Sent 14 March 2010 The following email is for Dr Ian Goodwin, and is to be taken as a final statement from Simon Kaiwai s immediate family (signed below). This is to replace all previous verbal or written communication given by the family members listed. All previous statements made by the family were based on information received from other parties. Information which has now been proven to be false, misleading, culturally insensitive, and a direct miscarriage of justice. Carolyn McKenzie (Simons Mother) visited with Simon, Susan and their children on 6-9 March 2010. This provided the opportunity to talk with Simon and view the evidence that he has of events that began in November 2009. This evidence includes a video of his arrest and his wife s eyewitness account, a power statement showing the property account being in credit and a subsequent medical report from an independent Doctor. The Police appeared to use unjustified force on Simon and resulted in a severe concussion. Following that he was kept in custody and questioned without examination by the Police or Doctors. The injury explains why Simon was unable to answer the questions clearly under custody - this was viewed by the Police as being uncooperative where in fact he was injured to the point of not being able to comprehend the questions. We have been advised that it is illegal to interview/question/put in Court someone with head injuries such as concussion. It is clear that Simon Kaiwai acted reasonably at the time he was taken into custody. He was not being uncooperative or suffering from mental instability. Simon was suffering from a serious head injury caused by the beating the Police had just given him. Our family has no medical history of any mental illness (including no querelent paranoia or delusion as is being alleged by Mr Goodwin). The following statement is written with all undersigned parties consent.

Simon is putting his family first. They are his priority. We support Simon s prioritisation which is to do his best for the family. Any comments outside of this was based on misleading information provided by the courts appointees while Simon was incarcerated and incommunicado. We see no reason for Dr Ian Goodwin and associates to be suggesting that Simon be medicated and hospitalised. It appears that they are seeking to destroy a happy and healthy family. Please correct all information that relates to the family and Simon in particular, to be consistent with the above. This information is given in good faith.
