Myself a considerable critic on various governments (of all colours) I face obviously the risk that any legislative powers will be to curtail my publications to somehow prevent me my right of freedom of speech, as anteed in the constitution. . Now, I am well aware that there is much debate that claims we do not have any guaranteed right of freedom of speech but then again I am a CONSTITUTIONALIST and As such understand the constitution to the intentions of the Framers of the Constitution and not what others may make out it to be. . POLITICAL LIBERTY was made clear by the Framers of the Constitution was a legal principle embedded in the constitution and so were CIVIL RIGHTS. Therefore the right of any person to sue within the ambit of tort/libel legal provisions will continue and as such the only perceived issues is

We cannot have a government being freely allowed to publish any deceptive statement and then the media (including authors/publishers like myself) beio9ng restrained in publications. . I have published many articles about lawyers, including judges, exposing their deception and none ever sued me because in particular when taking on judges I am well aware that one can easily be chartge3d with contempt of court merely by publishing something derogatory about a court, and in fact one judicial officer made a very unsuccessful attempt upon me but as I explained misread the legislation and so she failed in kit. Now, if publications were to be deemed by what a fair minded person would view, and then the judge has to deal with it then a person like myself would be left in the lurge that the judge with bias will then obviously rule against me. . Currently I have been well prepared to exercise my conbstituti8onasl rights and even State government hired lawyers, despite their elaborate attempts, have failed miserably in all kinds of attempts to stop me publishing or even to withdraw my writings. . In my view, the right to sue by any person exist by existing State legislation and privacy isnt going to be protected by prohibiting people against illegal phone tapping as if it is illegal then it is enforcement of existing law that is failing. . Those in government should remember that is was the very right of POLITICAL LIBERTY and CIVIL RIGHTS that enabled them to get into government, as had it been otherwise they still be out of government, hence they cannot deny the freedom and rights of others to have their say, even if that includes newspapers. . In the Gutnik case the High Court of Australia held that publication occurs where the person downloads it upon his computer. As such, how can the Commonwealth restrict publications of other sources from anywhere in the world versus limiting publications of newspapers (read any media format) or is it proposing to somehow restrict overseas publications like those in the Middle East showing young children parading with guns (See channel 7 24-7-2011 Sunday Night program re multiculterism), where this was puibli8shed in Australia? Get real, those who publish that from overseas will be beyond the powers of the Federal Government and what we really would get is government censorship that will seek to restrict free publications not just by the newspapers and television media outlets but also by independent authors and publishers like myself and yet nothing will be achieved to protect the privacy rights of a single person beyond what already exists. Because media on line is not a new item, as I receive for example various Dutch language newspapers regularly then clearly why should media based in the commonwealth of Australia be restricted where other media outlets not based in the commonwealth of Australia but legally still publishing her can publish unrestricted? . Again the High Court of Australia made its ruling and we should all accept this and adhere to this. You cannot restrict the Internet publications and again where there is a perceived breach of local laws then it will be up to the relevant State to cater for internal legislative provisions. The Framers of the Constitution made clear that any federal law must be uniform and as such if the Commonwealth does contemplate to restrict publications or otherwise under the claim of privacy seek to introduce legislation then it must consider that it cannot merely do so against media sources within the Commonwealth of Australia but not against foreign based publications received within
