Summary of Claim: Claimant hired the Respondent on 06/07/2008 to handle a mediation matter, where Respondent was given a retainer in the amount of $5,000. On 09/08/2008, Respondent requested an additional flat-fee of $50,000. Claimant issued a check in the amount of $30,000, on 09/08/2008. Claimant alleges that on 04/22/2010, he hired Respondent to handle a foreclosure matter for a flat-fee of $4,000. Claimant states there were pleadings that were completed by Respondent, meetings took place and a phone deposition, which had to be canceled due to Respondent sleeping during the deposition; there were many meetings scheduled over the time-period, but were canceled by Respondent, ALL pertaining to the mediation matter. As far as the foreclosure matter, there appears to be no work that was done and that opposing counsel had trouble reaching Respondent. Claimant learned of Respondents suspension in the local paper in 03/2010 and asked Respondent what was going to happen to his cases, Respondent replied that he was appealing the Bars actions against him; Claimant feels that Respondent did not fully represent him and walked away from his legal responsibilities prior to Claimant hiring another attorney months before Respondents demise.
