Mr. Murphy, After your telephone call to me and several messages to the fellow tenant, Mr. Gerald Goldstein on September 29th and 30th, it became abundantly clear to me that you would continue your policy of not responding to make even the most basic repairs to make this unit habitable. Despite Mr. Goldsteins 8 year tenure as a dependable tenant who has made every rental payment (amounting to over $100,000.dollars), you continue to intimidate him and, as you said to me on September 29th: You should both be intimidated by me In a more detailed follow-up letter I shall detail a series of escalating intimidation and your slander against me. This has resulted in significant damages to both me and Mr. Goldstein. As for your persistent and willful violations and unlawful activity (and withholding of activity), I shall simply list some of the more blatant of regulations which have the force of law and are found in Chapter II of the State Sanitary Code [105 CMR 410.000] entitled Minimum Standards of Fitness for Human Habitation. You have known about most of these for years, but clearly in a letter of June, 2003 which I sent to you. Your response, of course, was to send eviction notices to me and Mr. Goldstein in July, 2003. As a landlord and Contractor licensed by the Commonwealth of Massachusetts, Office of Licensure, you are surely aware of these laws. I moved in on February 1st, 2003 and checks totaling $1,575. were received by you (security deposit, 1st and last months rent. There was no heat in my room or the bathroom and it became painfully clear that this condition would not be changed, even though you continue to falsify that you were not informed of this and other problems until April of 2004. Partial list of violations: [410.200] Heating Facilities.

[410.355] Provision for Oil [410.354] Possible violations. No access to main circuit breaker which is located next door at 344 part of duplex in a locked area. [410.351] Leaking toilet, unsafe stove with 2 electrical fires and then a sparking stop of electricity. You sent your colleague (Licensed Master electrician, Eric Woods) who lives directly across the street. He refused to repair or report to you the condition of the malfunctioning stove and, in fact, just told you that the unit was a mess and failed to say anything about this multi-decade old filthy, dangerous unit. [[410.352(B)] Missing or defective smoke detectors. [410.500] Defective gutters. Cause icing and other hazards and problems. [410.501] Windows and exterior doors must be weather tight. [410.600] A repulsive neglect and denial. Unlawful as well. [410.602](D) No secure basement door, lock, etc. This letter is sent as a final courtesy to you. Your days of intimidation, threats and neglect of dangerous, unsafe and squalid conditions must end. Also, I strongly urge you advise yourself and your subcontractors to cease and desist their harassment, clearly based on your instruction or implied slander.
