PLAINTIFF’S REPLY TO DEFENDANTS, EDGAR and CAREN HALE

ON BEHALF OF PLAINS RADIO NETWORK, INC. and BAR H FARMS,
INC. LETTER RESPONSE of MAY 26, 2011
TO THE HONORABLE COURT:
In response to this Court’s Order of May 26, 2011, Plaintiffs Philip J. Berg,
Esquire, in pro se and as Counsel for the Plaintiffs upon Pro Hac Vice admission,
Evelyn Adams, Lisa Liberi, Lisa Ostella, Go Excel Global and the Law Offices of
Philip J. Berg file the within Reply to Defendants Edgar and Caren Hale on behalf
of Plains Radio Network, Inc., KPRN AM 1610 and Bar H. Farms, Inc.
[hereinafter at times “Defendants”] Response to this Court’s Order of May 20,
2011, Docket No. 175. In support hereof, Plaintiffs aver as follows:
This Court issued an Order upon Edgar and Caren Hale directing them to
notify the Court of the Status of their Corporations, Plains Radio Network, Inc.,
KPRN AM 1610, and Bar H. Farms, Inc.
On May 26, 2011, Defendants complied stating that Plains Radio Network,
Inc. was no longer a corporation; that KPRN AM 1610 was part of Plains Radio
Network, Inc.; and they state “Bar H Farms: I have no idea where or what that
is…How these people figured out to sue a email account is beyond me.”
[Defendants letter brief, page 1, ¶2]. Unfortunately, Defendants Caren and Edgar
Hale were not honest with this Court.

Edgar and Caren Hale have a website set up at http://barhfarms.net, entitled
“Bar H Farms, Inc.” See EXHIBIT “1”. Defendant Caren Hale has a myspace
page at http://www.myspace.com/carenhale, wherein Defendant Caren Hale states
she is owner and operator of Bar H Farms, Inc. See EXHIBIT “2”. According to
the Nevada Secretary of State, Edgar and Caren Hale incorporated Bar H Farms in
or about December 2005. See EXHIBIT “3’. Further, according to the Texas
Comptroller’s Office, Bar H Farms, Inc. is listed as a taxable Entity with a file
number 0800577767. See EXHIBIT “4”.
In addition, the Defendants statements regarding the undersigned are not
accurate.
Obviously, Caren and Edgar Hale’s statements to this Court are untruthful
and should not be tolerated. Although, Defendants are pro se, and given a little
more leeway then that of an Attorney, they are still required to answer the Court
honestly, not perjure their testimony and follow the Federal Rules and this Court’s
local rules. See Bookman v. Shubzda, 945 F. Supp. at 1004-1005 (citing Jones v.
Sheehan, Young, & Culp, P.C., 82 F.3d at 1338; Douglass v. United Servs. Auto.
Ass'n, 65 F.3d 452, 455 N.4 (5th Cir. 1995)(cautioning pro se litigant that
disregard for rules of appellate procedure may result in dismissal), aff'd on reh'g en
banc on other grounds, 789 F.3d 1415 (1996)), Christian v. Dallas, 64 F.Supp.2d
at 623; Buckley v. Dallas County, Civil Action No. 3:97-CV-1649-BC, 2000 WL

502845 at *4 (N.D.Tex. April 27, 2000). A pro se litigant must follow the same
procedural rules governing all litigants. Christian v. Dallas, 64 F.Supp.2d at 623
(citing Martin v. Harrison County Jail, 975 F.2d 192, 193 (5th Cir. 1992).
Defendants also failed to serve any of the parties with their response and
failed to include a Certificate of Service, as required by the Federal Rules of Civil
Procedure and this Court’s Local Rules.
