FORT LAUDERDALE, Fla. Gay Republicans joined many of their straight counterparts in Florida Tuesday night in congratulating former Massachusetts Gov. Mitt Romney for his decisive victory in the Florida Republican primary. But R. Clarke Cooper, executive director of the national Log Cabin Republicans, while also congratulating Romney, cautioned him against engaging in anti-gay pandering or divisive social politics. Cooper told the Blade his comment was a reference to statements Romney has made in news media interviews over the past several months in which he appeared to be appealing to conservative voters hostile to gay rights. Ofcials with Log Cabins chapters in the Miami, Fort Lauderdale and Tampa areas said support for Romney was strong among LGBT Republicans in the state. Romney won by a lopsided margin in a Jan. 28 straw poll of Log Cabin members at an informal gay Republican caucus in Miami. Im pleased that Romney won, said Andy Eddy, board member of Log Cabin Republicans of Broward County, which includes the city of Fort Lauderdale and the nearby gay enclave Wilton Manors. Many of our members support him and believe he has the best chance of beating Obama, he said.

The 27-page decision cites testimony from a Rehoboth police ofcer that the employee, Nick Hutu, shoved Queen while Queen was dancing on the Summer House dance oor. The decision says the police ofcer also testied that Hutu reportedly said to people who were with Queen, Why dont you go to the gay bar Cloud 9, which is located near the Summer House. The Panel nds that based on the evidence presented at the hearing, Mr. Truitt and Mr. Queen proved by a preponderance of the evidence that Summer House discriminated against them based on their sexual orientation and that the reason offered by Summer House was a mere pretext, the decision says. The Panel nds for complainants Daniel Truitt and Mark Queen and against respondent Summer House based on respondents violations of the Delaware Equal Accommodations Law, it says. The decision orders Summer House to pay a civil penalty of $5,000, provide evidence within 30 days that it has provided training to all current employees about the states Equal Accommodations Law, and that all new employees receive such training. Summer House must also post a written non-discrimination policy in English and Spanish in a location where all employees see it where they sign in or clock in for their shifts, the decision says.

Furr later threatened the male friend with a gun when the two crossed paths outside the store, the afdavit says. The male friend and the other victims followed Furr in their car as Furr drove away from the store, saying they wanted to get his license number and report him to police, the afdavit says. Furr allegedly stopped his car and pulled out his gun when he noticed the other car was following him, says the afdavit. The car driven by the male friend of the trans women then crashed into Furrs car, prompting Furr to climb on the hood of that car and begin ring his gun at the people inside. The incident outraged LGBT activists, who said it came at a time when transgender women had been victims of assaults and violent hate crimes in a number of previous incidents.

KENNETH THOENES, 70
Kenneth Thoenes, a former Alexandria, Va., gay man, died Dec. 23 in New Prague, Minn., after a battle with supranuclear palsy and a few years of overall declining health, according to his friend and former partner, Robert Carmean of Mesa, Ariz. Thoenes was born Feb. 12, 1941 in Milwaukee. He was a 1959 graduate of South Milwaukee High School and served in the U.S. Army before graduating from the University of Wisconsin-Whitewater. He earned a masters degree in library science from Louisiana State University and worked at the D.C. Public Library and for years at the U.S. Naval Research Laboratory in Alexandria, Va. After retiring, Thoenes also lived in New Orleans and Pensacola, Fla. He brought much joy to others lives and there will be a large loss with his passing, Carmean said. Thoenes was preceded in death by his parents, the late Erwin Hugo and Marie Katheleen Thoenes and a brother, the late Erwin James. He is survived by a sister, JoAnn Lo, brother Gary, nieces Jennifer and Melisa and nephews James and Timothy.

Former D.C. writer wins Stonewall Book Award


Wayne Hoffman, a former D.C. resident and Washington Blade writer, won a 2012 Stonewall Book Award, which are given by the Gay, Lesbian, Bisexual and Transgender Round Table of the American Library Association. Hoffmans Sweet Like Sugar won the Barbara Gittings Literature Award. The book explores the complicated and unexpected relationship between 20-something Benji Steiner and an elderly rabbi mourning the loss of his wife. The book is available on Amazon. The Stonewall Book Awards are given annually to English-language LGBTthemed works of exceptional merit. The awards will be presented to the winning authors at the American Library Association Annual Conference in Anaheim in June. The awards and honor books reflects an amazing breadth and depth in writing and publishing materials for gay, lesbian, bisexual, and transgender readers, allies, families, and friends, said Stonewall Book Awards Committee Chair Lewis Day in a statement. The creativity, curiosity, and courage of these works is profound, and we feel privileged to be in the midst of these writers and their characters and creations. The Israel Fishman Non-Fiction Award went to Hide/Seek: Difference and Desire in American Portraiture, written by Jonathan Katz and David Ward, co-curators of the controversial 2010 Smithsonian exhibit of the same name. They shared that award with Michael Bronskis A Queer History of the United States.

Gay man seeks seat on Alexandria City Council


A local gay Democratic activist in Virginia is pursuing a seat on the Alexandria City Council. Sean Holihan, communications director for NARAL Pro-Choice Virginia and former president of the Young Democrats of Virginia, launched his bid last month during a meeting of the Alexandria Democratic Committee. Holihan, whos 30 and lives in Alexandria with his partner of three years, Danny Barefoot, said he wants to pursue a seat on the Council to be part of the change underway in Alexandria. Weve got a new city manager, weve got developments in every center of the city, Holihan said. Were going to have new members serving our Council because of two retirements, so I feel like its a good time to work and make an impact on the city. Among the projects that Holihan said he wants to pursue are protecting core services such as public safety education, and shepherding through a new Metro stop in Potomac Yard. As far as LGBT issues, Holihan said hed like to help raise money to elect LGBT people to political offices throughout

the country. Were a huge state; weve got 11 congressional seats, and weve only got six members of the LGBT community elected to ofce and most of them are on the local level, Holihan said. If elected, Holihan would be the second sitting openly gay person to sit on the Alexandria City Council. The other gay member is Paul Smedberg.

Arraignment set for ofcer in trans shooting


A D.C. Superior Court judge on Jan. 27 scheduled an arraignment in March for a D.C. police ofcer charged with ring his gun while off duty at three transgender women and two male friends while the ve sat in a car on a city street last August. Court observers say the decision to schedule an arraignment indicates negotiations between prosecutors and the attorney representing Ofcer Kenneth Furr over a plea bargain offer have been unsuccessful. Furr is now expected to be indicted by a grand jury within the next several weeks. Police charged Furr, a 21-year veteran of the police force, with assault with a dangerous weapon. Superior Court Judge Ann ORegan Keary ordered him held without bond pending trial at a Sept. 2 hearing after nding probable cause that Furr committed the offense. A police arrest afdavit says Furr allegedly stood on the hood of a car where the victims were sitting and red his service revolver through the front windshield, hitting two of the trans women and one of their male friends. All three suffered non-life threatening wounds, but authorities said the three could easily have been killed in the shooting. The afdavit says the incident began when Furr allegedly solicited one of the

Rehoboth restaurant guilty of anti-gay bias


A three-member panel of the Delaware Human Relations Commission on Dec. 2 issued a unanimous decision that the Summer House Saloon and Restaurant in Rehoboth Beach, Del., engaged in illegal discrimination against two gay men last March based on their sexual orientation. The ruling followed a Sept. 13 hearing in which the commission listened to testimony from witnesses who said an employee of Summer House refused service to Daniel Truitt and Mark Queen, the two men who led a discrimination complaint against Summer House.

Gay ex-congressman shuns politics in Florida


Bauman, outed in 1980 sex scandal, lives quietly and opposes same-sex marriage

FORT LAUDERDALE, Fla. Former U.S. Rep. Robert Bauman, a Republican who represented Marylands mostly rural Eastern Shore district from 1973 to 1981, was known at the time as a champion of conservative causes. Today, more than 30 years after a gay sex scandal led to his ouster from ofce, he lives in the upscale gay enclave of Wilton Manors, a small city located just outside Fort Lauderdale. In an interview with the Washington Blade on the eve of Floridas Republican presidential primary, Bauman said he remains committed to conservative and libertarian principles but has shunned politics since 1982. I think both parties are miserable, he said. I dont know what they stand for any more. Bauman added, I think they mirror each other. I think they are both completely enthralled to Wall Street and the banks. I think they are controlled by the people that contribute money to them. And that goes for Obama and it goes for Gingrich. The only thing you can say for Romney is that hes rich enough that maybe he wont be inuenced by that, said Bauman. I hate to say it, but I think hes probably the least inuenced by them because of his religion. Bauman, an attorney, said he voted earlier this month for GOP presidential contender Ron Paul, the congressman from Texas, as a protest vote. He said Pauls outspoken call for reforming the nations politics and economic policies represents a refreshing alternative to the other candidates, even though Bauman acknowledges some of Pauls proposals are unrealistic. When asked about former Pennsylvania Sen. Rick Santorum, the fourth remaining contender in the GOP presidential race, Bauman shrugged and said he considered him no better or no worse than Romney or Gingrich. Bauman noted that some people he knows who share his disappointment over the current state of U.S. politics no longer vote because they believe it lends credence to a lousy system. I dont feel that way. Ill keep ghting until I go, he said. In October 1980, then-U.S. Rep. Robert Bauman was widely believed to be the most conservative member of the House of Representatives. Admirers and critics alike recognized him as an articulate and formidable opponent of the Democrats who controlled both Congress and the White House at the time. But later that month, his status as a champion of conservative Republican causes and an admired husband and father of four children came crashing down. News surfaced that the FBI and D.C. police accused him of soliciting sex from a 16-year-old male prostitute who apparently used fake identication to land a job as a stripper in a D.C. gay bar called the Chesapeake House, the place where Bauman met him. Just four weeks before Bauman was expected to win re-election to a fourth term in Congress by a lopsided margin, he pleaded no contest in federal court to a misdemeanor charge of solicitation for prostitution. Under a plea bargain arrangement for rst-time offenders, authorities called for a sentence of just six months probation, with no jail time, after which the charge was dropped. As an interesting aside, Bauman said he was represented in court by Baltimore attorney Tom OMalley, the father of Marylands current governor, Martin OMalley. Following what Bauman has called a grueling four-week climax to his election campaign, in which longtime supporters turned against him, he lost his race for reelection to Democrat Roy Dyson. At the urging of loyal supporters, Bauman threw his hat in the ring for a comeback in the 1982 election. But he was immediately challenged in the Republican primary by a former state senator who seized on the sex scandal that led to Baumans defeat two years earlier. It was almost totally a personal campaign based on what happened to me, Bauman said. And with three of my kids still living with me and my wife and I separating, I just said to myself, thats enough, and I withdrew. And I almost won the primary six weeks after I withdrew. My name was still on the ballot. His opponent in the primary lost overwhelmingly to Dyson in the November election. So that was my last activity in politics, Bauman said. Over the next four years Bauman started a private law practice in Washington; worked briey as a lobbyist for the newly created Gay Rights National Lobby, the forerunner to the Human Rights Campaign; and wrote a book called The Gentleman from Maryland: The Conscience of a Gay Conservative. The book, published in 1986, has been praised by conservatives and liberals as an honest and painful account of Baumans struggle with his sexual orientation and alcoholism. Shortly after his book was published Bauman moved to Florida to take a job as an attorney with the U.S. Department of Veterans Affairs ofce outside St. Petersburg. He said he left that job about a year later after deciding he was no longer interested in working within the federal bureaucracy.

He next went to work as a freelance writer and attorney for a libertarianoriented publishing company called Agora Publications. In 1998 Bauman helped to found a subsidiary to the company called the Sovereign Society, which publishes email newsletters and books specializing in legal tax avoidance through the use of offshore investing. I write for them on a regular basis for their daily e-newsletter that goes out to more than 335,000 people, he said. And I write books. Ive written ve or six or more books on offshore nancing and on places to invest off shore asset protect all of the things that Newt Gingrich has been railing against for the last few days, he said. Bauman takes strong exception to gay activists who accused him of pushing for anti-gay policies during his years in Congress. He said that with the exception of one vote for a 1970s era amendment introduced by Rep. Larry McDonald (DGa.), which prohibited the U.S. Legal

Services Administration from taking on gay rights cases he never took a public position for or against gay rights. I was a closeted homosexual. Taking on gay rights issues was the last thing in the world I wanted to do, he said. Now, Bauman said he fully supports civil rights and full equality for gays and transgender people. But he said he isnt ready to support legalization of same-sex marriage, a position he acknowledges will upset gay activists. I have never supported gay marriage, he said. To me, marriage is between a man and a woman. I dont think you can replace centuries of religious tradition when it comes to marriage. It does not include two people of the same sex. He said he does support legal recognition of civil unions and domestic partnerships, saying same-sex couples joined in that form of legal relationship should be given all of the rights and benets of marriage.

Wash. Senate votes on same-sex marriage bill


OLYMPIA The Washington State Senate was expected to vote on a bill extending marriage rights to same-sex couples late Wednesday, in what will be the biggest hurdle toward passage for the bill. The bill, which is supported by the governor, and is expected to pass easily in the lower house, faces its most difcult prospects in the Washington Senate where supporters say they have the slimmest of majorities. With 49 senators, the bill will need 25 votes to pass. The Blade reported earlier this month that 25 senators have pledged to vote in favor of the bill in the Senate, and supporters are hopeful, but the vote is anything but guaranteed. Marriage in Washington State has tremendous momentum behind it and were optimistic going into todays vote, Human Rights Campaign communications director Michael Cole-Schwartz told the Blade Wednesday. A second shot at marriage in Maine


State LGBT group hopes to bring issue before voters

The head of the statewide LGBT rights group in Maine is excited about the prospects for a November ballot measure that would legalize same-sex marriage. Betsy Smith, executive director of Equality Maine, told the Washington Blade that a win in Maine on the initiative the rst voter-initiated pro-LGBT measure to appear on a state ballot anywhere in the country would be hugely signicant. Our opponents are always saying that we can win marriage in the courts and we can win marriage in the legislature but when it comes to the people, we can never win marriage, Smith said. Thats the biggest thing. If we win at the ballot, it will be through the support of Mainers, of Americans, and thats a really, really important statement that Americans are now believing that the freedom to marry is what should be the law of the country. Last month, Equality Maine as well as allied groups Freedom to Marry and Gay & Lesbian Advocates & Defenders submitted more than 105,000 signatures to Secretary of State Charles Summers, Jr., for certication of a ballot measure legalizing same-sex marriage. The number of names required for certication is 57,000, and Smith said she has signicantly more than enough valid names to qualify for the ballot. Theres not a problem with the signatures, Smith said. We have, we think, around 85,000 to 90,000 valid signatures. So, in terms of validating, thats not an issue. The secretary of state has 30 days to review the signatures and validate them, so the ofce will certify the measure by Feb. 26. Once the measure is certied, it wont go directly to the ballot but to the Maine Legislature. The legislature has three options. One would be passing the initiative on its own, an unlikely scenario that would result in the measure becoming law and the legalization of marriage rights for gay couples. Another, which Smith said shes betting on, is the legislature indenitely postponing action on the measure, sending it to voters after the lawmakers recess for the year in April. But another option for the legislature that has drawn concern is the placing of an alternate question before voters alongside the proposition to legalize same-sex marriage. For example, the legislature could approve language asking voters to approve civil unions as an alternative to marriage, or same-sex marriage with extreme religious exemptions. But Smith said she thinks the legislature wont pursue this path, which could derail the effort to legalize same-sex marriage in Maine, because neither opponents nor supporters of same-sex marriage will want to go down that road. Youd have to have majority support for whatever you want to pass, so if its for civil unions, they would need to have a majority support civil unions, Smith said. Start thinking about where those votes come from. Well, the pro-marriage folks are not going to vote for it because we dont want them to, and the anti-equality folks dont support even civil unions for us, so when you start to add up how they get majority support, even though its a Republican legislature, its just really highly unlikely. But once the voter-initiated ballot measure is certied, the legislature can do nothing to kill it, so same-sex marriage would be on the ballot in Maine one way or the other. November 2012 wont be the rst time that Maine voters have had to decide on the question of same-sex marriage. In 2009, Maine voters rejected a same-sex marriage law, signed by former Gov. John Baldacci (D), in a referendum by a vote of 53 percent. Larry Sabato, a political scientist at the University of Virginia, said movement in favor of same-sex marriage within the American public at large and having President Obama at the top of the ticket bodes well for LGBT advocates the second time around at the ballot. While Maine is unusual politically, and can go back and forth between the parties and has an independent streak, it is very likely to back Obama again this fall, Sabato said. That probably helps passage. On the whole, Id say it will be a tough ght, but prospects for approval are no worse than 50-50, and potentially could be better if the pro-marriage campaign is well run.

Anti-gay lawmaker asked to leave restaurant


KNOXVILLE Tennessee Sen. Stacey Campeld the sponsor of several antigay bills, including the infamous Dont Say Gay bill has responded with a furious post to his personal blog after being asked to leave a Knoxville restaurant because of his record. The Nashville Scene website reported that the lawmaker was denied service at the Bistro at the Bijou located on Gay Street by restaurant owner Martha Boggs. I didnt want his hate in my restaurant, Boggs told Metro Pulse, a Scripps publication. I told him he wasnt welcome here. ... I feel like hes gone from being stupid to being dangerous, and I wanted to stand up to him. Last week Campeld appeared on the Michelangelo Signorile radio show, and shocked listeners by claiming that HIV is virtually impossible to transmit through heterosexual sex. My understanding is that it is virtually not completely, but virtually impossible to contract AIDS through heterosexual sex... very rarely [transmitted], Campeld said on Sirius satellite radio. Whats the average lifespan of a homosexual? Its very short. Google it yourself.

Newark mayor slams Gov. Christie


NEWARK Responding to a call by N.J. Gov. Chris Christie to put same-sex marriage up for a vote in the Garden State, the mayor of the states largest city told reporters we should not be putting civil rights issues to a popular vote subject to the sentiments of the day. No minority should have their rights subject to the passions and sentiments of the majority, Newark Mayor Corey Booker told reporters at a press conference last week. This is a fundamental bedrock of what our nation stands for. And I get very concerned that we have created in our state, we refuse to address, call it like it is... that weve created a second-class citizenship in our state.

LGBT group to Colbert: reenter GOP race


WASHINGTON Catholics for Equality, an organization of pro-gay Catholics, is calling on comedian Stephen Colbert to reenter the GOP primary. Colbert briey irted with the idea of entering the GOP primaries and held a rally in South Carolina in mid-January prior to that states primary vote, but was unable to qualify for the ballot. Catholics for Equality is calling on fellow Catholic Stephen Colbert to restart his primary campaign, saying his views reect the views of most mainstream Catholics. Colbert is the only Republican Catholic contender who reects comprehensive Catholic social justice teaching, the group said in a press release.

Rea Carey, the Task Forces executive director, said during her 2012 State of the Movement address that the very ability to cast a vote is under attack and called on LGBT rights supporters to ght those efforts and bring voters to the polls. They could derail our progress for years by focusing on something that our movement could easily mistake as not our issue, Carey said. Believe me, it is our issue when we or our allies nd ourselves without easy access to the polls. Carey said executive orders in 14 states and 20 new laws have made it harder for ve million people to vote this year. According to Carey, these initiatives are a systematic effort to take the vote away from people of color, students, the working poor and unemployed and other groups. Her views are supported by a report published in December by the Voting Rights Institute, which says new Republican-initiated laws have cut early voting, challenged the citizenship of eligible voters and mandated that voters produce photo ID at the polls. One such law is Floridas HB 1355, an omnibus elections overhaul passed after the Tea Party came into power in the state in 2010. In addition to early voting cuts, the law imposes restrictions on non-governmental entities conducting voter registration. Carey said these efforts which she called one of the last desperate ploys by those who can no longer compete with the power of their ideas particularly affect LGBT people because they have a devastating effect on the ability of transgender people to vote and impact

states where marriage equality could be on the ballot in 2012. If we do not protect the right to vote, we will not win on immigration, we will not win on non-discrimination, we will not protect afrmative action and we will not win on marriage, Carey said. The Task Force chief called on the audience to register voters that anti-gay forces dont want at the polls and urged voters who are turned away to cast a provisional ballot, post their story on Facebook and Twitter and contact the Civil Rights Division at the Department of Justice. Carey made the remarks during the 24th annual Creating Change conference at the Hilton Baltimore, where an estimated 3,000 attendees came to discuss LGBT rights. Conference participants ranged from government ofcials in suits, female activists wearing combat boots and bloggers in graphic tees. The hotel bathrooms were modied as gender neutral to accommodate attendees. During her speech, Carey offered a litany of accomplishments that the LGBT community has achieved in the past year, including the passage of statewide transgender non-discrimination laws in four states, defeating an anti-trans bill in Maine and the lifting of Dont Ask, Dont Tell. Carey also said the Task Force and LGBT

advocates had a hand in issues facing a broader range of people, such as beating an anti-choice personhood ballot measure in Mississippi and a measure in Maine that would end same-day voter registration. Carey noted the heavy emphasis that marriage receives in the LGBT rights movement. The LGBT movement is not a movement for marriage only, Carey said. It is a movement for the full dignity of our lives, for a transformed society. Marriage has motivated our allies and captured the attention of people who werent paying attention before, Carey said. But someday, when we succeed in nationwide recognition of our marriages, and even along the way, we will likely see that the engagement in our movement will drop off. Severely. Carey said in states where marriage equality has been achieved, advocacy groups nd they have less attention, engagement and fewer donations. She said these groups in some cases have had to lay off workers even while struggling to get attention for other very pressing issues. We have learned that with a win, we usually have to turn right around and defend that win, Carey said. We also know that people who arent

included in that win remain vulnerable to discrimination. New York is an example of a state that could be in such a situation. The state legalized samesex marriage last year, but workplace nondiscrimination protections for transgender people havent yet been enacted. At the Task Force, we say we want more than marriage there is no singular solution to the many ways we experience discrimination, violence and bigotry, Carey said. At the Task Force we insist that immigration, housing, health care, fair wages, Social Security and ending systemic racism and sexism are all LGBT issues. Careys speech was well-received by those in audience, and her remarks that marriage shouldnt be the singular focus of the LGBT rights movement were met with signicant applause. Katherine Acey, a former executive director for the New York City-based Astraea Lesbian Foundation for Justice, said Careys speech was expansive and visionary and useful because it laid out everything weve accomplished. Her looking at the big picture and looking at how we must stand with all of the members of our community also allies who are part of our world community I thought that was striking, the way she delivered that, Acey said.

OMalley urges lawmakers to pass marriage bill


BALTIMORE Maryland Gov. Martin OMalley called on state lawmakers to pass a bill legalizing same-sex marriage and another measure barring discrimination based on gender identity during a speech last weekend at the Creating Change conference sponsored by the National Gay & Lesbian Task Force.

Maryland can be the seventh state to pass a civil marriage equality law, OMalley said. We need to get it done this year. In a short speech that included references to Baltimores role in the creation of the United States, OMalley repeatedly cited the need to protect religious liberties and called for a civilized debate on the contentious issue of marriage. Laws matter but words also matter, he said, we must choose words of compassion.

He also spoke about the bill to ban antitransgender discrimination. Discrimination [based] on gender identity is wrong, OMalley said to loud applause. Passing a law to protect transgender people is the right thing to do. Fellow Democrat Thomas Mike Miller, the Maryland Senate president, does not support the bill. According to Gender Rights Maryland, Miller said he only has time for one gay bill this session. We do not have Senate President Millers support, Gender Rights Maryland

said in a statement. That has been the case for ve years, and remains the overwhelming roadblock. OMalleys remarks came during the closing brunch of the 24th annual Creating Change conference. His wife, rst lady Katie OMalley, spoke Thursday and caused a minor stir when she referred to opponents of the bill in last years session as cowards. She later issued a statement that she regretted those comments. Gov. OMalley did not mention the incident in his remarks Sunday.

HUD: Religious groups must abide by non-bias rule

A Department of Housing & Urban Development ofcial said Monday that religious institutions receiving federal funds for housing programs will have to abide by a new HUD rule prohibiting discrimination against LGBT people. John Trasvia, assistant secretary for Fair Housing and Equal Opportunity, conrmed the rule would impact religious institutions during a conference call in response to a question from the Washington Blade, saying, All HUD housing providers are covered under this rule. Asked to clarify whether these providers include religious institutions, Trasvia replied, Yes. Ian Thompson, the ACLUs legislative representative, rst wrote in a blog posting on the ACLUs site last week that the rule will cover religious institutions that receive money for federal programs. [T]he rule will require all organizations that operate HUD-assisted or HUDinsured housing facilities to serve LGBT Americans looking for shelter and housing including religious organizations, Thompson said. [O]nce a religious organization chooses to provide housing all organizations must provide equal access to HUD housing programs and did not sanction the use of religion to discriminate, Thompson concluded. The rule, rst proposed in January, covers programs serving an estimated 5.5 million Americans, including those living in low-income subsidized housing. The measure, which has four general components, requires owners and operators of HUD-assisted housing to make housing available to applicants and occupants regardless of their LGBT status. The rule claries families otherwise eligible for HUD programs cant be excluded because of one or more members of the familys sexual orientation, gender identity or marital status. Additionally, the rule prohibits owners and operators of HUD-assisted housing or housing whose nancing is insured by HUD from inquiring about the sexual orientation or gender identity of an applicant or occupant of a dwelling, whether renter or owner-occupied. Trasvia said HUD claried this provision doesnt prohibit voluntary and anonymous reporting of LGBT status in state, local or federal data collection requirements. Additionally, the measure has a bearing on mortgage insurance programs. It prohibits lenders from using LGBT status as a basis to determine a borrowers eligibility for Federal Housing Administrationinsured mortgage nancing. These days, when one-third of new homebuyers are served by FHA lenders, this last element to make sure that ones sexual orientation or gender identity is not a basis for denying an FHA loan is critically important to Americas families, Trasvia said. Trasvia added that rule is governed as a HUD program rule, so, unlike the Fair Housing Act provision, HUD ofces throughout the country will enforce it and not just the Ofce of Fair Housing & Equal Opportunity. HUD Secretary Shaun Donovan announced on Saturday during a speech at the 24th annual Creating Change conference that HUD would this week make nal the rule by publishing it in the Federal Register. On Monday, the department published the text of the nal regulation. Trasvia conrmed that the Federal Register would publish the rule this week, but in response to another Blade question said he couldnt give a more denitive time for when the rule will be published. Thats a little bit out of our control, Trasvia said. Typically, the rules get printed within a week once theyre submitted, so the rule has been submitted, were just waiting for its publication. Trasvia noted that publication of the rule will start the 30-day period before the measure will go into effect and expects the measure to go into effect starting in March. In a statement provided by HUD, gay Rep. Barney Frank (D-Mass.) commended the department for implementing the change, saying I am grateful to the Obama administration for instituting this important policy.

OMalley, who once advocated for civil unions over marriage, made the bill part of his 2012 legislative agenda. As you know we already recognize civil marriages that come from other states, OMalley said during his brief testimony, the civil marriage equality bill draws upon the lessons that we have learned from these other states. This bill balances an individuals civil marriage rights with the important protections of religious freedoms for all, OMalley continued. And because it protects both of these inalienable rights, it is supported by a broad coalition of Marylanders, which includes clergy, community leaders, faith-based organizations, civil rights groups and those who hold the most important title of all in our democracy, and that title is citizen. OMalley addressed the 24th annual Creating Change conference in Baltimore on Sunday and urged lawmakers to pass the bill. (See page 10)

He was followed Tuesday by gay Sen. Richard Madaleno who spoke about his long relationship with his partner and status as a parent as well as Democratic Sens. Jamie Raskin and Robert Garagiola and Republican Sen. Allan Kittleman, as well as Attorney General Douglas Gansler, all of whom urged passage of the bill. Also testifying in favor of the bill was Baltimore Mayor Stephanie RawlingsBlake. I believe that all couples regardless of their sexual orientation, want their children protected under the law, Rawlings-Blake testied. Please dont be mistaken, this bill is about more than those rights, its also about civil rights and about equality under the law. Both sides were given two hours each to present their witnesses in four parts the rst and third hours in support of the bill, and the second and fourth in opposition. All told, more than 75 citizens delivered testimony both for and against the bill over a period of four and a half hours. Opposition to the bill included colorful testimony from local same-sex marriage hearing mainstay minister Leroy Swailes. Supporters of the bill included the mother

of a lesbian daughter, Penny Nichols. The supporters also included dozens of same-sex couples raising children, parents of gay children and straight children raised by same-sex couples, all in an attempt to counter arguments by the opposition that same-sex marriage would be detrimental to the development of children in Maryland. Also testifying in support of the law in the rst hour were gay veteran and law enforcement ofcer Irene Huskins of Fort Washington; president of the Maryland AFL-CIO and father of a gay child, Fred Mason; gay federal worker and longtime Maryland resident Candy Holmes; supportive Unitarian-Universalist minister Rev. John Crestwell; and David Rocah, staff attorney at the ACLU of Maryland. One of the questions that Rocah elded from committee member Sen. Joseph M. Getty after his testimony dealt with whether the law discriminates against close family members that wish to marry because of genetics, and the familial relationship is because of genetic relationships. Its long-standing policy in Maryland to prohibit marriage between people

of a particular familial relation, Rocah answered. They dont all relate with genetics. Maryland has prohibited relationships between stepfathers or stepmothers, theyre not genetically related. Different states have different degrees of familial relationships in which marriage is prohibited. I dont see the issue of discrimination that youre referring to. Both the hearing room itself and an overow room were lled to capacity through much of the day, producing an electric and anxious atmosphere among those in attendance. Same-sex marriage supporters sat next to opponents, making it difcult in many cases to distinguish who was there in favor of and who was there against. In the second hour, the opposition rst presented Maryland Family Alliance President Pastor Dereck McCoy, who set a cordial, respectful tone. Regardless of the tenuous debate that were in, McCoy said, I think we need to understand that Marylanders are separated on this issue, but its a deep and passionate thing in the root and the heart of the communities and many peoples lives.

Floridas gay Republicans celebrate Romney win

With 100 percent of the election precincts counted, Romney captured 46 percent of the vote. His closest rival, former House Speaker Newt Gingrich received 32 percent, former Pennsylvania Sen. Rick Santorum received 13 percent, and Texas Congressman Ron Paul received 7 percent. In Floridas winner take all primary, Romney captured 50 delegates, giving him a boost going into a series of upcoming primaries and caucuses leading up to Super Tuesday on March 6, when 10 states hold primaries. This big win for Gov. Romney makes it all but certain that he will emerge as the nominee of the Republican Party, said Jimmy LaSalvia, executive director of the gay conservative group GOProud. Gov. Romneys win tonight is particularly pivotal given the size of the state and the importance Florida will have in electing the next president, he said. Gov. Romneys message of economic hope and renewal has clearly resonated with the voters of Florida. The truth that neither Barack Obama nor his friends in the liberal media want to discuss is that most Americans, gay or straight, are no better off than they were in 2008 and that is a product of Obamas failed big government policies, said LaSalvia, who personally endorsed Romney earlier this month. Cooper said Log Cabin has a longstanding rule of not endorsing presidential candidates until the time of the Republican National Convention. He said on Tuesday night that the timing of the clubs endorsement vote is strictly administrative in nature and has no bearing on the groups views of Romney. During the Log Cabin caucus in Miami on Jan. 28, which followed a national Log Cabin board meeting, Cooper and ofcials with Log Cabin chapters in Florida said the groups members clearly were leaning toward backing Romney. Hastings Wyman, editor of Southern Political Report, a newsletter specializing in reporting on politics in the South, characterized as remarkable Romneys dramatic rise in popularity in Florida. He noted that Romney had been trailing Gingrich in the Sunshine State by double digits in the days following Gingrichs win in the South Carolina primary. I think the biggest single factor was money, said Wyman, in referring to Romneys lopsided lead over Gingrich and the other three GOP contenders in money raised for his campaign. He said Romneys large campaign war chest enabled him to purchase a barrage of negative TV ads that clearly hurt Gingrich. GOP frontrunners tortured history on LGBT rights

Republican frontrunner Mitt Romney has been criticized as a ip-opper during his presidential campaign and although hes defended himself against accusations that his positions have pivoted on LGBT rights, his record shows that hes also changed on those issues. During a Dec. 15 debate in Sioux City, Iowa, when Fox News moderator Chris Wallace said Romney has changed his positions in the last 10 years on abortion, gay rights and gun control, the candidate took exception to the list and said his positions have been consistent on gay rights. Im rmly in support of people not being discriminated against based upon their sexual orientation, Romney said. At the same time, I oppose same-sex marriage. Thats been my position from the beginning. But an examination of Romneys previous statements reveals any assertion that hes held the same positions on LGBT rights including opposition to samesex marriage since the beginning of his political career is false.

On Dont Ask, Dont Tell


In a 1994 letter to Log Cabin Republican, Romney called DADT a transitional policy that would lead to open service: One issue I want to clarify concerns President Clintons Dont Ask, Dont Tell, Dont Pursue military policy. I believe that Clintons compromise was a step in the right direction. I am also convinced that it is the rst of a number of steps that will ultimately lead to gays and lesbians being able to serve openly and honestly in our nations military. In a 2007 GOP debate at Saint Anselm College, Romney said Dont Ask was working: When I rst heard of the Dont Ask, Dont Tell policy, I thought it sounded awfully silly. I didnt think that would be very effective. And I turned out to be wrong. Its been the policy now in the military for what, 10, 15 years, and it seems to be working. This is not the time to put in place a major change, a social experiment, in the middle of a war going on. I wouldnt change it at this point. In a June 2011 debate in New Hampshire: I believe it should have been kept in place until conict was over. In 2011, he told the Des Moines Register: Thats already occurred and Im not planning on reversing that at this stage. ... I was not comfortable making the change during a period of conict, by virtue of the complicating features of a new program in the middle of two wars going on, but those wars are winding down and moving in that direction at this stage no longer presents that problem.

In a December 2011 interview with the Boston Herald: Romney expressed support for a constitutional amendment that could create a complex three-tier system of marriage maintaining marriage rights for straight couples, allowing gays who have already married to remain married, but barring future same-sex marriages. I think it would keep intact those marriages which had occurred under the law but maintain future plans based on marriage being between a man and a woman, Romney said. In 2011 to the Des Moines Register I would like to see a national amendment dening marriage as a relationship between a man and a woman. But that was tried maybe three or four years ago. I dont think thats likely to receive the necessary support, at least in the near term. During a January 2012 debate Romney said hell advocate for full rights for gay people, although he said he remains opposed to same-sex marriage. If people are looking for someone who will discriminate against gays or will in any way try and suggest that people that have different sexual orientation dont have full rights in this country, they wont nd that in me, Romney said.

Gay Republicans embracing Romneys candidacy

tactic for the Republican presidential nominee to defeat Obama in November. Our local chapter leaders report that, like Florida voters overall, Log Cabin members in the Sunshine State were drawn to Romneys business sense and clear plan to return America to prosperity through a strong private sector, Cooper said. Still, there remain serious reservations about recent statements by Romney to so-called pro-family groups, Cooper said. The real question now is whether Romney can win a majority of Americans, including younger voters, independents and disaffected Democrats, he said. Log Cabin Republicans are looking for a candidate who can rebuild the big tent, unite our party and claim a mandate to restore liberty and scal responsibility to the United States. Whether that candidate is Romney remains to be seen. Jerame Davis, executive director of National Stonewall Democrats, an LGBT group that is backing Obama, said Romneys win in the Florida primary was due to his ability to outspend and throw more mud than all of his opponents combined. He called Romney a very unpopular frontrunner whose support is not as strong as the not-Romney wing of the Republican Party. Although the conservative GOProud and more moderate Log Cabin leaders often disagree over how the LGBT community should interact with the Republican Party, the two groups appeared to be in agreement this week over how to secure LGBT votes for Romney if he wins the nomination for president. Both LaSalvia and Log Cabin members in Florida said they would stress that LGBT people, like all other voters, care about issues beyond gay rights. While Romney may not be as supportive or outspoken on LGBT issues as Obama, they said they will stress that Romneys economic policies would help gays where it counts the most, in their wallets and pocketbooks, as Log Cabins Tampa chapter president Jim Pease said. So why do I think gays will do well under Romney? asked gay Republican activist Jim Driscoll, a former Bush administration appointee to the Presidential Advisory Council on HIV/AIDS. Romneys opposition to discrimination against gays in jobs, etc., is genuine. He is not uncomfortable with gay people. Gay Democrats argue that unlike Obama, Romney hasnt taken a position on whether he would support and sign the Employment NonDiscrimination, or ENDA, which would ban job discrimination based on sexual orientation and gender identity. Gay Democrats respond by saying Obama has supported virtually all other items on the LGBT rights agenda, including repeal of the Defense of Marriage Act, which bans the federal government from recognizing same-sex marriages performed in states that have legalized them. In what will likely emerge as the gay Republicans key talking point in the fall general election, LaSalvia said gays are not one-issue voters. Something I say a lot, is especially true when contrasting Obamas policies with any of the Republican candidates, is that I believe that free market solutions benet all Americans, but especially gay Americans, he said. Whether its Social Security reform that includes private inheritable accounts, free market health care reform that would allow same-sex partners to go on the open market and purchase family plans, or tax reform to make the tax code simpler and

fairer, Romney and the other Republican candidates are offering solutions to problems facing all of us that are far better for our country than Obamas failed policies, LaSalvia said. Davis from National Stonewall Democrats said most LGBT voters will dismiss such arguments as ridiculous. He said NSD and the Democratic Party has and will continue to show that Obama comes out far ahead on LGBT and nonLGBT issues. Davis said both Log Cabin and GOProud were downplaying what he called Romneys most anti-gay stand his agreement to sign a pledge issued by the anti-gay National Organization for Marriage to support a U.S. constitutional amendment to ban same-sex marriage. Its the height of hypocrisy that gay Republicans would attempt to excuse Romneys support for the NOM pledge, Davis said. They should be ashamed for excusing any of these GOP swindlers for pandering to these regressive demagogues who seek to not only take

away our rights, but persecute us back into the closet, he said. A random, unscientic sample of interviews with 14 gay men at Fort Lauderdales gay beach on Tuesday appeared to conrm the longstanding leanings of that citys LGBT community. All 14 said they strongly support the reelection of Barack Obama and would be unlikely to vote for any Republican. As a gay man, I wont vote for any Republican, said Al Adamczyk, a longtime Fort Lauderdale resident. Im gay and Im proud of it. Gay Republicans are idiots. Daniel Jeffers, a gay Air Force veteran who just moved to Fort Lauderdale with his partner, Jerry Finster, said the two believe Obama has been good on both gay and non-gay issues and would never consider voting for a Republican candidate for president. Some gays want him to do more, said Finster of Obama. He is doing everything possible. I think independents will vote for him. The Republicans are a joke. Out of a scale of ve stars, I have six stars for Obama.

The 24th National Conference on LGBT Equality: Creating Change, produced by the National Gay & Lesbian Task Force, completed its ve-day stay at the Baltimore Hilton on Jan. 29. Close to 3,000 attendees from all over the country attended the confab that included four plenary sessions, 12 day-long institutes and more than 260 workshops and seminars covering a wide swath of topics. These included immigration, politics, bisexuality, organizing, faith, family, HIV/AIDS, gender, aging and youth. Five busloads of conference attendees headed to Washington to lobby members of Congress on day two. The conference ofcially opened later that evening with a welcoming address from Baltimore Mayor Stephanie RawlingsBlake, who boasted that Baltimore is one of the leading cities in the U.S. when it comes to LGBT rights. Katie OMalley, the wife of Gov. Martin OMalley and a sitting judge, caused a ap over her comment that those who opposed the bill last year were cowards. The next day she apologized for her choice of words. Benjamin Jealous, president and CEO of the NAACP, was the keynote speaker. He addressed hundreds in the audience and spoke of the need for justice and equality for black as well as LGBT individuals. The weekend was emceed by comic and activist Kate Clinton. Task Force Executive Director Rea Carey presented the state of the movement address. HUD Secretary Shaun Donovan discussed federal efforts to advance the rights and well-being of LGBT people and their families at HUD and beyond. Gov. OMalley spoke of his desire to secure marriage equality and gender identity protections. And actor/singer Wilson Cruz closed out the conference with Love, Child..., a musical performance. I think the 2012 Creating Change conference has been a spectacular success, Sue Hyde, Creating Change director, told the Blade. We have brought 3,000 people together here in Baltimore. Each and every one of them is going home with better skills, more condence and more inner strength to do the work that they do every day. Edwin OBrien, the Archbishop of Baltimore who will soon be Cardinal, denounced the effort to secure marriage equality in Maryland. His speech from Jan. 25, shown on the Catholic Review website (catholicreview.org/) ridicules the notion that opposing the bill amounts to discrimination. OBrien injected race into his comments. Racial discrimination is discrimination because of the pigment of the skin and it cant be tolerated, he said. But marriage goes far deeper than the pigment of the skin. It goes to the very roots of our culture. And we are in it for keeps. He predicted that the coalition that opposes the measure will succeed in derailing the marriage bill.

We should support mayors citywide summit


Feb. 11 event fosters participation in government
cision to conduct another citywide summit, which will be held at the Convention Center on Feb. 11. Its success will depend on how carefully the day is planned, how much input people will be allowed and how that input is channeled. But I recall the warm feelings people at the Williams summits had after having the opportunity to talk to residents from across the District and the chance to discuss issues and problems with those coming from differing backgrounds and perspectives. There were about 1,500 people and many were surprised that it didnt matter where they lived in the District they actually saw some things in the same way even if their proposed solutions differed. Just sharing and debating thoughts and ideas with each other was a valuable experience for the participants and the administrations commissioners and agency directors who roamed the room chatting and soliciting feedback and opinions on the work of their agencies. There was an unmistakable feeling of camaraderie. Much of the media are now focused not on what can be gained from a summit but rather on how much it will cost. In todays world bringing people together isnt cheap. Costs include the facility, audio/visual equipment; the technology required to collect opinions and share them with a room full of people. Then there are meal costs if you want people to come early and spend the day. The estimated cost of the event is about $650,000 or slightly more than $1 per every person living in the District. That is not too much of an investment in citizen participation considering the Districts annual budget is $10 billion. I urge the mayor to continue to seek private sponsors for part of the event. Maybe Marriott would consider funding box lunches or an AV company would make an in-kind donation. He shouldnt worry about the attacks that will come from the same media complaining about the cost to the city when he later announces who helped fund the event. Those donors should be proud to help and their names should be prominently displayed at the event. But for the money that cant be raised privately why not ask each agency to nd funds in its budget based on the percentage of the Districts budget they are funded with. If the Department of Health receives $1 billion or 10 percent of the Districts budget they would be responsible for funding up to $65,000 of the summit. I am sure that within a billion dollar budget that would be doable and the feedback they get may be a lot more valuable. Let us not forget that the reason we need to do these kinds of events is that encouraging community input and involvement in the workings of our government is important for our Democracy. I urge every community to be sure they are represented at this event. There should be representatives from every ethnic and cultural group, socio-economic group, men, women, lesbian, gay, bi, transgender, and straight and from every corner of the city. There needs to be a concerted effort to encourage people to do more than complain about lack of services or waste in government but to rather get involved and be a part of nding the solution to the problems they see. There are great ideas out there that government needs to hear. This summit is an investment in nding them and a very worthwhile one at that.

Gone are the days when participatory government meant people gathered in the village square and debated the future of their towns and villages. That form of participation has gotten lost in our busy and technology centered world. If we want to bring people together face-to-face today in any major way to discuss the future of cities, it takes planning, organization and money to recreate that village square. During the Anthony Williams administration, the mayors ofce sponsored more than one citywide summit. There was great participation and feedback from residents across the city who discussed and debated what they saw as the problems and their possible solutions. Some of our media look back favorably on the Williams administration events but are now questioning Mayor Vincent Gray for trying to revive individual and community participation in government. Participation declined during the Adrian Fenty administration, where despite all the good things he did, asking people for their opinions and ideas wasnt one of them. Calling on DynCorp to meet diversity standards


Non-discrimination policies are good for the bottom line

When a major corporation is indifferent to the abuse of one of its employees based on real or perceived sexual orientation or gender identity, the company stakeholders should be outraged. When the corporation in question, DynCorp, is the recipient of more than $2 billion of taxpayers money in the form of federal contracts, such indifference is absolutely unacceptable. Large corporations like DynCorp that continue to resist the best practices of corporate management should not be eligible for federal contracts. Last week, DynCorp landed another contract from the federal government. Yet last month, DynCorp settled the lawsuit of a straight employee being taunted by anti-gay slurs; however, the incident has only shed light on a corporation demonstrating a keen lack of insight into 21st century corporate policies. When best practices are not in place to protect all employees from discrimination on the job, the entire corporation suffers, leading to a decline in prots and the elimination of jobs. According to a Williams Institute study of the top 50 federal contractors, DynCorp is ranked No. 32 and is one of the few contractors that does not have any public statements on general diversity, domestic partnership benets, or policies tied to creating an LGBT inclusive workforce. In comparison, the top four agencies, including Lockheed Martin, Boeing, Northrup Grumman and Raytheon, all have diversity policies covering sexual orientation, gender identity and domestic partner benets. DynCorp should see the writing on the wall. Corporate success is not about enabling easy discrimination, but instead harnessing the collective diversity of the people who make the corporation successful. Not only do these types of policies ensure a more productive workforce, but also better recruitment and retention of top talent. When we founded the National Gay & Lesbian Chamber of Commerce (NGLCC) almost 10 years ago, we knew corporate America was already leading the world in recognizing the strengths of an LGBT inclusive workforce. Three of our founding partners, IBM and Wells Fargo have protections for LGBT employees going back more than 25 years and countless more companies have added them since. The NGLCC works with federal agencies to ensure federal contracting avenues are open and accessible to LGBT business owners. Last year, we nalized a memorandum of understanding with the Department of Commerce. In addition to working on agency priorities like the presidents National Export Initiative, the MOU adds LGBT-owned businesses to the diverse pool of potential suppliers at the department, and we will continue to sign similar memorandums with other federal agencies throughout 2012. We intend to expand our work to the largest contracting agency, the Department of Defense. But in the meantime, the NGLCC and our members know that corporate change is always related to the return on investment. Developing and implementing policies that ensure every employee is helping improve the corporate bottom line should maximize corporate prots. Any investor has a right to demand change. DynCorps misguided management practices should be raised to the investor relations department and at the annual shareholder meeting. We encourage every shareholder of DynCorp, whether individual investor, mutual fund, LGBT, or ally to hold management accountable for erroneous policies that hinder the ultimate goal of maximizing shareholder return. We hope that President Obama will take note of federal contractors whose policies are non-inclusive and urge them to adopt policies that provide a 21st century environment for all workers. DynCorp and other federal contractors that nd themselves behind the times should make changes to their policies to protect all employees from workplace discrimination, add LGBT businesses to their diverse supply chains and ensure shareholders are properly represented. As evidenced by policies and practices adopted by the NGLCCs 140 corporate partners, it isnt a matter of IF these policies will impact DynCorp; its a matter of when. Non-discrimination polices are good for the workforce and they are good for the bottom line.

D.C. Council myopia on Ward 5 warehouses


Medical marijuana cultivation center decision likely to delay, limit program
talization relevant to the LGBT community in recent years not been effectively or successfully addressed if at all by local advocates and organizations? Perhaps most important, what causes the citys elected ofcials to buckle so quickly to such anti-business protestations, abandoning common sense along the way? The D.C. Council previously limited both the number and permissible locations in the area for gay strip clubs displaced by the Nationals stadium hoping to re-open, at the insistence of disgraced former Ward 5 Council member Harry Thomas Jr. The result? No venue relocated to Ward 5 due to insurmountable prohibitions, with only Ziegfelds/Secrets surviving at a grandfathered new location near the previous cluster of businesses and the stadium site. The latest dust-up is over D.C.s medical marijuana program that hit another snag two weeks ago when the D.C. Council approved emergency legislation to limit the number of cultivation centers allowed in Ward 5. Introduced by At-Large Council member Vincent Orange, who previously represented Ward 5 prior to an unsuccessful mayoral campaign, and co-sponsored by Council Chair Kwame Brown, it primarily affects a ward encompassing the upper northeast corner of the city from the nexus of New Jersey Avenue at 3rd Street, N.E., and surrounding the New York Avenue commercial corridor within a southern boundary continuing along Florida Avenue and extending outward via Benning Road. The approved legislation limits the number of marijuana cultivation locations in any ward to six, passed with lightning speed within a week of introduction. David Catania, the gay At-Large Council member and Committee on Health chair, was credited with striking a deal reecting the best possible compromise. With neither side certain of the vote alignment, and Mayor Vincent Grays statement that the bill would further delay implementation of this important program, which is necessary to assist individuals who suffer with chronic debilitating pain not making much of an impact, Catania negotiated the lessened limitation. The original regulations, approved by the Council more than a year ago, dictated the citys business proposal solicitation and qualication process to date. The Councils action has upended and complicated progress and will likely cause further delays and difculties in determining locations for the small necessary number of production sites. Nearly all of the 28 business applications to operate each of only 10 cultivation centers permitted citywide including a signed property lease selected available and appropriate sites in Ward 5. Eight qualifying proposals have been forwarded to a respective Advisory Neighborhood Commission (ANC), which have a near-veto opportunity under scoring rules that portend more obstacles to come. Six of the eight sent for ANC review are for locations in Ward 5, resulting in the probability that remaining applications under review wont fulll the new geographic restriction. Because these businesses are production facilities only with no distribution component, strict security protocols are required, only 95 plants are allowed at each location in order to avoid heightened criminal penalties should the Obama administration continue with threats and prosecution interfering with programs nationwide and require only a modest and discreet size with a nondescript and non-commercial exterior, the reaction is both dumbfounding and disappointing. Cultivation businesses essential to implementation of the Districts pending medical marijuana program do not constitute behemoth Walmart of Weed footprints or activity. Their presence will actually be difcult to detect. The D.C. Councils kowtowing to opponents of these businesses is cowardly and will further delay and potentially limit or ultimately deny patients the benet of physician-prescribed medical relief.

Madonna sometimes likes to lay low for a few years, give people a chance to miss her, then come roaring back with a urry of new projects and appearances. And the world is in the throes of the biggest such onslaught in years. Its been percolating for weeks her song Masterpiece was a surprise winner at last months Golden Globes, her interview with Cynthia McFadden on ABCs 20/20 found the singer famously weighing in on Lady Gaga and she was on Jay Lenos Tonight Show this week. Fans are salivating in anticipation over Sunday nights Super Bowl halftime performance, this weeks release of new single Give Me All Your Luvin (with Nicki Minaj and M.I.A.), new album MDNA (slated for a March 26 release) and, to a markedly lesser degree according to some camps, the new movie W.E. which had a limited release in December and went into slightly wider U.S. release this week (no word yet on D.C. screenings).

Madonna fans, of course, are whipped into a frenzy but the rest of the world is curious too and it raises an ocean of questions: Is too much being made of the Madonna/Gaga comparison? How can Madonna call Gagas work reductive when the former spent years mining old pop culture imagery for inspiration? Is it unfair that we keep wondering if Madonna still has it to a degree we dont require of, say, the Stones or U2 each time they re-emerge? And could Madonna known, of course, for her controversial TV performances risk a Janet-caliber disaster if she tries something outrageous at the Super Bowl? Longtime Dupont Circle resident Michael Rawson has always been interested in painting, but his retirement a few years ago has given him more time to get serious about it. And the dedication is paying off the 64-year-old Quakertown, Pa., native has seven of his oil paintings in the new exhibit Beyond Words: The Symbolic Language of Plants which opens this weekend at the Delaware Art Museum in Wilmington and runs through April 8. Rawson is a member of Studio 155, an artists group that formed after its 17 members took classes together at the Corcoran Gallery of Art and collaborated on the 2006 exhibition Botanical Treasures of Lewis and Clark. Together their work is featured in the large Delaware exhibit. They work to realistically capture the natural world while expanding the boundaries of botanical art. I always loved plants, Rawson says. My mother is a good gardener. And trees are our tallest and biggest plants. They are what give us life the air we breathe, the food we eat, the shelter, our clothes. So that was my inspiration. Rawson spent most of his career as a pre-school teacher and says he always worked well with young children. He came to Washington in 1966 to attend George Washington University. He and partner Gordon Binder, a senior fellow at the World Wildlife Fund, have been together 38 years. They attribute the longevity of their pairing to companionship, intimacy, friendship, common interests and enough differences to keep it lively. Rawson enjoys water aerobics, reading, watching TV, quiet evenings at home and, of course, painting, in his free time. Go to delart.org for more information on the exhibition. Young gay Red actor takes acting seriously

is only as good as his last performance. He must be totally committed to the storytelling that is taking place onstage on any given minute. And though he breaks into a wide grin explaining his love of performing, Andrews reiterates that for him acting is not a game. Hes made a lifestyle choice that demands complete dedication. He sees himself as part of a noble, thousand-plus-year-old tradition. The actors rst artistic memory involves seeing Rothkos huge abstract paintings at the famous Rothko Chapel in Houston with his family. He describes much of his Amarillo, Texas, childhood as art driven lots of museums and creating things. But mostly, he focused on drama and dance. As a teenager, Andrews was on track to become a professional ballet dancer, but at the last minute he declined an offer to enter a young apprentices program with the Pittsburgh Ballet Theatre, opting to follow a broader theatrical career path. Directly out of high school, he landed a job in the national tour of Fosse and has been working ever since. Andrews is based in Chicago where hes an ensemble member of the progressive American Theatre Company and an artistic associate with the LBGT-centric About Face Theatre. Andrews is also heavily involved in the citys queer art scene and is a member of the three-man band, DAAN: Its named for band founder Dan Foley. We added the extra A to sound pretentious. We like to play around with the performance art aesthetic, he says. We describe our sound as queer electro fuck music.

Typically with works portraying the mentor/pupil dynamic, pupils take a backseat, says young actor Patrick Andrews. But in Red, John Logans exploration of artist Mark Rothko rocky relationship with his studio assistant Ken (currently playing at Arena Stage), its different. Local queer group performs for black AIDS awareness day


Brave Soul Collective will be performing Moments of Truth: Healing Ourselves From the Inside Out at Warehouse Theater (645 New York Ave., N.W.) on Tuesday at 8 p.m. The show will feature original work by founder Monte J. Wolfe and members Alan Sharpe, Jared Shamberger, Thembi Duncan and Cornelius Jones, Jr., including theatr, spoken word and personal testimonials. The Collective is an education, outreach and support organization for LGBT HIV positive and negative individuals living their lives in truth through the arts. This performance is in observance of National Black HIV/AIDS Awareness Day. Tickets are $15 and can be purchased online at bravesoulcollective.org.

Westenhoefer to play Birchmere

How to navigate the tough topics in the early days
If you are going on a date with someone who is more nancially successful than you, also dont assume (s)he is paying. Its not only inconsiderate, but downright rude. Assuming the other person is paying gives off a cheap vibe, which no one likes. Myth No. 3: No one wants to have the are we exclusive talk. Having this conversation can be very difcult for most. If you really are interested in a relationship and genuinely like someone, dont sleep with her/him until you decide to be exclusive. If you are sure that you are the only person (s)he is seeing, and you two are spending ve nights a week together, then the conversation should be easy. If you are casually seeing one another, then this conversation can be more difcult. To ease the chat, be open and upfront with her/him in the beginning of your relationship, in that you are looking for a relationship. No, you wont scare her/him away by saying this (as long as you dont say I want a serious relationship and I want it with you right off the bat). Myth No. 4: We are going to have sex on date No. 3, otherwise, (s)he isnt into me. This is certainly tough territory when it comes to managing a new relationship. If you didnt give in on your rst date/meeting, how do you handle when its time to get down and dirty? Sex has different meanings to many people. If you are seeking a relationship, dont build/start a relationship based on sex. It wont last. You have to be attracted to the person not only physically, but emotionally as well. If you both are really invested in building a relationship, then it is worth waiting to have sex until it feels right. Myth No. 5: (S)he didnt kiss me on our rst date (s)he isnt interested in me. Come on now, mature single people is a kiss really the make it or break it factor? We know from years of experience in coaching singles that some people dont even believe in kissing on the rst date. Kissing is one of the most intimate things two people do together. Many times, at the close of a rst date, the two of you are standing outside a restaurant and saying goodbye. This might not be exactly where you want to have your rst kiss. Dont be upset or read into it. Some people dont like PDA. Make sure to have an intimate second (or third, fourth) date where you know you will not have to worry about any onlookers. These are just a few hot topics prevalent in new relationships. Are you making your new relationship even harder by playing the game or avoiding certain topics because they make you uncomfortable? Dating newsash of the week: If youre serious about nding a relationship, avoidance hinders your chances of turning dates one, two and three into a serious relationship. Heres our advice: Myth No. 1: Wait for three days to call. This rule is a silly anachronism. Whomever made up the three-day call rule or abides by it needs some serious dating advice. If you want to communicate with the person you were irting with the night before, pick up the phone. If you had a two-hour conversation with someone at a party two nights prior, then pick up the phone and ask her/ him out. We dont believe that waiting a certain period of time shows any sign of interest. Texting is easier but its a cop out. (And is texting really easier than pressing call on your phone?) Waiting to see if (s) he will call you rst is just immature. You want a date? Initiate contact. Myth No. 2: The man pays for the date. Old-fashioned much? Understand dating in the modern world, people! So, lets say a friend/Grindr/matchmaker set you up for a rst date (or second) for Friday night, dinner. You have a blast, as you do with someone you really like. The meal is delicious and wine or tea is paired perfectly, conversation is effortless, chemistry is there. When the dinner check arrives, why is it all of a sudden awkward? Modern etiquette suggests that the person who asked the other out is responsible for covering the check. In the situation where you are set up by your matchmaker or a close friend, split it. It is always polite to offer to pay regardless of the situation. Show you are mannered and dont assume your date is paying. Note:

Revisiting resolutions
A month into the new year, its time to consider how to make our tness goals stick
achieved with the circumstances at hand. A wide-eyed scenario that is too extreme from your norm is a recipe for failure. If you have a mediocre gym ve minutes from your house, dont join the state-of-the-art gym thats 30 minutes away. Small, incremental changes stick better rather than grandiose sweeping modications. If you need more sleep, begin by going to bed 15 minutes earlier each night or if losing 30 pounds is in your mindset start by losing in ve-pound increments. Smaller increments are a much less daunting task and you allow yourself mini rewards along the way to assist in fueling your larger, often more intimidating, goal. In keeping with realistic and incremental goals, I nd it benecial in acknowledging that every little bit helps. Discovering what you can do in each moment or each day geared toward your goal can be liberating. Knowing that you dont have to lose 30 pounds in one day or be able to run a marathon in a week can make an overwhelming task or resolution much more within reach. I think back on the 100 mile bike rides I have done and remember that dissecting the ride into mini rides was not only a healthy contest, but a much more effective training approach than over-focusing on the totality and grueling nature of 100 miles. Taking 15 miles at a time was easier and I conquered them with more zest making the nal goal of 100 miles more triumphant. When I look too far for the end result or the larger goal that I am paralyzed and not sure what the next step should be. When I do the next right thing or think in terms of what I can do in that given moment, my goals are far more manageable and more enjoyable. Its a clich but it works take one day at a time. You didnt gain 30 pounds in a day, so its silly to think you can lose it that quickly. Changing everything at once is setting yourself up for failure.

Lesbian veteran shares ordeal; researchers interview hundreds of trans people

There are so many LGBT-themed books released all the time, its impossible to read them all. Here are two from last fall that deserve attention. Out of Step by J. Lee Watton is a memoir that tells of the authors years in the mid-1960s as a member of the Navy WAVES (Women Accepted for Volunteer Emergency Service), a division of the Navy that started in World War II for women that continued until 1972 when the ofce was disestablished in favor of women being integrated into the main force. Watton, a lesbian, shares her story of being one of ve WAVES who were tried and discharged in 1965 at the U.S. Naval Training Center in Bainbridge, Md., for being gay. Watton shares how the incident led to years of humiliation, decades in the closet and overall distress. A retired journalist who now lives in Delaware with her partner, a retired Army captain, Watton was eventually inspired to come out when she read Serving in Silence, a landmark book by former colonel Margarethe Cammermeyer that was eventually made into a 1995 TV movie with Glenn Close. Watton says Cammermeyers story inspired her to give up 25 years of living solely as a heterosexual. She dabbled in writing starting in 2000 but committed to it fully in 2008. Rehoboth Beach, Del.,-based publisher Fay Jacobs, a lesbian, says she was drawn to Wattons story and says its an important one to share. It was released last fall about the time Dont Ask, Dont Tell was repealed, timing Jacobs calls an amazing coincidence. I read it in manuscript form and I said immediately, Wow, this needs to be published, Jacobs, owner of A&M Books, says. Its so important to understand the kind of discrimination that gay people faced in the military for many years and its not just an incident that happens when youre 19, 20 or 21. Sue Rankin, who identies as queer, teaches education policy studies at Penn State University. She did what she calls a climate study on trans issues in 2003 but Genny Beemyn, director of the Stonewall Center at the University of Massachusetts, told her she hadnt asked the right questions, as Rankin puts it. The two embarked on another study in which they collected data throughout 2006, which theyve compiled in a book. The Lives of Transgender People encompasses the ndings of hundreds of interviews they conducted through participants they found mainly through online listservs and conferences. About 3,500 answered a survey. Rankin and Beemyn, who doesnt identify as either male or female, followed up with the interviews with about 400 of the respondents. We had such an enormous response, we thought it was book worthy, Rankin says. We knew we needed to hear what their experiences were in their own voices. She says to her knowledge, nothing of this scope has been attempted before. It wasnt Madonna at all who was pointing this out at rst, Musto says. Everybody online was chirping that it was eerily similar with the chord progressions and the rappy part being kind of Vogueish, he says. But Im all for anything that drives Madonna crazy her haughtiness, her pretentiousness. I mean lets face it, shes not the warmest tool in the shed and that has led to some ill will. Lady Gaga is deeply talented and obviously a better singer than Madonna, though I do think Madonna was great for calling out that one song. I am still on the Gaga team, but I did recently write that Madonna has, once again against all odds, made herself hot again just by putting herself out there. Musto predicts Madonna will continue to stay front and center in the pop culture limelight as long as she wants. She comes at it with steely determination and she wears these blinders 24 hours that bar out negativity, he says. To her, her new project is the best thing in the world. Yes, the deck is increasingly stacked against her, but she knows all the tricks to stay on top. She knows to work with the young, hot people and once again, shes made herself hotter than shes been in a long time. Others say Gagas success doesnt mean Madonna cant continue in a big way too. I dont think there has to be a Gagaversus-Madonna thing like youre either one or the other, says Michael Crawford, a gay activist with Freedom to Marry whos been a huge Madonna fan since the 1983 single Burning Up was released. Its not like youre either a Republican or a Democrat. Clearly I worship the ground Madonna walks on and I always will, but I think Gaga is very good too. A lot of people just want to be bitchy but Madonna is Madonna, Gaga is Gaga. Others say the comparisons are inevitable and warranted. Ive always told the rabid Madonna fans whove said Gaga is overly inspired by others that theyre on a weak foundation considering Madonnas many homages and references in her work, says Matthew Rettenmund, the gay author of Encyclopedia Madonnica. Sometimes when you listen to Madonnas most ardent fans, the ones who dislike Gaga anyway, they are using many of the exact same slams against Gaga that were used against Madonna her whole career by her detractors. That lack of perception is discouraging because I think Madonnas work does attract pretty smart fans. Her references are not low brow and while you dont have to understand every one of them to enjoy her work, being educated and informed does enhance your appreciation of it. I think Lady Gaga is

the only artist in 30 years to even approach Madonnas blueprint and I hope she is able to change and grow and keep it interesting in the way Madonna has been able to. One doesnt cancel out the other. Madonna, of course, clearly channeled Marilyn Monroe from the all out recreation of the Material Girl video to the more subtle bleached blonde looks she sported in the Bedtime Stories and Whos That Girl eras but is that any different from what Gagas doing with her or what Monroe herself may have channeled from her own predecessors such as Jean Harlow? It would be interesting if Marilyn had been around in the 80s and gone on Nightline or something and been asked about Madonna, says local nightlife impresario Ed Bailey, who DJs the popular Madonnarama events here and around the country. I think [the Material Girl video] was not just using that old concept for her own good, it was more of an homage and a statement about a strong powerful woman, which is something that clearly speaks to Madonna. I think there is a line between copying somebody and taking inspiration from something and there is a line between those two concepts. Sometimes its very blurry and sometimes its very clear. Rettenmund says the comparisons get silly after a while. I think it says more about gay men in particular and how they project themselves into their idols and how personally we take this trivial stuff, he says. I mean, My diva is better than your diva, is the level at which this is and my reaction to it, aside from obviously admiring and liking Madonna for 30 years and being brand loyal, is that I love Gaga too and Im happy to have all the divas around. Its gay-on-gay crime to be attacking over this nonsense. Its a homosexual civil war. Others wonder if Madonna will continue

to be able to capture the worlds attention indenitely. Shes been at it for decades now and even with all the changes in the way people hear and buy music, pop radio especially in the U.S. is as much a young persons game as it ever was, especially for female singers. On the last few albums, Madonna almost always manages a Billboard Hot 100 top 10 hit with the rst single, but follow-up singles routinely fail to chart stateside (they do better abroad and on the dance chart) and her last few singles Celebration and Revolver failed to hit big on U.S. radio. Younger divas from Rihanna to Kelly Clarkson to Gaga are logging much higher numbers. Musto says thats just how the industry works. I mean imagine if Peggy Lee had released something in the 80s or something. Would it have charted? No way, not unless she hooked up with the Bee Gees or something, he says. Diana Ross could come out with the most amazing song ever right now, it wouldnt get played. Working with these younger artists, like M.I.A., thats [Madonnas] way around it. Bailey says this time could be different. He says theres a coalescing of whats hot on the mainstream chart and in the clubs in a way thats unprecedented. That, he says, could bode well for Madonna. Ive been in clubs for 20 years and never in that entire time has there been a time when the dance music in the club and pop on the radio were identical until now, he says. Its just the way the world is right now. People are listening to Lady Gaga and Chris Brown and David Guetta and Flo Rida, you wouldnt call them pop artists really. Theyre dance artists. Now its every single thing you hear. People have an appetite now for that dance/pop sound with Rihanna, Katy Perry. I think for Madonna, this is gonna work out really well.

And as for the Super Bowl? Is Madonna taking pot shots at her old rival Janet Jackson when she promises no nipples or is it just more of the gays making too much of off-the-cuff remarks? Rettenmund says the performance will be huge. Rumors abound that shes invited the Gay Mens Chorus of Minneapolis to join her on stage. Im assuming its going to be a visual orgy of cheerleading with water cooler moments, he says. Madonna is an artist who is never considered fully proven every time she returns, there is this expectation of OK, show me from some quarters. And the Super Bowl is no exception, except this time Madonna has set it up as a make-or-break moment of her own doing so it has to be great. She knows that and in the past, she has lived up to expectations. Bailey calls it a tall order. The Black Eyed Peas were really good last year and shes got to live up to that. It has to be a visual spectacle. She cant just come out and say, Im gonna strip it all back and just make it about good, quality music. That wont work. And if a stunt should backre? Madonna would just laugh and keep going, Crawford says. I think Janet is really great, but Madonna just goes for it and makes no apologies Janet apologized and Justin sold her out, there was a lack of strength in that whole episode. Madonna has a unique ability to make things work to her advantage.

A trend in roof restoration on Capitol Hill homes could benefit owners in the long run

Historically, almost all the original and original-replacement flat- and low-slope roofs on Capitol Hill were made of standing-seam tin. Tin was one of the most common metal roofing materials used throughout the 19th century when most Capitol Hill homes were built. Today, you will still find many roofs in the area that are 40-plus years old that are standing-seam tin. In recent years though, roofs have been replaced with built up asphalt or rubberbased roof systems. These roofs are less expensive than tin, copper or other metal roof systems and are of better quality than earlier built up roofing materials, but metal roofs will last two to three times longer than a traditional asphalt roof. There is a recent trend to go back to tin or metal-based roof systems on Capitol Hill because of an historical interest in restoring roofs to their original materials. I will discuss some of the installation components, benefits of metal roofing systems and some of the concerns regarding metal roofing. Metal roofing systems can generally be constructed of copper, zinc, tin, terne, stainless steel and aluminum. While most of these types of roofs can be found on Capitol Hill, the most common new roof installations on flat and low slope roofs are standing-seam copper and tin. Standing-seam is a hidden fastener metal roofing system. Panels overlay in side-by-side fashion with each overlapping panel hiding the fastener that holds the previous panel in place. Penetrations of the fastenerholder are below the metal surface directly onto the roofing deck and thus protected from leaking entry points. Most standing-seam roof systems are fastened in a way that allows for expansion and contraction of the metal. The panels are roll-formed at the job site or roofing supply warehouse or can be precut and delivered by the metal roofing company manufacturer. Panels are usually made from 16- to 20-ounce copper or 24-gauge galvalume coated steel. The installation methods and the composition of the materials offer a longer lasting and more reliable roofing alternative to other roofing systems. Metal roofing is also an environmentally safe building material. Metal roofs contain a significant proportion of recycled metal content. When the time comes to replace your metal roof, the removed roof materials are fully recyclable and the recycled materials can be readily reused for other purposes. Metal roofs reflect solar radiant heat and reduce your cooling costs. Metal roofs are also impervious to rot and mildew and insect damage, such as termites. There are some concerns that have been expressed by homeowners about metal roofing systems such as noise levels, danger in lightning storms and cost.

It is true that metal roofs can be noisier than other types of roofs, but new metal roofing systems are typically installed over a solid substrate. Additionally, the attic and proper insulation levels provide a sound barrier. Metal roofs do not attract lightning any more than a conventional roof does. If the metal roof does get struck by lightning, it is less combustible than conventional roofing materials. Copper roofs are fire and spark resistant and resistant to hail and wind. Cost considerations do come into play when you are considering replacing your existing roof with a new metal roof. Initial costs of a metal roof are unquestionably higher, but the cost becomes considerably lower in the long run. As mentioned previously, metal roofs last two to three times longer than asphalt-based roofs, maintenance expenses are minimal (tin roofs need to be

painted every few years, copper roofs never need to be painted) and it is reasonable to assume that the value of a home is increased with a new metal roof. The investment depends on your outlook and time frame.
