Pursuant to Local Rule 83.7(c), attorneys Kevin M. Toner and Kyle B. Osting of

the law firm of Baker & Daniels LLP ("Attorneys") respectfully move the Court for leave to

withdraw their appearance on behalf of defendants Germaine Tomlinson Insurance Trust Dated

January 23, 2006, lB. Carlson, its Trustee, and The Carlson Media Group, Inc. (collectively

"Trust Defendants").

On August 20,2010 Attorneys notified J.B. Carlson, as the Trust Defendants'

representative, of their intent to withdraw their appearance in this action. On September 15,

2010, Attorneys notified the Trust Defendants of their intent to present this motion to the Court

today. Undersigned counsel has delivered today by electronic and first class mail a copy of this

motion to J.B. Carlson, who currently remains Trustee ofthe Tomlinson Insurance Trust and

President of The Carlson Media Group, Inc., and to Dennis F. McCrosson who represents the

Trust Defendants in this action as co-counsel. A copy of the letter transmitting this motion is

attached as Exhibit 1.

WHEREF"ORE, Attorneys respectfully request the Court for leave to withdraw

their appearance for the Trust Defendants effective September 24, 2010, which is eight (8) days

from now.
