Deccan Engineering Ltd. had agency to sell mopeds in South India.

Managfng Director's son Ajit, qualifred from IIT, has become Executive

Director. He then decided to carry out job evaluation as he felt

that a few managers who had been promoted from the ranks were

not classified correctly and pay, allowances and perks were not

rationalized. Some of the senior managers and one or two directors

were not keen to disturb the present set up and felt ad-hoc inirements

could be granted to solve the problem

Ajil, however, got a well known management consultancy frm from

Mumbai to do the job. In all there were forty persons in managerial

grades in six different categories -'group six being the lowest.

Job descriptions were revised and newly made, questionnaires were

prepared and two persons from the consultaniy frrm submitted pheir

recommendations.

Mr. Tambe, who lrad joined as a senior clerk from a chartered

accountant's firm had twenty one years service. He was a B.Com.

but had no additional qualification. Recently he was promoted from


' his group six to the superintendent's group frve.

Job evaluation was kept confidential and managers were informed

category to which they belonged. Mr. Tambe was informed that the

job he was doing in accountsdepartment was that of a senior supervisor,

he would continue to be in group six and he will not receive any

more increments till additional responsibility is given to him. He

heard in the lunch room that some of his friends who had only

tcn years service were placed in group 4 and 5.

Mr. Tambe sought an appointment with Chief Accountant, who assured

to look into his case. Thereafter Mr. Tambe did not receive his

annual increment and also rise in conveyanceexpense reimbursement

and HRA which was given to all other managers. Mr' Tambe wrote

a letter in anger to Chief Accountant. Chief Accountant consulted

considered and some benefrts will be given. After some time Mr.

Tambe wrote another letter to the Chief Accountant and conv to

personnel manager. He was interviewed by personnel manager and

glven assurance.

Thereaftel, Mr. Tambe, along with other employees, was given

a radio-cum-clock on completing twenty years service. Mr. Tambe

wrote a letter to the managing director and returned the radio

stating that he was disappointed by the treatment given to a loyal

employee.

Managing director asked chief accountant and personnel manager

to piit up a note to him separately. He wanted the personnel manager

to draft a short letter to the department heads to avoid such cases

in future.

big size pumPs and emPloYing 850 workers and staff. The year ends

work of several pumps is undertaken simultaneously. This year the

company has an ambitious target of manufacturing plmps worth

125 crores and by February end the production had reached a frgure

of 108 crores. Many pumps were in the final stage. March is. an

important month because balance production could be achieved if

everythirig went well.

Towards end February there were elections of .the union and new

president waS elected. While assuming office he wanted something

from management and as such put up demands that workmen be

given milk and all the office bearers of the union be given permanent

frrst shift. He desired a meeting with general manager.

The general manager conveyed that he was busy and hence the

works manager be contacted. The works manager said that's for

milk the demand was part of the existing settlement and union

should not agitate.on that matter. Regarding first shift he said

that personnel manager was the best judge. The personnel manager

did not agree to first shift.

Workers then organized under a union. The union submitted a charter
of demands but there was no settlement. The union then soughl,
intervention of labor offrce.-The matter was admitted in conciliation
but there also there was no settlernent. The matter was then referred
to industrial tribunal for adjudication.

In the mean time, the employer threatened the workers of closure


and made them sign a settlement on his terms and conditions. The
union was kept out. The workers sig:ned the settlement under a
fear of closure and losing their job.

In the industrial tribunal the union argued that the settlement is


under coercionand threat of closure as such it is not a fair settlement
and the matter be adjudicated. The corrtpany opposed it saying once
a settlement then no intervention. The industrial tribunal asked the
union to frle affidavits of workers. All workers made affidavits that
the settlement was under coercion and threat.

The company then got wild and is now threatening the workers
that either they file another affrdavit sayrng earlier affrdavit was
under pressure of union and they willingly accept the settlement,
otherwise the company will recover all the benefrts and wage rise
given under the settlement and then close the unit permanently.
