Friday Report - April 8, 2011


THIS FORMAT FOR THE ELECTRONIC FRIDAY REPORT IS DESIGNED TO BE PDA FRIENDLY AND STILL GIVE YOU ACCESS TO THE ENTIRE CONTENT. Click to view the entire printed version of the Friday Report. 1. ATI/POINT OF SALE - H. 3713 AND S. 647 A. IN THE HOUSE: The House Ways and Means Committee reported H. 3713 to the floor with a favorable report. The committee removed the retroactive application of the bill. H. 3713 will have an annual fiscal impact of $52 million. An Estimate of Impact by County produced by the Board of Economic Advisors is attached. The sheet shows the direct impact on all entities which rely on property taxes. The schools are impacted through the Index of Taxpaying Ability, and any school district in a county above the average impact noted would probably receive more money under the Education Finance Act (EFA). School districts in counties falling somewhere below the average would have their EFA money reduced. Contact your house members, and ask that they object to H. 3713 when it comes up for debate on Tuesday and work to defeat this awful tax policy. H. 3713 will produce greater problems than proponents say it will solve. B. WHEN YOU TALK TO LEGISLATORS, ASK THEM: Why would you want to discourage new investment and a larger number of jobs? New investment and construction create far more jobs than the churning of existing properties. By eliminating ATI/point of sale (which means the buyer pays taxes on less than what they said the property is worth when they bought it), the General Assembly will create a tax policy that discourages new investment and construction. S. 647 and H. 3713 force potential buyers of new

construction to pay tax on 100 percent of the value of their property, while purchasers of existing property with an exemption under the 15 percent valuation cap pay on less than 100 percent of the value of their property. In effect, this is a tax subsidy for those who decide not to add to the tax base or create large numbers of jobs. Why would you want to raise taxes on or shift taxes to so many of your constituents? In most counties, the majority of property owners are taxed on 100 percent of the value of their house or business. Assuming these bills were to pass, everyone buying a property that gets an exemption under the 15 percent valuation cap would be taxed on the previous owner's lower than 100 percent tax valuation. Bond payments must be paid, and the millage must go up to offset any decrease in taxable value. Any new millage levied would fall disproportionately on those paying tax on 100 percent of their value, as well. To the extent the millage rate limitation allows operating millage to increase to cover operating costs, the same is true. Why would you want to cut basic services to people in your district? The loss in tax base value will likely mean that growth in the value of a mill will not keep pace with rising costs of gasoline, wages, health insurance, medical equipment for ambulances, etc. Under the hard millage rate cap, operating revenue may not be able to offset the cost increases of existing services. In those instances where the cost of existing services exceeds the growth of the tax base, there will be service cuts to existing citizens. This is compounded by cuts to the Local Government Fund - $20 million less than last year in the House-passed budget. IF THE ANSWER TO ANY OF THESE QUESTIONS IS "I DON'T," THEY SHOULD BE WORKING AGAINST S. 647/H. 3713. C. IN THE SENATE: S. 647 is awaiting second reading on the contested Senate calendar. Senators arranged a meeting among the realtors, officers of the realtors and their McNair law firm lobbyists on the one hand and SCAC, MASC, the SCEA and S.C. School Boards Association on the other in an effort to find a compromise. The meeting was somewhat productive with both sides needing to explore some of the ideas put forth. NO BREAKTHROUGH OR AGREEMENT WAS REACHED. 2. MULTI-LOT DISCOUNT (MLD) - H. 3934 The House Ways and Means Committee gave H. 3934 a favorable report after proposing an amendment to delete Section 1 of the bill, which related to a provision new subdivisions cannot use. The fiscal impact of H. 3934 is $5.8 million. This is on top of the House LGF cuts and any impact of ATI/point of sale. H. 3934: Reduces the minimum number of lots to be eligible for the MLD from 10 to five lots. Eliminates the annual application after the initial application for the MLD. Grants an additional three years for the discount. Please contact House members, and ask them to object to H. 3934 when it comes up for debate on Tuesday. 3. SENATE FINANCE COMMITTEE TO TAKE UP THE BUDGET ON TUESDAY The Finance Proviso subcommittee finished their work, and the Finance Committee will begin deliberations on the budget next week. A. LGF Status. The House adopted a $20 million LGF cut below last year's level. The House cut reduces the LGF to $182.6 million, its lowest level since FY 95-96. This is a $53 million cut from the statutory funding level or a 22.5 percent cut from the statutory LGF formula. There has been no discussion of the LGF funding level at Finance Committee.

The Finance Committee has scheduled H. 3516, which would suspend the LGF formula, for consideration on Tuesday along with the budget bill. It is critical that you contact your Senators now, and explain the importance of this funding source. Assuming that millage rate increases are an option in a given county, many counties do not have enough millage rate raising capacity under the millage rate cap to make up the cut to their share of the LGF. B. Flexibility Proviso - 86.8. C. Use of 911 Funds. SCAC is supporting a proviso that would allow a local government that imposes a monthly 911 charge for public safety communications to use the Individual PSAP Communications Facility portion of the funds for the lease, purchase, lease-purchase or maintenance of emergency radios or other communications equipment--so long as the radios or equipment are used to dispatch public safety services to the appropriate public safety agency. The Finance Proviso subcommittee carried over this proviso. Senators have asked staff from SCAC and the Budget and Control Board to meet early Tuesday to work out details. Please contact your Senator and ask them to support this proviso. D. Traffic Cameras - Proviso 86.10. The House version of this proviso prohibits traffic citations which are based on camera-assisted evidence. The penalty in the House version is a reduction of LGF monies equal to the amount collected by fines. The penalty applies only to municipalities. The Proviso subcommittee considered an amendment to this proviso which substantially rewrote this section. That proviso would state that all political subdivisions must certify to the State Treasurer that they do not mail traffic tickets. A failure to certify will result in the withholding of Aid to Subdivisions monies. A willful violation will result in a penalty of two times the distribution of Aid to Subdivisions money. The subcommittee carried over this proviso. 4. JAILS A. Conditional Early Release Bonds - S. 194. The bill creates a procedure to give DOC the authority to release an inmate from custody upon the inmate posting an early release bond and complying with conditions of the bond as set by the director. Some local jails have expressed concern that if the bond is revoked the inmate is to be housed in a local detention facility, with no procedure for disposition of the bond revocation or release from that facility. Obviously, this could lead to shifting inmates serving sentences for up to five years for nonviolent crimes from state custody to the custody of county jails. The interested parties agreed that local jails should not be the ultimate holding facility for these types of revocation. A Senate Corrections subcommittee carried the bill over, citing several concerns with the proposed language. B. Inmate HIV and Hepatitis B Testing - H. 3679 and S. 568. 5. FINANCE AND TAXATION A. Transparency - S. 435. B. Tax Collectors - H. 3657. C. Miscellaneous Tax Provisions - H. 3650. 6. OTHER BILLS OF INTEREST A. Voter ID - H. 3003. The House took up the Senate version of H. 3003. They amended the bill by removing the early voting provisions. A person will be required to produce a current photo ID in order to vote. DMV will issue free ID cards to persons 17 or older, and will accept information from the DHEC's Bureau of Vital Statistics to verify a person's name and date of birth--if the person cannot produce a birth certificate. The State Election Commission is to set up a system to issue photo voter registration cards, provided the commission has the funds to implement this system. H. 3003 now returns to the Senate. This bill will probably end up in a conference committee.

B. Underground Facility Damage Prevention - S. 705. C. Road Transfers - H. 3266. This bill would allow road transfers between the state highway system and county systems. H. 3266 originally required approval of the local government or a majority of the county's legislative delegation for these transfers to occur. At the request of SCAC, the subcommittee amended the bill to require local government consent for road transfers. DOT asked that the legislative delegation be notified, instead of having to approve transfers. H. 3266 was given a favorable report with the proposed amendment. D. Lifeguards at Public Swimming Pools - H. 3994. H. 3994 would require all public swimming pools to have two lifeguards for every 40 swimmers and one lifeguard for every 20 swimmers above 40, which is the Red Cross standard. The bill also mandates more lifeguards be added, if deemed necessary by "pool management." H. 3994 was introduced last week and went without reference to a committee, precluding testimony and subcommittee debate. It is currently awaiting second reading on the contested House calendar. E. Dr. David Jeremiah For My people have committed two evils: They have forsaken Me, the fountain of living waters, and hewn themselves cisterns--broken cisterns that can hold no water. Jeremiah 2:13 Recommended Imagine an ever-flowing fountain, accessible and attractive, the waters fresh and pure. The flow is copious Reading as the water gurgles and splashes from rock to rock as if Jeremiah 2:913 dancing down stairsteps. There a person finds the overflow to meet his needs, irrigate his crops, and water his flocks. He never thirsts, and the fountain is never diminished in drought. Now imagine this man deliberately ignoring the fountain. With illogical obstinacy he prefers to dig a hole in the ground for run-off water, which quickly seeps out of his broken cistern, leaving him nothing but mud. That's the Bible's picture for those looking for happiness in the wrong places. The world is filled with broken cisterns--we can easily name them-but only Jesus can give satisfying joy. He said: "Whoever drinks of this water will thirst again, but whoever drinks of the water that I shall give him will never thirst. But the water that I shall give him will become in him a fountain of water springing up into everlasting life." True happiness is only in Christ, the living water. I came to Jesus, and I drank of that life-giving stream; my thirst was quenched, my soul revived, and now I live in Him. Horatius Bonar

The apostle Paul reminds us that our struggle is not against flesh and blood but against Satans dark forces. However, he goes on to provide tremendous hope and protection for every believer when he instructs us to

stand firm in our faith and take on the full armor of God each day (Ephesians 6:13-17). Before your feet hit the floor in the morning, make sure that you claim Gods armor as your protection. His angels are all around you, but when you clothe yourself for battle with the belt of truth, the breastplate of righteousness, the shield of faith, the helmet of salvation, and the sword of the Spirit, which is the Word of God, their job is made swifter and surer. Also, read through Ephesians 6 and allow it to be a firm reminder that God is your true refuge, and He has provided all that you need to live this life victoriously. Stand firm then, with the belt of truth buckled around your waist, with the breastplate of righteousness in place, 15 and with your feet fitted with the readiness that comes from the gospel of peace. 16 In addition to all this, take up the shield of faith, with which you can extinguish all the flaming arrows of the evil one. 17 Take the helmet of salvation and the sword of the Spirit, which is the word of God. A Heartfelt Act

Pastor Greg Laurie Assuredly, I say to you, wherever this gospel is preached in the whole world, what this woman has done will also be told as a memorial to her. Matthew 26:13 As you read the New Testament, you can't help but notice how little it says about the major events of world history. You might think Scripture would mention Rome and all its mighty conquests. But it doesn't. Instead, God brings out nuances that are entirely different. Here in Matthew 26, for example, we find a unique story that God wants us never to forget (see verse 13). It was the incredible sacrifice that a woman made for Jesus. What was it that she did that so impressed the Lord? Was it a miracle or some great teaching? No. It was a heartfelt act. There in the home of a man named Simon, this woman took a jar of expensive perfume and anointed Jesus with it. Why is this so significant? Her actions are memorable because she seemed to recognize that Jesus needed to be anointed for His burial (see verse 12). So with complete abandon, she gave Him everything she had. Mark's Gospel tells us her perfume cost more than 300 denarii (see Mark 14:5). In these times, 300 denarii was the equivalent of nearly a year's wages. But it wasn't the gift that mattered. It was her heart behind the gift. It was her motives that touched Jesus, because He knew she sacrificed nearly everything for Him. Are you doing all that you can for the Lord? Some people, like many of the dutiful Pharisees, will only give what is required. They will try to get

by with the bare minimum. In many ways, we can be like that too. Today, won't you commit to serving the Lord above and beyond what is requiredlike this woman did?

Man finds more than $70,000 for friends and relatives by using Treasurers website.
(Columbia, SC) Today State Treasurer Curtis Loftis presented a check for $66,481.39 which had gone unclaimed. A Midlands man worked with the Treasurers staff to return the property to the rightful owner. This is a great example of how easy our treasurer.sc.gov website is to use to find unclaimed property for people across South Carolina, Treasurer Loftis said. In this case, we were able to track down an old life insurance policy worth $66,000 and that money was just returned to the rightful owner. Midlands resident Jim Brantley credits using the State Treasurers website www.treasurer.sc.gov to find family and friends more than $70,000 recently. I had no idea one my relatives was owed $66,000, Brantley said. When I went to dinner with this relative and was told the dollar amount, I couldnt believe it. Ive found lots of friends and family with money owed listed on the Treasurers website, its great to give the good news. The $66,000 unclaimed property payout is one of the largest individual amounts given to an individual in recent times. (For security purposes and per the individual, the recipient is not being named.) The Palmetto Payback Program currently holds more than 1.5 million accounts totaling nearly $300 million. For fiscal year 2010, the program paid 13,629 claims; returning more than $12.2 million dollars to the rightful owners. The most common unclaimed properties are dormant bank accounts, uncashed insurance policies, unclaimed utility deposits, uncashed checks and forgotten stocks/bonds. Hi Classmates, Many of you may know by now but our classmate, Michael Williams passed away this morning. Some of our classmates were able to visit with Michael last month. Let us please try to represent the class of "78". When I get more details I will let you all know and if you should hear anything before I get back with you all please let me know. Below is an email that I recieved. Hopefully it's beneficial because males and females get thyroid cancer. I thought this was WORTH PASSING ALONG!, Dr. Oz had a show on the fastest growing cancer in, women, thyroid cancer. It was a very interesting program and he, mentioned that the increase could possibly be related to the use of, dental x-rays and mammograms. He demonstrated that on the apron the, dentist puts on you for your dental x-rays there is a little flap that, can be lifted up and wrapped around your neck. Many dentists don't, bother to use it. Also, there is something called a "thyroid guard", for use during mammograms. By coincidence, I had my yearly mammogram, yesterday. I felt a little silly, but I asked about the guard and sure, enough, the technician had one in a drawer. I asked why it wasn't, routinely used. Answer: "I don't know. You have to ask for it." Well, if I hadn't seen the show, how would I have known to ask?, Someone was nice enough to forward

Hi Patricia, I went to Mt. Chapel today for the above program. If you were there, I am sorry I missed you. I took a few notes that I would like to share with you. Order of Service Dea. Adger and Dea. Williams carried on Devotional Services. Scripture was read by Rev. McFadden, followed by a prayer by Rev. Chandler. The introduction of the speaker (Rev. Fred Addison, Associate Minister from Trinity) was done by Rev. Otis Williams. Rev. Addison used the Book of Ephesians 6:10-24, and his subject was A Strong Soldier for God. He said that every preacher needs a Cyrus or a Barnabas. He said that your spiritual training deals with your ups and your downs. He referred to Isaiah 7, wait on the Lord, and Psalm 24, the earthits fullness thereof Rev. Addison wants every Christian to join this Christian army and Jesus will come to your rescue. He made reference to 1st John 5:4, and he asked the question, Does God have a good track record with you? Rev. Lawson from Gum Spring blessed the offering and the Oratorical Contest began. Sis. Barbara White, Chairperson for the Young People, with the assistant of Sis. Eva Gaters, Co-Chair, introduced the contestants for this portion of the program. There were two (2) contestants, 1 for each category of the NJ Brockman and the C.O. Jackson awards. Tinisha Pendergrass from Mt. Chapel was award $100.00 and Jalicia Chandler from St. Mark got the 150.00. Both the young ladies did a fantastic job in their category. Of course they hope to critique some

things for the State Convention. Bro. Gabriel Oliver, Treasurer did the Young People Offering. The Offertory Prayer was done by Bro. Quavon Whitfield, President. Rev. Carnell Witherspoon got up and thank everybody for their efforts and hard work in making this program a success. The blessing of the food and the Benediction was done by Rev. Fred Addison. But prior to that, Rev. Chandler got up and announced the Week of Training, April 25-28 from 6 to 9 p.m.. This training will consist of 4 subjects: (1) Pastors/Ministers/Deacons/Trustees, (2) Building Church Leaders, (3) Youth, and (4) Music. I hope to be at the Building Church Leaders and the Youth sessions, if they do not conflict. Hope to see you soon. PS: Finally realize that upcoming events are listed in back of my program for 106. However, Day of Giving was not listed for today.

Friday Report - April 1, 2011

Items 1 and 2 in this Friday Report cover bills which will have a significant impact on local government revenue and services and will come up on Tuesday. Please read carefully and contact your legislators. The House and Senate have begun redistricting work in earnest, and the work on other bills has tailed off significantly to allow for those meetings to occur. There will be a dramatic drop off in work on legislation other than the budget as the redistricting process moves forward. ATI/Point of Sale - H. 3713 /S. 647 In the Senate: S. 647 was given a favorable report and is on the Senate contested calendar. The Senate Finance Committee proposed an amendment to change the effective date from 2006 to Jan. 1, 2011. This makes the first year fiscal impact $52 million, instead of $260 million. However, the fiscal impact will be $260 million in just a few years. During the committee meeting, Sen. Matthews asked why commercial realtors say investors are running to Georgia and North Carolina, when both of those states tax the full fair market value of property. Could it be that South Carolina has narrowed the tax base to the point that even with the 15 percent valuation cap in our state, they would rather pay tax on the full value in another state? That seemed to be what TRAC was saying when they studied the South Carolina sales tax system. In the House: H. 3713 is scheduled to be considered by the House Ways and Means Committee on Tuesday,

April 5, in Room 521 of the Blatt House Office Building, 90 minutes after the House adjourns. This will be no earlier than 2:30 p.m. H. 3713 is retroactive to 2006 and would have a $260 million first year impact. A committee roster is attached. There is no opportunity to speak at the committee meeting, so contact before the meeting is critical. When you talk to legislators, ask them: Why would you want to discourage new investment and large numbers of jobs? New investment and construction create far more jobs than the churning of existing properties. By eliminating ATI/point of sale (which means the buyer pays taxes on less than what they said the property is worth when they bought it), the General Assembly will create a tax policy that discourages new investment and construction. S. 647/H. 3713 force potential buyers of new construction to pay tax on 100 percent of the value of their property, while purchasers of existing property with an exemption under the 15 percent valuation cap pay on less than 100 percent of the value of their property. In effect, this is a tax subsidy for those who decide not to add to the tax base or create large numbers of jobs. Why would you want to raise taxes on or shift taxes to so many of your constituents? In most counties, the majority of property owners are taxed on 100 percent of the value of their house or business. Assuming these bills were to pass, everyone buying a property that gets an exemption under the 15 percent valuation cap would be taxed on the previous owner's lower than 100 percent tax valuation. Bond payments must be paid, and the millage must go up to offset any decrease in taxable value. Any new millage levied would fall disproportionately on those paying tax on 100 percent of their value as well. To the extent the millage rate limitation allows operating millage to increase to cover operating costs, the same is true. Why would you want to cut basic services to people in your district? The loss in tax base value will likely mean that growth in the value of a mill will not keep pace with rising costs of gasoline, wages, health insurance, medical equipment for ambulances, etc. Under the hard millage rate cap, operating revenue may not be able to offset the cost increases of existing services. In those instances where cost of existing services exceed the growth of the tax base, there will be service cuts to existing citizens. This is compounded by cuts to the Local Government Fund - $20 million less than last year in the House-passed budget. If the answer to any of these questions is "I don't," they should be working against S. 647/H. 3713. Multi-Lot Discount (MLD) - H. 3934 The House Ways and Means Property Tax subcommittee will consider H. 3934 to expand both the length of and eligibility for the current multi-lot discount on Tuesday, April 5, in Room 511 at 11:30 a.m. This is an effort to get H. 3934 on that afternoon's Ways and Means Committee agenda. The cost of the Senate version (S. 447) of this expanded tax break is $5.8 million. H. 3934 does the following: Reduces the minimum number of lots to be eligible for the MLD from 10 to five lots. Eliminates the annual application deadline, allowing the developer to request the MLD any time prior to the penalty date for taxes due on a lot. Grants an additional three years for the discount. Please contact the members of the Ways and Means Committee on the attached roster to let them know the impact of H. 3934. Senate Finance Subcommittees Continue Their Work on the Budget The Finance proviso subcommittee will consider all provisos adopted by subcommittees next week. The full Finance Committee will begin their deliberations on the budget the week of April

11. LGF Status. The House adopted a $20 million LGF cut below last year's level. The House cut reduces the LGF to $182.6 million, its lowest level since FY 95-96. This is a $53 million cut from the statutory funding level or a 22.5 percent cut from the statutory LGF formula. There has been no discussion of the LGF funding level at Finance Committee. It is critical that you contact your Senators now, and explain the importance of this funding source. Flexibility Proviso - 86.8. A Finance subcommittee adopted the SCAC supported version of the flexibility proviso this week. It is important that you contact your Senators and ask that they support this proviso. Use of 911 Funds. SCAC is supporting a proviso that would allow a local government that imposes a monthly 911 charge for public safety communications to use the Individual PSAP Communications Facility portion of the funds for the lease, purchase, lease-purchase or maintenance of emergency radios or other communications equipment--so long as the radios or equipment are used to dispatch public safety services to the appropriate public safety agency. A Finance subcommittee adopted this proviso this week. Please contact your Senator and ask that they support this proviso. Transparency - S. 435 Other Bills of Interest Restructuring - H. 3066. Employees on Boards or Commissions - H. 3625. Abandoned Boats - H. 3287. Fire Marshal Order Appeals - S. 693. Sailboats - S. 502. Civil No-Contact Orders - S. 53. Millage Rate Limitation Allowance Each year, the county may increase the millage rate over the rate imposed the previous year by the percentage increase in the CPI--as determined by the Budget and Control Board's Office of Research and Statistics--plus the percentage population increase in the county over the previous year. If either the CPI or population change is negative, that factor is considered to be zero. This is found in S.C. Code 6-1-320. The Budget and Control Board's Office of Research and Statistics has announced both the CPI to be used (1.64 percent) and population growth figures.
