Introduction

On October 21, 2010, the XXXX family obtained a Restraining Order against Marsha Weber. (See
Restraining Order attached hereto as Exhibit A) Said Restraining Order was based upon Marsha Weberʼs
continuous harassment of the XXXX family and her intentional vandalization of the XXXX familyʼs home.
Marsha Weberʼs conduct was captured by the XXXXʼs home security cameras, was observed by several
independent witnesses, and was documented by the Ventura Police Department. Presently, Marsha
Weber is continuing to harass the XXXX family in defiance of this Courtʼs mandate and constantly violates
both the letter and the spirit of the Restraining Order. Said Restraining Order violations have also been
captured by the XXXX familyʼs security cameras, have been observed by several independent witnesses,
and have been documented by the Ventura Police Department. The XXXX family has attempted to
preclude the need for further judicial intervention in this action by corresponding with Marsha Weberʼs
attorneys on several occasions, requesting that they attempt to get Marsha Weber to voluntarily abide by
the terms of the Restraining Order. Unfortunately, said attempts to secure amicable compliance have
been fruitless and Marsha Weber continues to ignore this Courtʼs Order. In fact, in the past 4 weeks,
Marsha Weber has increased the frequency and intensity of her harassment of the XXXXs. Accordingly,
the XXXX family has been forced to bring this Motion and hopes that this Court can somehow find a way
to make Marsha Weber abide by the terms of the Restraining Order and stop harassing the XXXX family.

Harassment Prior to Restraining Order

Marsha Weber and her husband Leonard began a pattern of continuous harassment of the XXXX family
almost immediately after the XXXX family purchased their home. (See Video Still attached hereto as
Exhibit B) Marsha Weber filed several baseless complaints against the XXXX family with the Ventura
Keys Homeownerʼs Association that the HOA investigated and deemed to be unfounded. Marsha Weber
filed baseless complaints against the XXXX family with the City of Ventura that the responding
investigators deemed to be unfounded. Marsha Weber wrote defamatory letters to the XXXX familyʼs
neighbors making false claims and untruthfully disparaging the XXXX familyʼs reputation. (See Letter
attached hereto as Exhibit C) Marsha and Leonard Weber constantly threw trash over the XXXX familyʼs
border fence, constantly screamed obscenities at the XXXX family over said fence, and constantly
pounded on the border fence with poles and sticks to annoy the XXXX family in an attempt to provoke a
confrontation. (See Video Still attached hereto as Exhibit D) Marsha and Leonard Weber constantly
moved the XXXX familyʼs garbage cans into the middle of the street, into the middle of the sidewalk, and
placed them in front of the XXXX familyʼs cars so that ingress and egress to the family home was
obstructed. Marsha and Leonard Weber constantly trespassed on the XXXX familyʼs property, taunting
the XXXXs and attempted to provoke confrontations. (See Video Still attached hereto as Exhibit E). In
short, Marsha Weber has terrorized the XXXX family as described above without cause and without
provocation for almost two years.

In addition to the foregoing, on June 24, 2010, Marsha Weber intentionally vandalized the XXXX family
home causing significant water damage. Marsha Weber turned her garden hose on full, secured it to the
top of the border fence, intentionally aimed it into the XXXX familyʼs open bedroom window 3 feet away,
and left it spraying on full to flood the XXXXsʼ guest bedroom. (See Video Stills attached hereto as Exhibit
F) Marsha Weberʼs criminal actions caused water damage to the XXXXsʼ guest bedroom requiring
$980.45 for water remediation and repair services. During the trial, the Judge asked Marsha Weber why
she vandalized the XXXXsʻ home. After lying to the Judge several times under oath by stating that she
did it because the nozzle was broken, she finally admitted that she did it “Because I was very frustrated
from the morning activities of him ... I was frustrated, I donʼt know how to get back at him.” (See Audio
Transcript of Trial @ 12:33) Finding Marsha Weber liable for the damage caused by her willful actions, a
judgment was issued in favor of the XXXX family for the full amount claimed. (See Judgment attached
hereto as Exhibit G)

For all of the foregoing reasons, the XXXX family was forced to seek a Restraining Order to curb Marsha
Weberʼs destructive conduct and to prevent her from further harassing the XXXX family. On October 21,
2010, this Court issued a Restraining Order against Marsha Weber and instructed her to refrain from
further harassing the XXXX family. (See Restraining Order attached hereto as Exhibit A)

Violations of Restraining Order

Marsha Weber is willfully defying this Courtʼs mandate by continuing to harass the XXXX family and has
violated both the letter and the spirit of the Restraining Order on many occasions. Said continuing
harassment and resulting Restraining Order violations have been captured by the XXXX familyʼs security
cameras, have been observed by several independent witnesses, and have been documented by the
Ventura Police Department. Until now, the XXXX family has chosen not to respond to Marsha Weberʼs
frequent violations and has continued to turn the other cheek. However, Marsha Weberʼs attacks upon
the XXXX family have escalated as of late and the XXXX family once again needs the assistance of this
Court.

Marsha Weber has continued throwing trash over the border fence onto the XXXX familyʼs property, has
continued to push large 10 foot tall boards over the border fence onto the XXXX familyʼs property, has
continued to move the XXXX familyʼs garbage cans into the middle of the street, has continued to yell
obscenities at the XXXX family over the border fence, has continued to display her middle finger at the
XXXX family every time she passes by one of them in the neighborhood, and has continued to verbally
assault the XXXX family without provocation on numerous occasions. A few of the more serious
instances of Marsha Weberʼs frequent violations of the Restraining Order for which independent
witnesses were present are listed below as examples of her continuing harassment.

On December 17, 2010, Marsha Weber called the Police and filed a false report alleging that XXXX
violated the mutual XXXX/Weber Restraining Order on several occasions. After thoroughly investigating
the allegations, the investigating Police Officer found that XXXX had committed no violations and was in
full compliance with the Order. The investigating Officer also found that the Webers were intentionally
instigating confrontations to which XXXX did not respond. The Officerʼs report specifically stated:

“It appears that Leonard and Marsha Weber are going to the extremes as far as parking in front of the
XXXXʼs house and moving his trashcans. It appears that they are almost instigating the problems and
making it worse. Both Leonard and Marsha were advised not to cause anymore problems.”

Upon Marsha Weber complaining to the investigating Officer of financial abuse with regard to the XXXX
familyʼs emails to the Webersʼ attorneys, the Officer stated:

“I advised her that he had been emailing her attorney in reference to the incidences that both Leonard
and Marsha were bringing upon themselves.”

In addition to the foregoing, Marsha Weber admitted to the investigating Officer that she continues to
trespass upon the XXXXsʼ property, continues to push items over the fence and onto the XXXXsʼ
property, and continues to move the XXXXsʼ trash cans into the middle of the sidewalk. (See Police
Report attached hereto as Exhibit H) This conduct is a willful violation of the Restraining Order that
XXXX has against Marsha Weber.

On 03/12/11 at 6:00 pm, while XXXX was on Seaview Ave. talking with a group of neighbors, Marsha
Weber drove by, swerved to the wrong side of the street so as to be closer to XXXX, slowed down her
car and rolled down her window, displayed the middle finger at XXXX, and yelled, "Fuck you, you fucking
bastard lawyer." (See Police Report attached hereto as Exhibit I; Declaration of YYYY attached hereto as

Exhibit J) This conduct was a willful violation of the Restraining Order that the XXXX family has against
Marsha Weber. During the Police Officerʼs investigation of this incident, Marsha Weber claimed that
XXXX provoked her by making a derogatory comment immediately prior to her verbal assault. However,
the witness testimony and video evidence expressly contradict Marsha Weberʼs false claim. The true
facts are that, immediately prior to this incident, XXXX had no contact, verbal or otherwise, with Marsha
Weber or any member of her family. In addition, XXXX did not respond to Marsha Weberʼs verbal assault
and, once again, turned the other cheek. (See Declaration of YYYY attached hereto as Exhibit J; Video of
Incident) Attempting once again to get Marsha Weber to leave the XXXX family alone without further
judicial intervention, XXXX wrote a letter to Marsha Weberʼs attorney detailing the incident. (See Letter
attached hereto as Exhibit K) No response to the letter was received. Later than evening, from 11:00
p.m. until 1:00 a.m., someone in Marsha Weberʼs yard incessantly pounded on the XXXX familyʼs border
fence and once again yelled obscenities at the XXXX family home. (See Police Report attached hereto as
Exhibit I)

On March 13, 2011, at 11:30 a.m., Marsha Weber painted a sign on her broom that read "LOATHESOME"
and again began pounding on the XXXX familyʼs border fence, yelling obscenities and waving her sign
above the fence toward the XXXX familyʼs breakfast nook approximately 6 feet away. (See Picture
attached hereto as Exhibit L; Police Report attached hereto as Exhibit I) This conduct was a willful
violation of the Restraining Order that XXXX has against Marsha Weber. After approximately 10 minutes
of waving, pounding, and yelling, Marsha Weber fastened her "LOATHESOME" sign to the border fence
facing the XXXX family home and left it there. Shortly thereafter, Marsha Weber again began yelling
obscenities at XXXX while repeatedly opening and slamming her garage side door that is located
approximately 6 feet from the XXXX familyʼs living room. (See Police Report attached hereto as Exhibit I)
XXXX, once again, did not respond to Marsha Weberʼs attempts to provoke him. Not knowing how to
prevent Marsha Weber from further violating the Restraining Order, XXXX finally called the police for
assistance. Approximately 15 minutes later, while VPD Officer Alexander was at the XXXX familyʼs
residence, Marsha Weber again started yelling obscenities over the fence and repeatedly opened and
slammed her garage side door, unaware that a Police Officer was present and observing her conduct.
(See Police Report attached hereto as Exhibit I) This conduct was also a willful violation of the
Restraining Order that the XXXX family has against Marsha Weber. Thereafter, Officer Alexander
interviewed Marsha Weber regarding her conduct, during which Ms. Weber admitted that she had in fact
been waiving the sign at issue and yelling obscenities over the fence. (See Police Report attached hereto
as Exhibit I) Officer Alexander then proceeded to interview the neighbors as to what they witnessed,
when Marsha Weber again came out of her residence and began repeatedly yelling “You fucking liar!” at
XXXX. (See Police Report attached hereto as Exhibit I) Again, XXXX did not respond to Marsha Weberʼs
attempts to provoke him. Hoping to preclude the need for further judicial intervention in this matter, XXXX
attempted to get Marsha Weber to leave the XXXX family alone by once again writing a letter to Marsha
Weberʼs attorney detailing the incident and requesting assistance. (See Letter attached hereto as Exhibit
M) No response to the request was received.

Most recently, on April 28, 2011, immediately after XXXX put his garbage cans out, Marsha Weber started
moving them to once again block XXXXs familyʼs driveway. Upon XXXX asking Marsha Weber to leave
the XXXXsʼ trash cans alone, Marsha Weber threw her hands up and responded, “Fuck you, call the
fucking police.” (See Video Stills attached hereto as Exhibit N) This conduct was a willful violation of the
Restraining Order that XXXX has against Marsha Weber.

Marsha Weber terrorized the XXXX family as described above without cause and without provocation for
almost two years. The XXXX family sought to protect themselves from further harassment by requesting
that this Court issue a Restraining Order against Marsha Weber. On October 21, 2010, this Court issued
the requested Restraining Order and instructed Marsha Weber to refrain from further harassing the XXXX
family. Marsha Weber has chosen to defy this Courtʼs Order and continues to harass the XXXX family.
Said continuing harassment and resulting Restraining Order violations have been captured by the XXXX
familyʼs security cameras, have been observed by several independent witnesses, and have been
documented by the Ventura Police Department. The XXXX family has made several attempts to secure
Marsha Weberʼs voluntary compliance with the Restraining Order prior to filing this Motion. Unfortunately,
Marsha Weber refuses to voluntarily comply with this Courtʼs mandate and choses to continue harassing
the XXXX family. Therefore, the XXXX family does hereby respectfully request that this Court enforce the
terms of the Restraining Order, once again instruct Marsha Weber to stop harassing the XXXX family, and
fine Marsha Weber an amount sufficient to motivate her to comply with this Courtʼs mandates.
