TERMS OF AGREEMENT RENT IS DUE & PAYABLE IN FULL PAYMENT BY PERSONAL CECK OR MONEY ORDER ON OR BEFORE THE FIRST DAY OF THE MONTH, PAYABLE IN ADVANCE WITH NO GRACE PERIOD. Payments hereunder are to be made to WHD Rentals, LLC at 1617 Coronation Ct., Green Bay, WI 54313. Rental payments are to be made to the above address. Vacating notices and all other correspondence must be sent in writing to the Landlord at the above address. The unit shall be occupied only by the party(s) named above. All Tenants, if more than one, shall be jointly and severally liable for the full amount of any payments due under this lease. Tenant understands that if he/she vacates the unit before the end of the lease term, Landlord will charge the Tenant the cost of advertising, showing and any other expenses incurred to rerent the apartment. The Tenant understands that he/she is obligated for rent loss through the end of the lease term unless the apartment is rerented to another Tenant who has executed a new lease and has taken possession of the premises. The premises are to be used only as a private residence for Tenant(s) and their minor children. Tenant will not permit nor invite any guest to reside in the premises without prior written consent of the Landlord. Occupancy by guests for more than any 10 days in a six month period is prohibited without Landlords written consent and will be considered a breach of this Agreement. Tenant will notify Landlord in advance if Tenant will be away from the premises for ten or more consecutive days. The Landlord may enter the premises at reasonable times and with 12 hours notice, with or without the Tenants permission to inspect the premises, make repairs, show the apartment to prospective Tenants or Purchasers, or to comply with any applicable law or regulate-on. The Landlord may enter with less than 12 hours advance notice upon specific consent of the Tenant. No advance notice is required for entry in a health or safety emergency or where entry is necessary to preserve and protect the premises from damage in the Tenants absence. All public areas (hallways, basement and outside areas) must be kept clean of all personal property. Tenants must park vehicles in assigned parking spaces only. Parking areas are reserved for passenger automobiles only; no trucks, motor homes, camper trailers or boat trailers are allowed without written approval from Landlord. All parked vehicles must have unexpired plates and be operative. Management reserves the right to remove inoperative and/or unlicensed vehicles at the expense of the Tenant. If premises parking area is serviced by a snow removal service, tenants are asked to move cars to allow snowplows to do a thorough job of cleaning up the parking lot. Tenant agrees to use the premises for residential purposes only by themselves and the minor children listed above. Premises include the following furnishings and appliances: Refrigerator, range, dishwasher garbage disposal; mini blinds, air conditioners, ceiling fans. Tenant agrees not to make or permit use of the premises for any unlawful purpose or any purpose that will injure the reputation of the premises or the building of which they are a part. Tenant agrees not to use or keep in or about the premises anything, which would adversely affect coverage of the premises, or the building of which they are a part under a standard fire and extended insurance policy. Tenant is responsible for all acts of negligence or breaches of this agreement by Tenant and Tenants guests and invitees, and to be liable for any resulting property damage or injury. Tenant agrees not to make excessive noise or engage in activities, which unduly disturb neighbors. This includes residents in the building, in which the premises are located. Tenant agrees not to keep in or about the premises any pet unless specifically authorized in writing, as a special condition in this lease. Pets are not permitted to visit for any length of time. Tenant agrees to obey all lawful orders, rules and regulations of all governmental authorities. Tenant will keep the premises clean, sanitary and in good condition and, upon termination of the tenancy, return the premises to Landlord in a condition identical to that which existed when Tenant took occupancy, except for ordinary wear and tear. Tenant will immediately

notify Landlord of any defects or dangerous conditions in and about the premises of which Tenant becomes aware. Such notification shall be in writing. 18. Under any circumstances the Tenant must give the Landlord and the Landlord must receive WRITTEN notice of termination of tenancy AT LEAST 28 DAYS PRIOR to the last day of the Tenants final month of tenancy. The day of delivery of notice to Landlord shall not be counted as part of the notice period. The notice MUST be sent directly to the address above. 19. The Tenant expressly agrees that such security deposit shall not be regarded as trust funds and the relationship between the Landlord and Tenant with regards to said deposit shall be that of Debtor and Creditor only and that said funds may be paid to the Landlord by any managing agent of the Landlord. Tenant understands that rent which is received with a United States postal mark dated after the first of the month is subject to a Five ($5.00) dollar per day late charge which must be paid within the same month in which the late charge was incurred. Tenant Initial Landlord/Agent Initial Tenant agrees that all checks returned from the bank for NonSufficient funds or due to a Stop Payment Order will be assessed a Thirtyfive dollar ($35.00) penalty. Replacement of said funds would be in the form of certified funds. A second occurrence will result in the payment being treated as a late rent and will be subject to the Five dollar ($5.00) per day late charge as described in Provision No. 1. The late charge must be paid within the same month in which the charge was incurred. The Tenant shall have seven days after the beginning of occupancy to advise Landlord of any other damages which existed prior to his/her occupancy. Tenant will reimburse Landlord, on demand by Landlord, for the cost of any repairs to the premises damaged by Tenant or Tenants guests or business invitees through misuse or neglect. Tenant Initial Landlord/Agent Initial Tenant understands that if he/she is obligated to pay for heat for the premises, and Tenant shall maintain a reasonable amount of heat in cold weather to prevent damage to the premises, and if damage results from the Tenants failure to maintain a reasonable amount of heat, the Tenant shall be liable for this damage. Tenant Initial Landlord/Agent Initial Tenant understands that he/she is not permitted to paint. The Tenant will not alter or redecorate the premises. The Tenant may not drive nails, tacks, screws, or apply other fasteners on or into any wall, ceiling, floor or woodwork of the premises. The Tenant shall not attach or affix anything to the exterior of the premises of the building in which it is located. Tenant Initial Landlord/Agent Initial The water closets and other water apparatus shall not be used for any purpose other than that for which they were construed, and no sweepings, rubbish; rags, paper or other substances shall be thrown herein. Any damage resulting to them from misuse of any nature or character whatever shall be paid by Tenant. Tenant Initial Landlord/Agent Initial Tenant expressly agrees that Landlord shall not be liable to Tenant or others, including Tenants occupants, guests, and invitees, from any cause whatsoever other than the negligent acts of Landlord. It is the responsibility of the Tenant to provide insurance for their liability, covering the leased premises. Tenant Initial Landlord/Agent Initial Tenants are responsible to adequately supervise their children as to their safety and conduct. Tenant expressly agrees that Landlord shall not be liable for any injuries to the person of Tenant or other, including the Tenants occupants, guests, and invitees, from any cause whatsoever other than the negligent acts of the Landlord. Tenant Initial Landlord/Agent Initial Tenant and Tenants occupants, guests and invitees shall not become intoxicated, disorderly, harass or solicit Tenants, their guests, or others, create or cause any odors or create or permit any unnecessary, unreasonable or improper noise or disturbance. Tenants and their guests shall not use hallways, stairways, garages, carports and parking for recreation or play. Tenant Initial Landlord/Agent Initial Wisconsin law requires that the Landlord maintain any smoke detectors located in any building common areas. State law further requires that THE TENANT MUST EITHER MAINTAIN ANY SMOKE DETECTOR ON THE PREMISES OR GIVE LANDLORD WRITTEN NOTICE WHENEVER A SMOKE DETECTOR ON THE PREMISES IS NOT FUNCTIONAL. The Landlord shall provide, within five days of receipt of any such notice, any maintenance necessary to make that smoke detector functional. Maintenance shall include the provision of new batteries, as needed. Tenant Initial Landlord/Agent Initial Tenant agrees to help keep the appearance of your unit attractive. Motorcycles shall not be left on the grounds or attached in any manner to the building or lampposts. Bicycles shall be attached in the area provided. Tenant agrees to keep bicycle(s) in their assigned storage area. The premises shall not be defaced with signs, advertisements, TV antennas, or satellite dishes. Entrances, hallways, stairways, laundry rooms and storage rooms shall be free and clear from any obstructions in accordance with fire safety regulations. Tenant understands there is no smoking in the front lawn, parking or common areas. Tenant Initial Landlord/Agent Initial Tenant agrees to use appropriate trash receptacles, such as plastic garbage bags and/or garbage cans and to place garbage securely inside of each. No bundles, refuse or articles are permitted in hallways or on balconies. Garbage is to be placed on the curb no sooner than noon of the day prior to garbage pickup. Tenant agrees to comply with all laws, orders and regulations of all state, federal, municipal and local governments regarding collection, sorting separation and recycling of waste products, garbage, refuses and trash. Tenant shall sort and separate such items into categories as provided by law, and in accordance with the rules and regulations adopted by the Landlord for the sorting and separating of such designated recyclable materials. The Tenant shall pay all costs, expenses, fines, penalties, or damages imposed on the Landlord or Tenant by reason of the Tenants failure to comply with recycling requirements. The Tenants noncompliance with recycling requirements shall constitute a violation or breach of Tenants lease. Tenant Initial Landlord/Agent Initial 15. Tenant has received a copy of Protect Your Family from Lead in Your Home pamphlet. (Only applicable for rental property built prior to 1978, as required by U.S. Environmental Protection Agency, 1996) Tenant Initial Landlord/Agent Initial 16. Landlord shall, within twentyone (21) days after Tenant surrenders said premises, return the refundable portion of said security deposit to Tenant at the written address provided for such refund or to Tenants last known address, providing therewith a written statement accounting for any amounts withheld. Tenant Initial Landlord/Agent Initial Tenant grills are not allowed on any porches or porch areas (HOT OR COLD), lower and upper levels included. Tenants are not allowed to store anything on balconies, patios, or porches unless approved by the Landlord. In accordance with State Fire Code, grills with hot ashes will be 15 feet from any combustible walls or open windows (in other words, the building). After grilling and the charcoal grill is cool, the grill must be stored in the tenants storage areas.
