An Open Letter CBCP President


Dear Msgr, Peace in Christ David Copperfield, the greatest illusionist magician successfully vanish the giant Statue of Liberty standing 350 feet and weighing 450,000 lbs. in front of an audience on Liberty Island in New York Harbor. According to history the Statue of Liberty was a gift of the Masonic brethren in France to the American Mason. It is the most popular National Monuments in the United States. But David Copperfield unsuccessfully vanish the COWD Board of Director members and selfish Cooperative leaders in our society. Why the Task Force Too-Big always lambast the COWD not the Rio Verde? The Cooperative leaders had selfish and interior motives because they will not informed the innocent concessionaires that there are some disadvantages if COWD will be form into cooperative and become private. Currently there is a rush to make local water districts a cooperative and this is only a step in toward the privatization of water services. The World Bank and International Monetary Fund (IMF) are pushing for the privatization of water services by multinational companies and capitalist businessmen. They are pushing cooperative and privatization through stipulations in trade agreements and loan conditions to developing countries. These programs started in the early 1990. The importance of water was also emphasized by Fortune magazine recently when it called water, "the oil of the 21st century." There will be Water deregulation the same for our Philippine Oil deregulation law which are common demand of the World Bank and IMF as part of their loan conditions. Msgr., if our local Cagayan de Oro City Water District will become private the cooperative leaders are more concerned with profits, so they will be willing to cut as many jobs as possible to continue to make profits. They would not care how many poor COWD employee families would be adversely affected by their actions. All they want is to provide a report to their executives and stockholders that show 'profit'. Many local water districts have continued to express concern that it will result in more retrenchment of the workers and the general state of lack of care for the ordinary people. Only the capitalist stock holders and the strong will enjoy the 'scramble and partition of all the "for sale" properties of our Philippine government. Therefore the private and cooperative water district will not also guarantee to solve of our domestic water problems because the selfish investors on the other hand, will allocate only the dividends for return of their investments. Why is it that the cooperative leaders are not going after the COWD Board of Directors who was responsible for the COWD-Rio Verde Bulk Water Supply Contract Scandal? Based on the GOCC Governance Act of 2011(SEC. 19): The members of the Board and Officers of GOCCs shall: Act with utmost and undivided loyalty to the GOCC and Fiduciary Duties of the Board and Officers avoid conflicts of interest and declare an interest they may have in any particular matter before the Board. The alleged COWD Board Resolution no. 222, s-04 dated December 09, 2004 appeared to have been issued in favor of the caprices of a Bulk Water Supplier Rio Verde Water Consortium, Inc., a non-responsive bidder. It was a clear violation of RA 9164. The COWD Board of Director Members then was composed of Mr. Frank Mendez, Chairman, Atty. Fred Gapuz, Vice Chairman, Dr. Raymundo Java, Mr. Sandy Bass and Mrs. Sarah Borja. Mr. Joel Baldelovar, now the COWD Board Chairman as also implicated.

Msgr., the COWD concerned employees will always be vigilant for the publics interest and that the BOD members will only unanimously approved with legal basis but not to their political debt of the City Mayor and with regard of the recent COWD financial and water crisis. The latest BOD Res. No.081, s-11 dated July 13, 2011 which extended the financial assistance of One Hundred Thousand Pesos (100,000.00) for the Kagay-an Festival 2011 upon the official written request of our City Mayor Vicente Y. Emano dated June 27, 2011. The COWD Board of Director Members then were composed of Mr. Joel A. Baldelovar, Chairman, Mr. Sandy Bass, Atty. Emmanuel A. Gaabucayan, Secretary, Ruben A. Vegafria, Mr. Soc Anthony M. del Rosario, Vice Chairman and the disgruntled Board of Director member who wants to turn the COWD into cooperative. Therefore, Mr. Joel A. Baldelovar and Mr. Soc Antony M. del Rosario we urge you to resign from the post because both of you had conflict of interest. It was a clear violation of the Administrative Order no. 103 directing the continued adoption of austerity measures in the government Sec.1 no. 8 suspension of the following: Donations, contributions, grants and gifts, except if said activities are undertaken pursuant to the mandate of the donor-agency. The EO no.24, transparency, accountability and prudence in the government-owned or-controlled corporation (GOCC) are government agencies and their funds are public funds which must be used prudently al the times with a view to prevent dissipation and waste. According to Article 217 Malversation of public funds or property; Presumption of malversation Any public officer who, by reason of the duties of his office, is accountable for public funds or property, shall appropriate the same or shall take or misappropriate or shall consent, through abandonment or negligence, shall permit any other person to take such public funds, or property, wholly or partially, or shall otherwise be guilty of the misappropriation or malversation of such funds or property, shall suffer: 1. The penalty of prison correctional in its medium and maximum periods, if the amount involved in the misappropriation or malversation does not exceed two hundred pesos. 2. The penalty of prison mayor in its minimum and medium periods, if the amount involved is more than two hundred pesos but does not exceed six thousand pesos. 3. The penalty of prison mayor in its maximum period to reclusion temporal in its minimum period if the amount involved is more than six thousand pesos but is less than twelve thousand pesos. 4. The penalty of reclusion temporal, in its medium and maximum periods, if the amount involved is more than twelve thousand pesos but is less than twenty-two thousand pesos. If the amount exceeds the latter, the penalty shall be reclusion temporal in its maximum period to reclusion perpetua. The COWD concerned employees are kind and religiously law-abiding, and we contend that BOD they are innocent until proven guilty. We were surprised to receive small amount that were unheard of after our nine months daily peaceful demonstration last year and after they told us Let them suffer. But we immediately felt that BOD was trying to buy our soul and to keep silence the latest BOD Res. No.081, s-11. Many COWD employees thanked them profusely, but not us because we will not compromise truth and that the COWD BOD was lavish as lavish can be! and allegedly violated AO no. 105 which orders all government agencies to implement austerity measures.
