LGBT advocates joined gay and lesbian members of the
Maryland General Assembly last week in predicting voters
in their state would become the rst in the nation to uphold
a same-sex marriage bill in a referendum expected to be
placed on the ballot in November.
With a crowd of same-sex couples and the eight openly
gay and lesbian members of the General Assembly
standing behind him, Maryland Gov. Martin OMalley on
March 1 signed the Civil Marriage Protection Act, which
calls for legalizing same-sex marriage in the state.
Several hundred supporters celebrated at a reception hosted
by OMalley at the governors residence immediately following
the signing ceremony at the State House in Annapolis.
Were going to win, declared Del. Luke Clippinger
(D-Baltimore City), one of seven out gay or lesbian members
of the House of Delegates.
Clippinger, like the others basking in the legislative
victory, acknowledged that supporters have a difcult task
ahead in going against what most observers predict will be
an aggressive and well-funded campaign by opponents to
defeat the bill at the polls.
Were going to win because people in our community
are going to get out, they are going to talk to their co-
workers, theyre going to talk to their neighbors, theyre
going to talk to everybody they know and tell them why
this is so important, said Clippinger.
Del. Heather Mizeur (D-Montgomery County), an out
lesbian, said supporters across the state were poised and
ready to wage an unprecedented campaign to retain the bill.
Its a very, very proud moment for all Marylanders to

Support puts senators ahead
of Obama on marriage
for same-sex couples

A group of U.S. senators is joining the wave of LGBT
rights supporters calling for an endorsement of marriage
equality in the Democratic Party platform.
The Washington Blade received statements from the
ofces of 22 Democratic senators including Sens. John
Kerry (D-Mass.), Dianne Feinstein (D-Calif.), Chris Coons
(D-Del.) and Ron Wyden (D-Ore.) expressing support
for including a marriage equality plank in the Democratic
Party platform. The Blade solicited statements from all 53
Democratic senators.
I think this is an historic moment for the Democratic Party
in our commitment to equal opportunity and our opposition
to discrimination I support marriage equality and I think
Massachusetts has taught the country an important lesson
about how marriage equality can work, said Sen. John Kerry
(D-Mass.), adding, No one should be worried about a party
platform that celebrates those advances.
The senators follow the lead of Sen. Jeanne Shaheen
(D-N.H.), who on Feb. 28 became the rst U.S. senator this
year to get behind the idea of including same-sex marriage
in the Democratic Party platform. Shaheen, whos also a co-
chair of President Obamas national campaign committee,
said she backs a plank in support of marriage equality
proposed by the LGBT organization Freedom to Marry.
In addition to calling for inclusion of marriage equality
in the Democratic Party platform, the language also backs
overturning the Defense of Marriage Act and passing DOMA

Gay rights pioneers burial
ceremony postponed

The man named by the late gay rights
pioneer Frank Kameny as the main beneciary
of his estate has led separate lawsuits against
four of Kamenys longtime friends and fellow
activists, charging that they wrongfully
removed property from Kamenys house
shortly after his death last October.
The lawsuits, which were led in D.C.
Superior Court on March 3 and March 5,
came days after one of the men now named
as a defendant, Bob Witeck, announced
that a March 3 ceremony for the interment
of Kamenys ashes at Congressional
Cemetery had been postponed in
deference to Kamenys estate.
Timothy Lamont Clark, the Personal
Representative of the Estate of Dr. Franklin
E. Kameny, led Complaints for Writ of
Replevin against Dr. Marvin Carter, Charles
Francis, Richard Rosendall and Robert
Bob Witeck in the Superior Court of the
District of Columbia Civil Division, says
a statement released by attorney Glen
Ackerman, who is representing Clark and
the Kameny estate.
The Estate alleges that Messrs. Carter,
Francis, Rosendall and Witeck removed
property belonging to the Estate of Dr.
Kameny without authority or permission,
Ackerman says in the statement. The
Estate is seeking immediate recovery of
the property wrongfully taken.
Witeck and Rosendall said they had no
immediate comment on the lawsuits. Rande
Joiner, an attorney saying she represents
Francis, said Francis also would have no
comment. Carter did not respond to an email
and phone message seeking comment.
U.S. Legal.com, a website specializing
in legal issues, describes Replevin as an
action or writ issued to recover an item of
personal property wrongfully taken. It says
it can be used as a legal remedy in which a
court requires a defendant to return specic
goods to the plaintiff at the beginning of the
action while the case is awaiting trial.
The suits allege that some or all of the
defendants improperly removed from
Kamenys house his personal papers; a U.S.
Army uniform of Kamenys; a statue; Gay
is Good pins; and personal and historical
photographs, among other items.
The lawsuit also claims Francis is required
to hand over to the estate the posthumous
certicate awarded to Franklin Edward
Kameny by the American Astronomical
Society on January 10, 2012.
Francis said in a press release earlier
this year that he traveled to Texas at the
invitation of the astronomical society to
accept the award on Kamenys behalf.
The lawsuits say each of these items
belong to the Plaintiff and the Estate
of Franklin Edward Kameny and are
of unknown historical value and of a
monetary value yet to be determined.
Ackerman told the Blade that Francis,
Witeck, Rosendall and Carter removed the
items from Kamenys house in November.
Rosendall and Witeck told the Blade
earlier this year that Clark, who was living
in the house at the time, gave them
permission to take the items to preserve
them for safekeeping, with the intent of
returning the items to the estate.
The two said Clark, who inherited
Kamenys house, told them he was about
to have the house cleaned to prepare for
placing it on the market for sale and was
ready to dispose of many of the remaining
items in the house as trash.
Rosendall told the Blade last week that
he, Witeck, and Carter became alarmed
that important papers and other items
needed to preserve Kamenys legacy were
in danger of being discarded and lost.
He said Clark had no objections to their
temporarily taking possession of the items
and allowed them access to the house.
Ackerman this week said Clark disputes
that characterization of what happened.
According to Ackerman, Clark says he
never told Witeck, Francis, Rosendall or
Carter that he planned to throw away
the items in question. Ackerman said
Clark feels he was misled by the men into
thinking they had the legal right to take
the items from the house.
At that time he didnt understand the
legal issues of all of this, Ackerman said.
Activists helped
Kameny in last years
Kamenys will, which names Clark as
Kamenys personal representative for
the estate, also names Clark as the sole
beneciary of Kamenys house, car and
all other possessions except his papers,
which Kameny bequeathed to the Library
of Congress.
Activists who know Witeck, Francis,
Carter and Rosendall credit them with
helping Kameny nancially in the last years
of his life. Carter, founder and executive
director of the local charitable group
Helping Our Brothers and Sisters (HOBS),
arranged for the group to raise money to
help Kameny pay his bills at a time when
he was in nancial need.
Francis founded the Kameny Papers
Project, which arranged for the Library
of Congress in 2007 to take possession
of thousands of Kamenys papers and
documents that cover the gay rights
leaders work on behalf of LGBT equality
over a 50-year period.
The project, under Francis and Witecks
direction, raised more than $75,000 from
donors to buy the papers from Kameny,
giving him needed nancial support, and
donate them to the Library of Congress,
where they are available to researchers.
Ackerman said he recognizes the
contributions of the four men on Kamenys
behalf. But he said that he and Clark are
legally obligated in probating Kamenys
will to keep an accurate inventory of all of
Kamenys property. All of the items taken
from the house belong to Clark under the
terms of Kamenys will, Ackerman said.
He said Francis has declined to say why
he has yet to deliver the Kameny papers he
took from the house shortly after Kamenys
death to the Library of Congress.
Its almost six months since Dr. Kameny
died, Ackerman said. What is it taking
so long for him to give those papers to the
Library of Congress?
He said he was troubled to learn from
Joiner, Franciss lawyer, that Francis and
the others have agreed to return the
items they took from the house but only
if the estate issues a legal waiver releasing
them from any liability associated with the
estate or Clark.
Ackerman said the estate refuses to
agree to such a waiver.
Why do they want to be released from
liability if they didnt do anything wrong?
he said.
Interment delayed
over gravesite ownership
The abrupt postponement of the March
3 interment ceremony for Kamenys ashes
at D.C.s historic Congressional Cemetery
startled many of the activists who knew
Kameny and planned to attend.
Patrick Crowley, interim senior manager
for Congressional Cemetery, said Witeck
informed him on March 2, one day before
the ceremony was to take place, that he
and the other organizers of the event
wanted to call it off.
All I can say is there is a disagreement
between the parties that own the plot and
the estate of Mr. Kameny, Crowley said.
Crowley said HOBS, operated by Carter,
purchased the gravesite earlier this year.
Ackerman said HOBS along with Francis
and Witeck announced plans for the burial
service without consulting Clark or the
Kameny estate. He said Clark, who has
legal rights to the ashes and planned to
take possession of them, was not informed
in advance of the burial plans and was
completely excluded from the entire
process of obtaining a cemetery plot and
planning the interment of the ashes.
When Clark asked about the ashes last
year, he was told they already had been
buried, Ackerman said Clark told him.
Ackerman said he and Clark did not learn
that the ashes had not been buried until
last month, when he saw a press release
about plans for the interment and a
cemetery ofcial told him the ashes were
in an urn at the cemetery ofce.
With this as a backdrop, Ackerman said
he informed the cemetery and Francis,
Witeck, and Carter, through attorney
Joiner that the estate would not allow
the interment of the ashes to take place
until HOBS signed over ownership of the
cemetery plot to the estate.
The estate would pay HOBS for the
plot and other burial related expenses,
Ackerman said.
He said HOBS agreed to do this but
informed him that the HOBS board could
not make arrangements to approve the sale
in time for the ceremony. Ackerman said
the estate had no objections to holding the
gravesite ceremony but it could not agree
to the burial of the ashes until the estate
gained legal ownership of the plot.
Reached by phone March 2, Witeck
acknowledged that the interment
ceremony was being postponed due to
issues related to the Kameny estate, but
he declined to provide further details
on the reason for the postponement,
including whether organizers didnt
want a ceremony if the ashes could not
be interred.

Critics say measure
blurs line between
church and state

Intense debate recently broke out
in Virginia after the state House and
Senate passed two almost identical bills
that would add a conscience clause
to current state adoption laws. Gov. Bob
McDonnell has promised to sign the bill
when it arrives at his desk.
The conscience clause would give
private child-placement agencies,
including those that receive state funding,
the legal right to refuse to consider
adoption placements that conict with
their moral or religious tenets.
Additionally, it would prohibit the
state from denying or revoking a private
agencys license for failure to comply with
rules, if the agency cited a religious or
moral objection to the rules. It would also
prevent individuals whom agencies refuse
to provide service to for moral or religious
reasons from seeking damages.
Proponents say the measure, sponsored
by Sen. Jeffrey McWaters (R-District 8),
will provide a legal basis for groups to
protect their religious freedom. Critics say
it is discriminatory and could be used as
legal basis to deny government-funded
services to Virginia residents whose lives
may not match beliefs of religious groups.
Conscience and moral are proving
highly loaded terms, and this short clause
has become the center of a much larger
debate about family, values and the line
between protecting religious freedom and
imposing religious values in government.
What is certain about the measure is that
for some Virginia LGBT parents hoping to
adopt one of the 4,407 children currently in
the states foster care system, it will make the
road to adoption more difcult.
Adoption is privilege, not right
Adopting a child isnt as easy as
Angelina Jolie makes it seem. To protect
childrens safety and best interests, the
state requires prospective parents to
undergo an intense verication process
and demonstrate they can support a
family and provide a nurturing, stable and
safe environment.
A lot of judgments are made when
placing a child, said Eileen Guertler of
the Virginia Department of Social Services,
which oversees 120 public and 77 private
child-placement agencies across the state.
Both local and private agencies take
into account the suitability of the home
environment, the ability of prospective
parents to raise a child not born to them,
as well as the childs individual needs all
placements are carefully weighed with the
goal that both parents and children will
thrive, Guertler said. Adoption is not a
right, it is certainly a privilege.
Currently, Virginia state law prohibits all
unmarried couples, regardless of gender,
from adopting. Since 2006, when state
legislators added an amendment to
Virginias constitution dening marriage as
being strictly between a man and woman,
the state has effectively barred same-sex
couples from marrying. Together these
laws prevent same-sex couples in Virginia
from adopting children.
Single applicants, regardless of sexual
orientation, are allowed to adopt, but
during the application process they must
undergo a home study and explain their
living situation. Home studies are detailed
observations required for all prospective
parents, whether single or married, to
ensure that children will be placed in
stable and nurturing homes.
For gay and lesbian parents, the
conscience clause complicates adoption
because their sexual orientation becomes
grounds for private placement agencies
to deny them assistance. LGBT parents
hoping to adopt in Virginia may have to
choose between searching for public
child-placement agencies that wouldnt
have moral objections or hiding an aspect
of their identities in order to adopt.
Proponents of the measure say it will
help streamline the adoption process
by protecting the religious freedom of
private child-placement groups to act in
accordance with their values.
But a recent report by the UCLA
Williams Institute analyzing the impact
of a similar measure in North Carolina,
suggests that it would deter adoptions
and place additional costs on the state.
According to the study, 40,000 gay and
lesbian individuals in Virginia are potential
adoptive parents who stand to be
impacted by changes in the states legal
adoption framework.
Neither McWaters, who sponsored the
bill, nor staff at the Family Foundation,
an advocacy organization that supported
the bill, returned phone calls or written
requests to discuss the conscience clause
and its potential impact on Virginias
adoption and child-placement process.
A family with two fathers
The impossible legal situation in Virginia
for same-sex couples hoping to adopt has
pushed some to leave the state.
We moved from Virginia because we
knew how difcult it would be for us to
adopt there, said District resident John
Clisham, who lives in northwest D.C. with
his partner of 25 years, Barry Parsons and
their three children.
Ten years ago, when we were looking
to adopt, there had been no home studies
written in Virginia that recognized a single
parent as being gay, he said. We had lived
in Arlington for 10 years, but knew we werent
going to bang our heads against a wall and
endure that process, so we moved.
At the time they were looking to adopt,
Clisham and Parsons had been together
for 15 years. Their household had the
elements of a stable, nurturing adoption
environment. They were highly educated
and had attended graduate schools, were
gainfully employed with full-time jobs, and
were within the normal age range when
couples become parents.
But because they were technically
cohabitating, not married, they would
have been deemed ineligible to adopt in
Virginia. To do so, they would have either
had to apply as a single individual, which
would have entailed living separately or
lying about their living situation, which
neither wanted to do.
When we moved to D.C., our home
study was written with the full facts of who
I was and what I did for a living. I was able
to list Barry as my partner, and it was very
out in the open that we were gay. This kind
of thing wouldnt be approved in Virginia,
Clisham said.
I think we were fortunate to live in a
community where we could easily move
from one state to another and keep our jobs,
but a lot of people dont have that option
and might have to choose, he added.
There are 14,243 same-sex couples
living in Virginia, according to the most
recent census data. Specic gures of
how many same-sex couples in the state
have adopted are difcult to nd, but
a recent report by the UCLA Williams
Institute found that same-sex couples in
Virginia are raising more than 400 adopted
children and 70 foster children. The report
further estimated that single gay and
lesbian parents are raising 1,700 adopted
children and 300 foster children.
The government has to change to reect
what families are today, not hold onto some
archaic notion of what family is, or should
be, Clisham said. Its important that people
understand how this clause could impact
those beyond the (LGBT) community. An
agency could decide that they wont allow
an adoption because you have too many
piercings ... or because you have certain
political beliefs. Where will it stop?
Many argue that the measure goes too
far in seeking to protect religious freedom
and is an imposition of religious values on
state affairs.
Sen. Adam Ebbin, (D-District 30) is one
of several Virginia senators who raised
concerns about how the measure blurs the
line between separation of church and state.
This bill invites discrimination in
adoption and authorizes private agencies
in the state to discriminate on whatever
basis they want, or nearly every basis
they want, Ebbin said. They cant act in
violation of federal or state laws, but this
bill gives license for state funds to be used
for religious discrimination ... the question
is whether charities that receive taxpayer
dollars should be able to discriminate.
No matter what proponents of the
legislation say, this is the rst step in trying
to deny gay and lesbian households the
opportunity to provide safe and loving
families for children without a family,
Ebbin said.

3 gays win at D.C. Caucus
to become Obama delegates
An openly gay labor ofcial who emerged
as a dark horse candidate nished ahead
of D.C. Council member and former mayor
Marion Barry (D-Ward 8) to capture the
rst-place position in the citys March 3
Democratic caucus to select delegates to
the Democratic National Convention.
Gregory Cendana, executive director of
the Asian Pacic American Labor Alliance,
an arm of the AFL-CIO, received 187 votes
compared to 138 votes for Barry among male
candidates running in one of two districts
created for electing convention delegates.
D.C. Democratic Party spokesperson Bill
OField said party ofcials Monday night
completed the nal vote count for the
caucus. An earlier count on Saturday showed
Cendana ahead but by a closer margin.
Joining Cendana as winners for an
Obama delegate position were lesbian
Democratic activist Lateefah Williams,
president of the Gertrude Stein Democratic
Club, the citys largest LGBT political
organization; and Jeffrey Richardson,
former Stein Club president and director of
the Mayors Ofce of LGBT Affairs.
The local Democratic Party divided the
city into two voting districts for purposes
of electing 13 delegates and one alternate
delegate among the citys registered
Democrats. Under party rules, four male
and three female delegate positions were
allocated to District 1 along with one
female alternate delegate slot.
In District 2, three male delegate positions
and four female delegate positions were
created. Some 89 people competed for the
delegate and alternate positions.
In the District 1 male contest, Cendana
nished rst, with Barry coming in second.
Council member Jack Evans (D-Ward 2) was
in 3rd place, behind Barry, with 134 votes.
Richardson came in 4th place with 108 votes.
Just behind Richardson in 5th place
was David Meadows, a former Stein Club
president and staff member for D.C.
Council member Michael Brown (I-At-
Large). Meadows, who received 105 votes,
lost his bid for a delegate seat because
only four male delegate slots were
available in District 1.
In the District 1 female category, Williams,
the current Stein Club president, nished in
second place, with 115 votes, wining one
of the three delegate positions available
for women in the district by a comfortable
margin. She nished nine votes behind
rst-place winner Suisan Meehan.
Cendanas strong showing and lead
over both Barry and Evans has raised
eyebrows among the citys political
establishment. Some local Democratic
Party activists criticized Barry and Evans
for running in the caucus, saying they
should have allowed grassroots party
activists to ll the delegate positions at
the caucus.
The critics noted that more than a dozen
additional delegates will be selected
to represent D.C. at the Democratic
Convention by the D.C. Democratic State
Committee and by the Democratic National
Committee in the coming months.
Tonights results reect the power of the
grassroots, Cendana said in a statement
released on Saturday. This kind of energy
is what powered Barack Obama four years
ago we were inspired then, and we are
inspired now as this small movement for
big change continues.
Although Cendanas supporters say
he was helped by votes from LGBT
Democrats, they acknowledge that he
beneted greatly by the citys organized
labor activists. But political insiders also
credit Cendana with organizing a highly
effective campaign for the delegate post.
Eight more LGBT candidates nished
further down in the vote totals and did not
emerge as winners when the nal tally was
completed.

Caucus, ACLU
at odds over HIV
criminalization bill
The chairperson and a member of the
Maryland General Assemblys Legislative
Back Caucus testied last week in favor
of a bill to make it a felony offense to
knowingly transfer or attempt to transfer
HIV to another person.
In a break from two organizations that
often are on the same side, an ofcial
with the ACLU of Maryland testied
against House Bill 622, saying it is
wildly out of proportion to current
public health trends for addressing HIV
transmission and could violate the rights
of people with HIV.
Del. C.T. Wilson (D-Charles County), a
member of the Legislative Black Caucus,
and State Sen. Catherine Pugh (D-Baltimore
City), chair of the caucus, were the only
two witnesses to testify in favor of the bill
at a hearing last week before the House of
Delegates Judiciary Committee.
Melissa Goemann, an attorney with the
ACLU of Maryland, was the only witness to
testify against the legislation. A separate
hearing on the bill was scheduled for
next week before the Senate Judiciary
Proceedings committee.
In his testimony before the House
Judiciary panel, Wilson said blacks in
Maryland and across the country have a
far higher HIV infection rate than whites
and other population groups.
Wilson said the states current HIV
criminalization law, which treats knowing
transmission of the virus as a misdemeanor
with a maximum penalty of three years in
jail, provides an insufcient deterrent for
the reckless act of engaging in sexual
relations with someone without disclosing
they are infected with HIV.
HR 622 calls for making knowingly
transferring or attempting to transfer
HIV to another person a felony with a
maximum penalty of 25 years in prison.
The current law truly minimizes the
devastation and recklessness of this
crime, Wilson said.
Goemann told the committee the
proposed bill would harm efforts to curtail
HIV transmission by discouraging people
at risk for HIV, including African-American
men and gay men, from getting tested to
determine their HIV status. She pointed to
studies showing that in most cases where
HIV is transmitted through sexual contact,
the infected person doesnt know he or
she is infected.
Ignorance of HIV status is the best
defense for knowingly transferring HIV,
she said, adding that passage of the
proposed bill would create a powerful
disincentive to testing.
Del. Luke Clippinger (D-Baltimore City),
one of the House of Delegates seven
openly gay members and an attorney and
prosecutor, said he is aware of the ACLUs
concerns and seeking out more information
on the bills potential impact before deciding
how he would vote on the measure. Hes a
member of the Judiciary Committee.
Im a prosecutor, but I have real
concerns about the bill having a chilling

Stein Club wont endorse
in at-large D.C. Council race
The Gertrude Stein Democratic Club,
the citys largest LGBT political group, was
unable to endorse a candidate in the at-
large D.C. City Council race on March 1
when none of the four candidates running
received a required 60 percent vote from
club members.
In a unanimous vote, club members
endorsed D.C. Council member Jack
Evans (D-Ward 2), who is running for re-
election unopposed.
Evans and the four at-large candidates
are running in the citys April 3 Democratic
primary. In a city where registered Democrats
outnumber Republicans by more than an
eight to one margin, winners in the primary
are considered the odds-on favorite to win
in the general election in November.
In the at-large race, challenger Sekou
Biddle received 45 percent of the Stein
Club members vote, with incumbent
Council member Vincent Orange
receiving 37 percent and challenger Peter
Shapiro receiving 19 percent. The fourth
candidate in the race, E. Gale Holness,
didnt receive any votes.
In a second ballot runoff vote between
Biddle and Orange, Biddle received
55 percent, falling ve points short of
the 60 percent threshold needed for
an endorsement. Orange received 39
percent of the runoff vote.
We had club members speaking on
behalf of Orange, Biddle, and Shapiro,
said Stein Club President Lateefah Williams.
Williams said the four at-large
candidates spoke at the March 1
endorsement meeting and urged club
members to support them, saying they
each were in support of LGBT rights.
Biddle, Orange, and Shapiro said in a club
candidate questionnaire that they support
the citys same-sex marriage law.
Holness said in her questionnaire that
she favors placing the D.C. gay marriage
law before voters in a referendum, an
action strongly opposed by the Stein Club
and LGBT advocates.
The club endorsed Biddle over Orange
in the citys April 2011 special election in
which Orange won the race for the at-
large seat. The seat became vacant as
a result of the 2010 election, when then
At-Large Council member Kwame Brown
won election as Council chairman.
Williams said the club will hold an
endorsement meeting sometime next
month for the May 15 special election
to ll the Ward 5 Council seat. The Ward
5 seat became vacant earlier this year
when incumbent Council member Harry
Thomas resigned after being indicted on
an embezzlement charge.

against homophobia
PHILADELPHIA At least 35 players in the National Hockey League have
joined together in a new initiative to ght homophobia and encourage inclusion,
according to the New York Times.
You Can Play is the brainchild of Philadelphia Flyers scout Patrick Burke the
older brother of the late Brendan Burke, who came out while managing the Miami
(Ohio) University hockey team and encourages gay athletes to participate in
sports. The initiative released a website and public service announcement featuring
members of the New York Rangers, Anaheim Ducks and Ottawa Senators franchises,
which will air Sunday on NBC during the rst intermission of the Bruins-Rangers game.
Over 80 percent of pro-hockey players told Sports Illustrated they would
welcome a gay player in the locker room, but as of yet, no pro hockey player
has come out of the closet. Burke and his father, Toronto Maple Leafs General
Manager Brian Burke, have been vocal proponents of LGBT inclusion in the sport
after Brendans death in a 2010 car accident.
Poll: Most dont vote based on
candidates gay marriage stand
NEW YORK While more Americans support extending marriage rights to
same-sex couples than are opposed, their support does not compel voting for
pro-marriage candidates, according to an NBC/Wall Street Journal poll.
The poll found that 49 percent of respondents support same-sex marriage,
compared with 40 percent opposed. Of those polled 32 percent were strongly in
favor, while 31 percent were strongly opposed.
However, when asked if a candidates stance on the matter would affect whether
the respondent would vote for them, only 25 percent said they would more likely
vote for a candidate who supported same-sex marriage. Only 20 percent said they
were more likely to vote for an opponent of same-sex marriage.
Episcopal bishop endorses
Anchorage equal rights initiative
ANCHORAGE Rev. Mark Lattime, the Episcopal bishop overseeing Alaska, has
endorsed an April 5 ballot measure that would extend non-discrimination protections
to people in Anchorage based on sexual orientation and gender identity.
According to the Alaska LGBT blog Bent Alaska, Lattime wrote his ock
calling on them to strive for justice and peace and to respect the dignity of every
human being.
Working and praying for the just and proper protection under the law of
all human beings is certainly a faithful expression of the higher calling of the
Baptismal Covenant, Lattime wrote.

fund selects new director
DENVER The Gill Action Fund has chosen Kirk Fordham, CEO of the
Everglades Foundation and a former staffer for Republican Rep. Mark Foley, as
the organizations new executive director, according to the Advocate.
Fordham, 44, acted as Foleys Chief of Staff for 10 years prior to the congressional
page scandal that caused the Florida moderate to come out as gay and end his
political career in 2006. Fordham then headed the Everglades Foundation, which
seeks to restore and protect the Florida Everglades ecosystem.
Gill Action was founded in 2005 by notable gay political funder Tim Gill, and
houses the OutGiving program, which engages LGBT political donors and channels
money toward electing pro-gay lawmakers while defeating anti-gay politicians.
Majority of New Jersey voters
support same-sex marriage
TRENTON A Quinnipiac University poll shows that New Jersey residents favor
same-sex marriage 57 percent to 37 percent, easing the way for lawmakers on the fence
on an override of Gov. Chris Christies veto last month of the marriage equality bill.
When given the option of marriage, civil unions, or no recognition for same-sex
couples, a plurality still chose marriage at 47 percent, versus 34 percent who preferred
civil unions and 13 percent who believe same-sex couples deserve no recognition.

The eld of Republican presidential
candidates didnt get any clearer Tuesday
night after results were declared for the
largest number of contests on a single day
during the GOP primary season.
On Super Tuesday, when 10 states held
primaries to award a total of 437 delegates,
each of the Republicans candidates who
had previously won states former
Massachusetts Gov. Mitt Romney, former
U.S. Sen. Rick Santorum and former U.S.
House Speaker Newt Gingrich took
claim to new victories. Libertarian Rep.
Ron Paul (R-Texas) didnt win any states.
Romney won six states: Alaska, Ohio,
Massachusetts, Vermont, Idaho and
Virginia. Santorum had three in his column:
Tennessee, North Dakota and Oklahoma.
Gingrich picked up a win in his home state
of Georgia.
The race in Ohio, where total of 66 delegates
were up for grabs, was the most highly
contested between Romney and Santorum.
With 99 percent of precincts reporting, Romney
won 38 percent of the vote, while Santorum had
37 percent. The win for Romney was narrow
even though he reportedly outspent Santorum
in Ohio by a 12-to-1 ratio.
Ed Mullen, executive director of Equality
Ohio, said a win for Romney was more
favorable than a win for the more anti-gay
Santorum.
While Gov. Romney has expressed
anti-LGBT positions during the campaign,
it is heartening to see that Ohioans
rejected the radical anti-LGBT positions of
Rick Santorum, who traveled the state with
Maggie Gallagher, Mullen said.
Gallagher, founder of the National
Organization for Marriage and one of
the most high-prole anti-gay activists,
campaigned with Santorum in Ohio.
Romneys other wins arent surprising.
Massachusetts is the state where Romney
has served in his highest capacity as a
government ofcial, and Vermont is nearby
in geography and Republicans there have
a similar temperament. Idaho has a large
presence of Mormons, which is Romneys
religion. In Virginia, Romney was one of two
candidates on the ballot along with Paul.
Kara Suffredini, executive director
of MassEquality, said Romneys win in
Massachusetts was not unexpected
as she cautioned a Romney presidency
would be very bad news for LGBT people
across America.
To go from President Barack Obama,
who has accomplished more than any
president in U.S. history to embrace the
full dignity of LGBT people across the
United States and around the globe, to
former Massachusetts Gov. Mitt Romney,
who has actively opposed justice for
LGBT youth and families at every turn,
would be a tremendous setback for LGBT
Americans, Suffredini said.
As governor, Romney opposed a
Massachusetts Supreme Court decision
granting same-sex couples the right to
marry and renewed enforcement of a
1913 anti-miscegenation law to block gay
couples from other states from coming to
the state to marry.
According to MassEquality, Romney
abolished the Governors Commission on
GLBT Youth and rescinded an executive
order prohibiting sexual orientation
discrimination in the state workforce.
Despite the split wins among the
candidates, Romney still has the lead in terms
of total delegates won in the Republican
primary. According to the Associated Press,
Romney has 212 while Santorum has 84,
Gingrich has 72 and Paul has 22.
Jimmy LaSalvia, executive director of
GOProud, said Romney has won the
lions share of delegates at stake and
Super Tuesday all but guarantees that
Romney will be the eventual nominee
of the Republican Party. LaSalvia has
personally endorsed the candidate in the
Republican primary.
Heads of LGBT groups in Tennessee
and Oklahoma said they werent surprised
Santorum won in their states because they
said his anti-gay message resonates with
voters there.

Grifn says LGBT youth
will motivate him at HRC

Chad Grifn has an image in mind as he
prepares for his role to become the new
president of the Human Rights Campaign:
young LGBT Americans who lie awake in
bed at night worrying about their future.
Grifn, a Los Angeles-based activist
who has a long career in progressive
advocacy and roots on both the East and
West Coast, said growing up in a small
town in Arkansas he identied as that
young person who couldnt acknowledge
or be open about who he was.
Some people know me as a guy who
lives in L.A. and used to live in Washington,
but my entire childhood was in Arkansas,
and its where my entire family lives today,
Grifn said.
Grifn said his motivation over the next
few years at HRC will be to impact the lives
of that young kid, the young student, who
lives in Fresno or Bakerseld or Arkansas,
or Washington, D.C., for that matter.
The fact that every single night, where
we all have very lucky lives and live in
places where were accepted, there are
thousands, if not millions, of kids who go
to bed every night staring at the ceiling
something that so many of us all did
not being able to go to sleep out of fear
of waking up the next day and facing that
next day, Grifn said.
HRC announced last week Grifn will
succeed Joe Solmonese as president
after his contract expires. According to the
organization, Grifns appointment followed
a six-month search by board members, who
considered more than 100 candidates.
Grifn is set take on his new role on
June 11, 2012; Solmonese will continue to
lead the group until that time.
Grifn lauded for Prop 8 lawsuit
Grifn gained notoriety after he founded
the American Foundation for Equal Rights
in 2009 and secured Ted Olson and David
Boies as attorneys in litigation against
Proposition 8, Californias ban on same-
sex marriage. Last month, the U.S. Ninth
Circuit Court of Appeals ruled the ban was
unconstitutional as a result of this lawsuit.
But Grifn has had an extensive career
ghting for progressive causes. According
to his biography on AFERs website,
Grifn is founding partner of political and
communications strategy rm Grifn-
Schake, and took on the tobacco and
oil industry while pushing forward with
issues such as equal rights, clean energy,
universal health care, stem cell research
and early childhood education.
An outpouring of support came from
LGBT advocates when HRC announced
Grifn would take the helm of the
organization.
Hilary Rosen, a D.C.-based Democratic
activist and former interim head of HRC, said
shes thrilled with the selection of Grifn
because hes entrepreneurial and visionary.
He anticipated how not just that Prop
8 needed to be overturned, but the right
way to do it, Rosen said. That was both
be smart legally as well as galvanize the
best cross-section of allies. He built an
organization to do that.
Rosen said Grifns top challenges over
the next couple years will be determining
the best way to maintain the momentum
in all the above strategy that is our struggle
for equality.
There are ballot measures, theres
legislation federally, theres legislation
statewide, Rosen said. How you weave
that together in the national conversation
and where you choose to devote
resources and bring out new allies, I
think, thats the challenge.
Rosen added Grifn has all the right
instincts and all of the right experience to
take on these challenges.
I think that this job is a perfect job for
him, and hes perfect for the community,
Rosen said. And thats a nice combo.
R. Clarke Cooper, executive director of
the National Log Cabin Republicans, said
Grifns selection of Olson, a U.S. solicitor
general under former President George
W. Bush, and Boies for his legal team
shows hes willing to work on a bipartisan
basis. The two attorneys represented
opposite sides in the case of Bush v. Gore.
The campaign for equality is not a
partisan matter, it is about doing what is
right for all LGBT Americans, Cooper said.
By selecting Chad Grifn as their new
president, the Human Rights Campaign
has selected a leader who knows achieving
victory will require advocacy and champions
on both sides of the aisle.
Congratulations for Grifn also came
from the White House. Valerie Jarrett,
senior adviser to President Obama, issued
a statement after his appointment was
announced.
The president appreciates the work that
the Human Rights Campaign has done with
us and we congratulate Chad on his new
position as president of HRC, Jarrett said.
We look forward to working with him.
Impatient with pace of progress
Grifn spoke with the Washington Blade
over the phone from Dulles Airport as he
awaited his ight back to Los Angeles.
He was on his way to attend on Dustin
Lance Blacks play 8, which is about the
enactment of Proposition 8 in California.
During the interview, Grifn was hesitant
to talk about specic policies hed like
to pursue, noting Joe Solmonese is still
running HRC, but said he wants to continue
the positive change the LGBT community
has seen over the past few years.
It means changes in the workplaces,
changes at the state and local level, and,
obviously, it means signicant policy
changes at the federal level, Grifn said.
So much has been accomplished
over the past several years, but were not
nished, he said. And that kid is still
waking up staring at the ceiling because
he or she lives in a country where their
government directly and intentionally
discriminates against them.
Grifn said his sense of urgency will be his
top challenge at the helm of HRC, noting,
If in fact patience is a virtue, its a virtue I do
not possess. I voice frustration consistently
at the pace at which we make progress.
If you were to talk to anyone who
knows me, I think that they would describe
rst and foremost my lack of patience and
how self-critical I am when I cant achieve
what we need to achieve, Grifn said.
When Grifn comes to HRC in June,
the race for the White House will be well
underway, as well as the race for control of
Congress. LGBT voters will see measures
on marriage in Minnesota and Maine, and
possibly Washington State and Maryland.
(The anti-gay ballot measure in North
Carolina is set for a vote in May prior to
when Grifn will take over HRC.)
Grifn said he has a background as a
political strategist and is used to working
behind-the-scenes, developing campaign
plans and executing them.
If youre going to win the war, youve
got to ght the battle on every single front,
Grifn said. So thats at the federal level.
Its on the state and local level. With any
campaign, with limited resources, you have to
be smart about your investments and about
your plan, but I am not one who believes we
should forego any avenues of victory.
Not shy about challenging allies
The incoming HRC president also
comes into the role as many critics
contend HRC has been too cozy with the
Obama administration and too afraid to
criticize Democratic lawmakers.
Grifn said observers should look to his
previous work to discover that hes not
one whos shy about disagreeing with
friends and colleagues when he believes
theyre wrong.
I have a long record in that and think
thats the best way to judge how I will act,
Grifn said. Im not one who is thought
to be shy or easily intimidated, and you
typically will always know what Im thinking
and how I feel.
Grifn said hes on board with two major
requests for President Obama from the
LGBT community: an endorsement of
same-sex marriage and an executive order
requiring federal contractors to have LGBT-
inclusive non-discrimination policies.
I fundamentally believe that not
only the president but our members of
Congress and all of our leaders should
support marriage equality, and we should
do everything in our power to get them to
that position, Grifn said.
Grifn called the proposed directive
for federal contractors something that
should happen, and should happen as
quickly as possible, but said its only the
rst step and passage of the Employment
Non-Discrimination Act is necessary.
Its so frustrating that were in a country
where we still dont have an inclusive
ENDA, Grifn said. That is something
that has to remain a priority, but I would
think that the executive order that has
been discussed and proposed and pushed
forward is a good step and should happen.

Schools allegedly
allowed anti-gay
harassment of students

The Obama administration has arranged
an agreement requiring Minnesotas
largest school district to change its
policies after it allegedly allowed students
to be subjected to anti-gay harassment.
On March 5, the Departments of Justice
and Education announced it had come to an
agreement with six student plaintiffs and the
Anoka-Hennepin School District and led
a proposed consent decree with the U.S.
District Court for the District of Minnesota.
According to a statement from the
Departments of Justice and Education,
the consent decree will remain in place
for ve years and require the Anoka-
Hennepin School District to undertake
several initiatives.
The requirements include retaining an
expert consultant in the area of sex-based
harassment to review the districts policies
and procedures concerning harassment,
as well as developing a comprehensive
plan for preventing and addressing
student-on-student sex-based harassment
at the middle and high schools.
The decree also requires retaining an
expert consultant in the area of mental
health to address the needs of students
who are victims of harassment and
submitting annual compliance reports to
the U.S. government.
The agreement must still be approved
by U.S. District Judge Joan N. Ericksen,
who is adjudicating litigation involved in
the case, for it to take effect.
In November 2010, the Justice
Department received a complaint alleging
the school district which educates
more than 40,000 students and oversees
37 schools was allowing anti-gay
harassment of students because they
werent conforming to gender stereotypes.
Thomas Perez, assistant attorney
general for the Justice Departments Civil
Rights Division, said the consent decree
provides a comprehensive blueprint
for sustainable reform to enhance
the Anoka-Hennepin School Districts
policies to protect students.
Anoka-Hennepin Superintendent
Dennis Carlson called the consent decree
a positive statement of the continuing
efforts to ensure a welcoming environment
for all students and families in our district.
No federal law prohibits schools from
allowing harassment or discrimination
on basis of sexual orientation or
gender identity. However, the Obama
administration found that the Anoka-
Hennepin School District was in violation
of Title IV of the Civil Rights Act of 1964
and Title IX of the Education Amendments
of 1972, which prohibit harassment on the
basis of gender, because schools allowed
harassment against students who werent
conforming to gender stereotypes.
In July, the National Center for Lesbian
Rights and the Southern Poverty Law
Center led a lawsuit against the district
on behalf of six students who say they
experienced harassment and violence as
a result of an anti-gay environment. As a
result of this litigation, the district agreed
to pay student plaintiffs a total of $270,000.
Shannon Minter, legal director of the
National Center for Lesbian Rights, called
the agreements an important step in
making LGBT and gender non-conforming
students feel safe in school.
On the same day the agreement
was reached, the Justice Department
led a complaint as part of its standard
practices to intervene in federal litigation
against the Anoka-Hennepin School
District. The complaint details harassment
of ten students who are identied by
letters such as Student A or Student B.
Student A alleged he was told Youre a
guy, act like it and was called so gay and
fag, despite having never identifying his
sexual orientation. Students spread false
rumors that he was a pedophile and
alleged he raped his mother. Additionally,
other students threatened to kill him,
pushed him, threw food at him and called
him names nearly every day for two years.
In response, the district discouraged
Student A from engaging in gender
nonconforming behavior and implemented

member of the statewide LGBT advocacy
group Equality Maryland, describes

become full citizens in the State of Maryland.
Asked the prospects of winning a gay
marriage referendum ght in Maryland,
given that voters in 20 states have passed
ballot measures banning same-sex
marriage, Carrington said voters attitudes
on the issue are changing rapidly.
I believe if you look at the current polling
data you see that the tide is changing,
he said. It is changing dramatically and
exponentially. And thats whats going to
be helping us. So I think Maryland can be
the rst state to pass this on referendum.
House of Delegates Speaker Michael
Busch (D-Anne Arundel County) shares the
optimism of supporters like Carrington on
the bills chance of surviving a referendum.
I believe that the more people
understand about this issue theyll look
at it as an issue of equal rights and civil
rights, Busch told the Blade.
Gov. OMalley: We
are all Americans
Busch and Senate President Thomas V.
Mike Miller (D-Prince Georges and Calvert
Counties) joined OMalley in signing
the bill before a crowd of hundreds of
supporters who packed the lobby of the
state capital building in Annapolis.
We are all Americans. And all of us at
end of the day want the same thing for
our children. We want them to live in a
loving, caring, and committed home that is
protected equally under the law, OMalley
said minutes before signing the bill.
OMalley made no mention of a voter
referendum expected to be placed on the
ballot in November calling for killing the bill
before it becomes law. But his brief remarks
at the bill signing ceremony appeared to
reect the themes that Annapolis observers
expect OMalley to use to defend the bill
before voters in the fall.
For a free and diverse people, for
people of many faiths, for a people
committed to the principle of religious
freedom, the way forward is always found
through greater respect for the equal
rights of all, for the eminent dignity of all,
OMalley said.
After signing the bill, OMalley handed
the legislation to Busch and Miller, who
placed their signature on the document.
Miller voted against the bill; Busch
voted for it.
The bill is signed, OMalley declared,
triggering a burst of applause and cheers
from the crowd.
Marriage equality supporters
prepare for ght
Ofcials with Marylanders for Marriage
Equality, the coalition of LGBT and straight
allied groups that coordinated the effort
to pass the bill in the legislature said that,
while celebrating their legislative victory
on March 1, they were gearing up for the
referendum ght.
Spokesperson Kevin Nix said the
coalition is already raising funds for the
referendum through a donation link on
its website and would soon be stepping
up fundraising efforts. He said he could
not discuss details on the organizations
campaign strategy by press time, saying
campaign related activities would be
announced soon.
Most agreed that OMalleys signature
on the Civil Marriage Protection Act was
the kick-off for what political observers
predict will be an acrimonious referendum
campaign in which opponents, as they
have in other states, will warn that
legalizing same-sex marriage would result
in the teaching of homosexuality in
elementary schools.
Brian Brown, president of the anti-gay
National Organization for Marriage, called
OMalleys signature on the bill a meaningless
gesture, saying the bill was certain to be
defeated in the upcoming referendum.

The platform committee is set to discuss
and agree upon language in the Democratic
Party platform when it gathers for the
Democratic National Convention Sept. 3
in Charlotte, N.C. Ofcials with Democratic
National Committee have declined to
comment on whether the platform will be
marriage-equality inclusive.
Evan Wolfson, president of Freedom
to Marry, praised these senators for their
endorsements and said his organization
looks forward to working with them and
their Democratic colleagues to move
forward this crucial plank.
Their support shows real momentum
among Democrats to make sure that the
party does what the Democratic Party does
at its best ght discrimination in all its
incarnations and lead the way forward toward
a more perfect union, Wolfson said.
The endorsement of these senators
puts them at odds with President Obama,
who doesnt support same-sex marriage,
but continues to say he could evolve to
support marriage equality.
The White House didnt respond to the
Blades request for comment on whether
Obama wants to see support for same-sex
marriage in the Democratic Party platform.

conference call on Feb. 27 over whether
to take an ofcial position calling for a
marriage equality plank in the Democratic
Party platform, according to gay

spoke on condition that they are not
identied, said they have heard conicting
reports on which caucus members support
or oppose taking a position on a marriage
equality plank at this time.

LGBT Caucus, saic all ol rhe caucus's
phone conferences are condential and
he could not comment on specic issues
discussed during the call.

Marriage equality leaders
speak out on bill signing
Given the historic nature of Maryland Gov. Martin OMalley signing the Civil Marriage
Protection Act into law, the Blade asked several leaders who fought for marriage rights
for same-sex couples to share their thoughts on this signicant milestone.
Dan Furmansky, former executive director of Equality Maryland: The arc of justice is
bending and we are all so excited. We are anxious for January 2013 to be here.
Lisa Polyak, Equality Maryland board chair: Gita and I became formally
involved with the quest for marriage equality in July 2004 when the ACLU-directed
litigation was led seeking marriage for same-sex couples in Maryland We are
so grateful to all the people in Maryland who helped to lift this burden over the
nish line in Annapolis.
Dana Beyer, Gender Rights Maryland executive director: This is a joyful time
for the Maryland community, the culmination of years of hard work by so many.
Thanks to the governors leadership, the trans community is now able to look
forward to the dignity and protections marriage currently affords our family,
friends and neighbors.
Douglas F. Gansler, Maryland Attorney General: Its a momentous day, its an
historic day Now we got the representatives of the people who have voted for
same-sex marriage here in Maryland, and now we want to make sure the people
do that if in fact it goes to a referendum.
Lea Gilmore, musical performer and civic activist: This is a day that is just so
amazing for me. I along with so many others have longed for this day. This is a day
we got to see justice happening in Maryland.
Pastor Larry L. Brumeld, Church of the Brethren and co-host of radio show
Black, White & Gay: The Human Side: This is a very signicant day for me
because it has been a long, hard battle fought Im glad this segment of the
population is going to experience civil rights and all of its privileges.
Joe Solmonese, president of Human Rights Campaign: This is a huge victory
for members of our community here in the State of Maryland ... But I am mindful
of the fact that we will not have nished this work until November when we ght
off the referendum that is likely to be on the ballot.
Sultan Shakir, Marylanders for Marriage Equality campaign manager: The
ceremony marks the end of a pretty long legislative ght recognizing that all
couples should be able to go to a courthouse and get married. The opponents
will be collecting signatures pretty soon, and if theyre successful, we take the
battle that weve been doing and we expand that outreach to the broader
community in Maryland.
State Sen. Allan H. Kittleman, only Republican in the Maryland Senate to vote
for the bill: Its a very exciting day a day that weve been waiting a long, long
time. Im excited the governor did this.
Maggie McIntosh, Delegate, 43rd District: A great day for equality in
Maryland. Thanks to all who played a part, especially Governor OMalley and
Speaker Busch.
Luke Clippinger, Delegate, 46th District: The bill signing was the culmination
of years of effort on behalf of thousands of Marylanders. It was a fantastic day, and
one that I wont soon forget.
Conviction handed down in gay teens slaying
On March 1, Dante Parrish, 37, was convicted by a Baltimore jury in the murder
of 15-year-old Jason Mattison, Jr. in East Baltimore in November 2009. Jason was
openly gay and had attended West Baltimores Vivian T. Thomas Medical Arts
Academy where he was a popular student.
The murder took place at the house of Jasons great aunt. Jason lived there
because neither his mother nor grandmother would accept him in their homes
because of his sexual orientation.
Sentencing is scheduled for April 3.
GLSEN and Towson University host youth summit
Approximately 100 LGBT and allied high school students from the Baltimore area
attended a Youth Summit at Towson University on March 3. The event, co-sponsored
by GLSEN-Metro Baltimore, is held to afford the students an opportunity to attend
workshops and network. It culminated with a dinner and dance.
Radio personality Anthony McCarthy was the keynote speaker. Workshop
topics included Coming Out, Racism in the LGBT Community and Coping
with Homophobia.

Blackouts author plans regional book tour
Openly gay author Mark Brennan Rosenberg brings his 45-city book tour to
Baltimore with a visit to The Book Escape (805 Light St.) on March 15 at 5 p.m.
Rosenbergs tour is to promote his rst book, Blackouts and Breakdowns,
as well as his second book, Eating My Feelings, slated for release on April 19.
Blackouts includes 11 short stories exploring Rosenbergs once excessive
drinking and the struggles he faced when becoming sober. Eating includes 16
essays about his time in fat camp, high school and more.

Maryland marriage law

D.C. has the wedding bell blues.
While most D.C. residents are as de-
lighted as the late singer-songwriter Lau-
ra Nyro must have been when the soul
era pop music singing group 5th Dimen-
sion took her song with that title to the
top of the charts in 1969 at the time of the
Stonewall Rebellion, the potential initia-
tion of same-sex marriage in neighboring
Maryland next January has signicant im-
plications for the number of lesbian and
gay weddings likely to be performed in
the nations capital.
As reported in this column in Decem-
ber, the number of same-sex marriage
licenses issued in the District has already
proven to be far fewer than originally pre-
dicted. Projections by marriage equality
advocates and city ofcials greatly over-
stated the total number of weddings and
economic benet that would result follow-
ing legalization two years ago this month.
The number of same-sex weddings in D.C.
involving couples from surrounding jurisdic-
tions will almost certainly decline before the
rst handful of rice is thrown in the Free State.
If D.C. loses its distinction as the sole
jurisdiction in the mid-Atlantic region and
on the southern seaboard allowing same-
sex couples to marry, the total number
of gay and lesbian weddings and corre-
sponding city fee collection, lower than
anticipated tax revenue and business
benet, and nearly non-existent private
sector job creation will be further re-
duced. The unexpectedly modest expen-
ditures on wedding-related services and
activities by same-sex couples has also
contributed to this disparity and startled
local businesses and wedding vendors.
When the Maryland legislature ap-
proved the Civil Marriage Protection Act
and the governor signed the historic bill
last week, the state set out on a path to
join seven other states and the District of
Columbia in embracing marriage equality.
The Maryland law, however, is subject to an
almost certain voter referendum in Novem-
ber, as opponents are expected to easily
gather the required number of petition sig-
natures to place the measure on the ballot.
An expensive and intensive campaign
to preserve the Maryland law will be re-
quired, with polls indicating that the vote
could be extremely close. Regardless of
the nancial impact for Washington, our
neighbors should enjoy the nancial sup-
port and active participation of District
residents in supporting marriage equality.
Rules for D.C. food trucks
The D.C. Council Committee on Fi-
nance and Revenue last week unanimous-
ly approved a bill to require food trucks
to collect and pay the 10 percent local
sales tax imposed on restaurant sales
and prepared food items. As reported
here last week, food trucks are currently
required to pay only a nominal at fee of
$1,500 per year in lieu of the standard tax
rate the equivalent of paying sales tax
on a mere $15,000 in annual revenue.
D.C. Food Truck Association (DCFTA)
Executive Director Che Ruddell-Tabisola is-
sued a statement opposing the proposed
sales tax measure, renewing the organiza-
tions insistence that any decision to require
compliance with local tax law be contin-
gent upon the implementation of pro-
posed new vending regulations to which
food truck operators seek revisions. The
Council committee rejected this attempt to
link the two unrelated city agency matters.
The tax legislation now moves to the
full Council, with initial consideration like-
ly in April followed by a nal vote expect-
ed in May. If approved and signed by the
mayor, as anticipated by most observers,
the updated sales tax law would go into
effect in October.
Meanwhile, the period for public com-
ment on D.C. Department of Consumer
and Regulatory Affairs (DCRA) proposed
regulations governing food truck operation,
recently detailed in this column, came to a
close last week. City ofcials have indicated
that they will now review the submissions
that include substantive comments in or-
der to evaluate whether the proposed rules
should be revised prior to submitting them
to the D.C. Council for an up-or-down vote.
If DCRA decides to signicantly change
the current draft of the regulations, the
agency could again issue them for an ad-
ditional round of public comment before
nalizing a recommendation to Council.
Although a timeline for agency review
and action is unknown, it may take several
weeks to complete. Once the proposed
rules are nalized, DCRA will provide its
suggested rulemaking to Council for ad-
dition to the legislative calendar.

Primary season brings series
of homophobic attacks

In a recent interview with CNN, Cindy
McCain was asked for her opinion on her
partys attitude toward gays. McCain had
generated a great deal of attention in 2010
due to her participation in the NOH8 cam-
paign for marriage equality, and has come
to be seen as a supporter of LGBT rights,
despite the fact that she later said she stood
by her husband and his position against
repeal of Dont Ask, Dont Tell during his
Senate re-election campaign that year.
But when asked about her partys op-
position to gay rights, McCain dismissed
it, saying, I disagree with that. I think
the media portrays that. I think being a
Republican, being part of the party for
as many years as I have and knowing the
Republicans the way I do that is not the
case and thats not the bulk of Republi-
cans that believe in that, at all.
McCain insisted that most Republicans
in her state actually support equality for
gays and are opposed to negative cam-
paigning on social issues, and that nation-
ally it is a vocal minority that rails against
gays. Whether or not most Republicans
she knows arent opposed to LGBT rights,
what she doesnt seem to acknowledge is
that these vocal ones are the Republican
politicians who control the levers of power
and the voters who participate in elections.
Perhaps CNNs Erin Burnett could
have pressed McCain to explain the role
that the vocal ones and their animos-
ity toward gays have played in her partys
presidential nomination process. In this
primary season, weve seen a Republican
audience boo at an active duty American
soldier when he revealed that he is gay
via YouTube. Weve seen Texas Gov. Rick
Perry campaign explicitly against the fact
that gays and lesbians are now allowed to
serve openly in the military. Weve seen a
run for the nomination by Rep. Michele
Bachmann, a candidate who co-owns,
with her husband, a family-counseling
clinic that uses reparative therapy tech-
niques and promotes the ex-gay cause.
And weve seen a race where most of the
leading candidates have signed the Na-
tional Organization for Marriages anti-
gay marriage pledge, which included a
promise to investigate harassment of
traditional marriage supporters.
Outside of the presidential race, New
Jersey Gov. Chris Christie last month ve-
toed a bill that would have allowed for
marriage equality in his state, amid spec-
ulation that he is aiming for a chance at
the vice presidential slot on a Republican
ticket. These are just a few examples from
the past year of anti-gay politicians acting
as the face of the partys mainstream.
It is wishful thinking on the part of Re-
publicans like Cindy McCain to say that
social issues, including anti-gay senti-
ment, are not driving the agenda of their
party. By blaming the media, McCain is
participating in the same cynical strate-
gies undertaken by her partys presiden-
tial candidates, and by Tea Party gures
like Sarah Palin. At this point, campaign-
ing against the media has become al-
most as institutional to the Republican
Party platform as the anti-gay positions
that she claims are insignicant. The me-
dia cannot be blamed for discussing what
these politicians believe, and similarly,
McCains statement that the Republican
Partys anti-gay policies are media hype
has no basis in reality.
It is one thing to participate in a ashy
photo campaign, but in politics, words
and actions matter. If Cindy McCain truly
believes in ghting for equality for LGBT
people, she shouldnt be dismissive of
homophobia in her party and treat it as a
media exaggeration.
She should be willing to call out mem-
bers of her own party who campaign on
denying gay people their rights. Support
for an issue doesnt count if its the kind of
support that happens off the record among
friends, as criticism aimed at the media in-
stead of politicians, or voiced only when
there isnt an election happening.
It is true that there are people in the
Republican Party who have come to
support LGBT rights, particularly young
people. But the unpopularity of the issue
among the partys base makes it especial-
ly crucial that these young Republicans
have role models to demonstrate that it
is OK for them to press for what they be-
lieve in. Homophobia in the Republican
Party is real, and simply blaming the me-
dia isnt going to make it go away.
There is more to family
creation than simply
bringing a child home

Conceiving Family, a documentary
that follows ve same-sex couples in
Canada along the path to parenthood, is
ironically named all the couples adopt
rather than biologically conceive, to bring
children into their families.
American-born lmmaker Amy Bohi-
gian chose the title, she said in an inter-
view, because she liked the double mean-
ing of conceive the biological sense
and the thought process. She also hopes
that people who Google conceiving
most likely people trying to have biologi-
cal children might come across the lm
and be moved to consider adoption as a
viable option.
The lm was a personal as well as profes-
sional endeavor for Bohigian. She began
it because she wanted her own adopted
children to see how we all came into each
others lives. She and her partner, Jane
Byers, are one of the couples featured.
Bohigian at rst tried really hard not
to make a documentary, however, she
said. She feared Byers would be annoyed
if I had been worried about camera
placement and lighting as we were meet-
ing our children for the rst time.
She therefore decided to document
particular moments, rather than make a
documentary lm.
Eventually, however, she realized she
wanted to share the ways adoption had
transformed our lives for the better, and
decided to weave the moments of their sto-
ry with those of other lesbian and gay adop-
tive parents making a lm despite herself.
Each of the families has a different tale
to tell about their path to parenthood.
Bohigian and Byers adopted biracial
(East Indian/Caucasian) 15-month-old
twins who were being fostered by a Chris-
tian fundamentalist couple. To help the
children transition, the two couples lived
together for two weeks. The birth fam-
ily expressed that they felt homosexuals
were sinners, but Amy and Jane realized
that it was in the childrens best interests
for the two families to get along.
When the families visit a year after
the adoption, the birth father said that
he had told the members of his church,
[Bohigian and Byers] have committed
to loving these kids. That to me is more
Christian that what I see in most of the
denominations. ... These guys are actually
practicing the reality of what it is to com-
mit and love people.
Jan and Lindsey, another couple in the
lm, took a different path. They rst tried
assisted reproduction after having to lie
about their sexual orientation to a doctor
who didnt want to treat lesbians but did
not get pregnant. Then, inspired by a friend
who had adopted from Romania, they de-
cided to do the same. Not only was the trip
to Romania challenging in itself, but it was
followed by one of the twins nearly dying
after coming to Canada. After that, they
fought the courts for the right to have both
of them named as legal parents, eventu-
ally becoming the rst same-sex couple
in British Columbia to get joint custody
and guardianship. Twenty years later, they
fostered and adopted a baby boy and his
older sister from British Columbia.
Daryl and Ian faced subtle and not-
so-subtle discrimination from adoption
agencies and birth families. After prepar-
ing a nursery and buying a minivan, they
were rejected at the last minute by the
rst birth family that had selected them.
Eventually, the men adopted a four hour-
old baby boy from another family.
Jim and Ted considered surrogacy,
but rejected it as too expensive. Instead,
they adopted a ve-year-old boy, as Jim
worked to overcome the self-doubt in-
stilled by his upbringing as a good Cath-
olic boy and fears of disappointing his
devout mother.
Colleen had had children through a pre-
vious marriage to a man, but then decided
to raise a child with her partner Tammy.
They fostered a sick child of indigenous
heritage, and made the choice to return
with her to her community in Haida Gwaii.
Although they feared someone there
might want to adopt her instead, they
knew it was important for the girl to main-
tain connections to her roots. As it turned
out, they were welcomed with open arms.
Although the girls birth mother struggled
with whether to keep her child, she ulti-
mately decided to let Colleen and Tammy
become her adoptive parents.
Bohigian captures the experiences
that her subjects share waiting to hear
if there is a match with a child; misun-
derstandings or discrimination because
they are same-sex couples; the process
of transition for the children; maintaining
connections with birth families while
not ignoring the differences in how each
approaches these issues.
The emotionally and technically raw
footage of her family, she said, is not as
much through the lens of a lmmaker going
through this process, but of me when I was
becoming a parent. That distinction may
sound slight, but it made all the difference.

Couples from the 2004
lawsuit rejoice at states
marriage passing

Theres no questioning Charles
Blackburns love for partner Glen Dehn:
He met the now-retired government
worker at a party, moved in immediately
and is still with him 33 years later.
Yet the pair has never walked down the
aisle not because the men didnt want
to, but because the state of Maryland said
they couldnt.
We could never understand how a
committed relationship of two gays or two
lesbians could possibly hurt a heterosexual
marriage and we havent been told yet,
says Blackburn, who, urged by a friend,
signed the couple up to join a 2004 lawsuit
for same-sex marriage in Maryland.
Years later, the Blackburn-Dehn couple
is among 19 original plaintiffs rejoicing
in the wake of a newly signed measure
legalizing gay marriages in Maryland.
Gov. Martin OMalley signed the bill into
law on March 1; Maryland joins D.C. and
six states in legalizing gay marriages. The
Civil Marriage Protection Act is scheduled
to take effect in January, though a voter
referendum in November could kill the
measure before then.
For now, the signing brings to a close
a ght thats meandered from the failed
lawsuit, to legislative hearings and nally,
to the governors desk.
As the ght for marriage has twisted
and turned, so too have the lives of
those original couples through family
changes, relationship endings and new
beginnings.
Yet through it all, several of the original
plaintiffs tell The Blade theyre glad to
have played a role in securing the rights of
same-sex couples and families in Maryland
and beyond.
Whatever obstacles you face, you want
to make it better for yourself but you also
want to leave a path thats a little bit better
for the people who come behind you,
says Gita Deane, who joined the suit with
partner Lisa Polyak. I dont for a minute
think that we shouldnt have done it.
We had to do it
Polyak and Deane were living the life
of the average family with two young
daughters when a turn at the microphone
during a town hall near their Baltimore
home changed everything.

our lives being parents and about things we
wanted to do for our kids that we couldnt,

Joshua Bennett did the whole New York/professional actor/singer/dancer
thing for long enough that although he still loves performing, he says hes
perfectly content doing it in a volunteer capacity.
For some reason when it becomes my job or my obligation, its no longer
something I enjoy, the 36-year-old Kalispell, Mont., native says. I think of my
talent as a gift so when Im getting paid it becomes a chore.
Bennett gets plenty of chances to put his talent voluntarily to use with the
Gay Mens Chorus of Washington, which he joined shortly after moving to D.C.
in January, 2010. It started innocuously he was just looking for a way to
make friends. Since then hes had starring roles in several major productions.
Look for him as Frank N Furter in the Choruss all-male production of Rocky
Horror Picture Show next weekend (three performances at the G.W. Lisner
Auditorium; go to gmcw.org for details).
I just joined to be a singer, Bennett says. I never expected all these other
opportunities. I just gured Id be in the risers singing.
And for some shows he is. But Chorus brass obviously enjoys making use of
Bennetts professional training. He has an Actors Equity card and was in touring
companies of The Producers and Oklahoma during the six years he spent
in New York.
Bennett works by day as resident concierge team leader at Archstone, an
apartment building in Crystal City, Va., where he lives. He says eventually hed
like to go back to school but is professionally content for now.
And no, he doesnt have any issue with many of the barely there sartorial
selections the Chorus has for him. As a dancer, you lose a lot of your inhibitions,
he says. And I know sometimes the crowd likes to see a little skin.
Bennett is single and enjoys music, dancing, reading and TV in his free time.

I started the coming out process when
I was 22, shortly after I got divorced from
my ex-wife. She was the hardest person
to tell and I waited until she discovered it
on her own via Facebook 11 years later.

I would have to say Ellen DeGeneres.
Watching her come out publicly as a
young (closeted and married) gay man
was very inspiring. It gave me hope that
one day I could live freely and openly
without fear.

WHATS WASHINGTONS BEST
NIGHTSPOT, PAST OR PRESENT?
I dont go out often, but when I do the
best nightspot is wherever my friends
happen to be.

DESCRIBE YOUR DREAM WEDDING.
I dont really believe in the institution
of marriage anymore, but I do believe in
equality. I also claim the right to change
my mind for the right guy.

WHAT NON-LGBT ISSUE ARE YOU
MOST PASSIONATE ABOUT?
I am very concerned with
environmental issues. I think we need to
be more responsible with how we treat
our home.

WHAT HISTORICAL OUTCOME
WOULD YOU CHANGE?
There are too many instances of social
injustice in the history of humanity to
choose just one. Trial and error and
sometimes downright stupidity have
led humanity to where we are now, and
it is futile to wish things had happened
differently. Without those historical
moments, we would not be where we
are today. It is heartening to live in a
time when there is so much progression
on the equality front.

the brainwashing, but some people
can never reconcile who they are with
who they are told to be. We need to
continue to work hard to erase this idea
that homosexuality is wrong. We are
who we are.

Gay puppet innovator
dazzles with local run

Basil Twists work has been called
superhuman, breathtaking and adored
not the usual words used to describe
a puppet show. But then, Twist isnt
your usual puppeteer. His sophisticated
approach to puppetry melds tradition with
innovation and in the process takes the art
form to new heights. Throughout March
and April, four of his shows can be seen
locally as part of Twist Festival D.C.,
giving area audiences an opportunity to
experience his magic.
The mini-fest kicks off at the Shakespeare
Theatre Company with Petrushka, Twists
take on the classic Russian ballet about a
love triangle involving three puppets: the
eponymous clown, a ballerina and a Moor.
Originally commissioned for New Yorks
Lincoln Center in 2000, its a puppet show
about puppets with music Russian
identical twins Irina and Julia Elkina play
a reduction of Igor Stravinskys score on
identical pianos.
And though he doesnt perform in the
show, Twist selected, trained and directed
the unseen puppeteers who animate the
4-foot-tall puppets that he built. Three
puppeteers are required to operate
one puppet. For me the puppet is the
embodiment of a super human being,
Twist says. The puppet ballerina soars.
She can do things that a human being
only wishes she could do.
A third-generation puppeteer, Twist,
who is gay and single, broke onto the
scene in 1998 with his underwater, classical
musical puppet show Symphonie
Fantastique (with a festival production
at Clarice Smith Performing Arts Center
at the University of Maryland in College
Park). He credits his training at Frances
prestigious cole Suprieure Nationale
des Arts de la Marionnette with allowing
him to think outside the traditional puppet
box: I was taught how puppetry ts into
the larger world of art. Its prompted me
to collaborate and think larger and more
ambitiously about the place of puppetry
in the world.
The festivals other two productions
are Arias with a Twist, his racy and
riveting collaboration with New York
cabaret and drag performer Joey Arias;
and Dogugaeshi, a Japanese-inspired
journey of images accompanied by original
shamisen (Japanese lute) compositions
performed by master musician Yumiko
Tanaka (at Woolly Mammoth and Studio
Theatre respectively).
A good puppeteer is game, ready and
willing to do whatever it takes, says Twist,
41. Its not comfortable: A puppeteer must
put his body in weird positions. Ive tried to
use dancers as puppeteers but because
theyre so into their own bodies, they have
a hard time translating movement into
another object. Musicians who play guitar
and piano have more success.
Growing up in San Francisco, Twist
played with puppets and made envied
Halloween costumes. He loved the
Muppets and dreamt of a career in
puppetry or animation. He briey attended
Oberlin College where he quickly realized
that Ohio undergrad life wasnt for him.
One day at the library he came across a
book describing internships at the Center
for Puppetry Arts in Atlanta. Instantly
he realized, Thats where I needed to
be. It was crystal clear to me. So Twist
left school and moved to New York City,
where he still lives. Freshly determined
to become a professional puppeteer, he
interned in Atlanta and later studied in
France. Fortunately for him, the puppet
thing has worked out, because I cant do
anything else.

Tips to keep your
metabolism humming
and weight down
You may often hear someone intimating
that their excess weight is attributable to
a slow metabolism. Is this a scapegoat?
Lets examine these notions further and
see what we can do if anything to affect
metabolism.
Metabolism is essentially the rate
at which we absorb and process
calories converting food into fuel
and burning calories. The complexity
lies in the fact that not everyone burns
calories at the same rate and that there
are several factors to consider when
establishing ones metabolic rate.
Age, sex and the amount of muscle
mass are the three biggest influences
on metabolism and some people
just burn calories at a slower rate than
others, says Barrie Wolfe-Radbill, a
nutritionist specializing in weight loss
at the New York University Medical
Center. And despite the fact that the
thyroid glands function could have an
impact on metabolism, this is actually
rare and often the go-to diagnosis.
The good news is that despite these
certain pre-disposed considerations; there
are some things that can be done beyond
gender and genetics to speed up ones
metabolism and aid in weight stabilization
or loss.
Despite the misconception that excess
weight means a slower metabolism, the fact
remains that the more weight you carry, the
faster your metabolism is likely activated.
The simple fact is that the extra weight
causes your body to work harder just to
sustain itself at rest, so in most instances,
the metabolism is always running a bit
faster, says Molly Kimball, sports and
lifestyle nutritionist at the Oschers Clinics
Elmwood Fitness Center.
Another important fact to understand
is that muscle is signicantly more
metabolically active than fat. Personal
tness trainer Kelli Calabrese says that
every pound of muscle in our bodies
burns 35 calories a day, while each pound
of fat burns just two calories per day. This
explains why weight training is crucial to
a procient metabolism muscles simply
activate metabolism at a much higher and
more efcient rate.
And if you are trying to lose weight
it is actually counter productive to
neglect weight training in lieu of strictly
cardiovascular activity.
What other external factors affect
metabolism and what can be done to
boost metabolism?
Eat breakfast
Yes, it is indeed the most important meal
of the day. Eating breakfast wakes up our
bodies and stokes the metabolism into
greater efciency as opposed to allowing
it to remain essentially dormant when
we neglect food. Mother Nature goes
into shut down mode when we starve
ourselves as a protective mechanism to
hold onto calories due to the caloric decit.
Your breakfast should consist of a mix of
lean protein with complex carbohydrates
and healthy fats.
Caffeine
Caffeine stimulates your central nervous
system by increasing your heart rate and
breathing, says Robert Keneck, Ph.D.,
a research physiologist at the U.S. Army
Research Institute of Environmental
Medicine. Honestly, Keneck says, Could
there be a more perfect beverage?
Drink cold water
Your body may actually burn a few extra
calories by heating the cold water slowly to
your core temperature and while this may
not seem like much, every little bit helps.
Chili peppers
Yes, arguably these spicy little devils
can impact your metabolism. A study
published in the Journal of Nutritional
Science and Vitaminology resulted in the
determination in a temporary spike in
metabolism of about 23 percent.
Avoid alcohol
First and foremost, alcohol contains
seven calories per ounce of alcohol, not
quite as many calories as fat, but the
calories have very little if any nutritional
value sans occasional red wine in
moderation. And essentially alcohol stops
your metabolism dead in its track. Your
body will naturally use the alcohol as fuel
instead of fat and fat will continue to just
sit there if left to its own devices.
Get plenty of sleep
As is commonly suggested, eight hours
is generally best, eight to nine hours
depending on individual needs is a solid
guideline. Any less and researches at
Stanford University found that people
who snoozed fewer than seven-and-a-half
hours per night experienced an increase
in their body mass index.
So there you have it above all else,
keep moving.

Gay son abandoned
in new Picoult novel
Luke Warren never really wanted fame.
As a biologist, he never thought
hed write a book or become a TV star.
Reticent, almost hermit-like, what Luke
really wanted was for his research to
help people understand that real wolves
arent like the ones in fairy tales. Wolves
have their own culture, an explicit way of
communicating and family is everything.
Theyre also more afraid of humans than
humans are of them.
Luke knew that because he lived for
two years in the Canadian wilderness with
a pack of wolves, as we learn in Lone
Wolf, a new novel by Jodi Picoult.
Lukes son Edward remembered those
years without a father; how his mother,
Georgie, cried and how his little sister,
Cara, missed her daddy. Edward was 15
then and Luke had burdened him with
a man-of-the-house talk before he left,
handing Edward the nancial reins and
making him sign a scrap of paper which
gave the boy medical power of attorney.
Wanting neither, Edward did his best.
But shortly after his father returned from
Canada, shortly after he told his mother
he was gay, Edward left home, angry,
vowing never to return.
Cara Warren barely remembered Lukes
absence, but it didnt matter anymore.
After her parents divorced, Cara lived
with her mother but favored her father.
Everything she knew, she learned from
him. Compassionate, smart, wise and
patient, he adored her and he adored his
wolves.
But that was before the accident. Before
doctors said that Luke would never regain
consciousness, before Georgie called
Edward home. Before Edward decided it
was time to let his father go peacefully.
Filled with well-rounded characters
you come to feel as though you know
personally, Lone Wolf is comfortingly
typical of author Jodi Picoults other works.
Each person is allowed to tell his or her
own story though some in unexpected
ways and theres a pivotal issue around
which they all revolve and a tantalizing,
hidden hook you know is there but hate
to see.
Its a fast-moving, satisfying read sure to
satisfy Picoults legion of fans.

American Civil Liberties Union.
The civil liberties group was looking
for couples to join a lawsuit to be led in
Baltimore with the cooperation of Equality
Maryland. The groups would charge that a
state law denying same-sex couples the right
to marry violated the Maryland Constitution.
Joining the case could mean helping
pave the way for their family and similar
families to enjoy the nancial and
emotional benets of legal marriage. But
it could also mean harassment.
I had a great many worries about how
this would impact my children, Deane
says. When we had time to talk to the
lawyer ACLU my rst question was, Is
anybody going to send us hate mail or put
up signs on our front yard?
Farther south in Riverdale, Md.,
Mikkole Mozelle was also apprehensive
when her then partner Lisa Kebreau
mentioned getting involved in the case
shed heard about through an email
but for different reasons.
I guess I always thought something
like this was extraordinary people ghting
extraordinary struggles and we were just
your everyday, average couple. It caught
me off guard, but in a good way, says
Mozelle, a black woman who eventually
embraced the idea of changing the largely
white face of the gay marriage push.
The planned lawsuit would be one in a string
led by the ACLU, its partners and afliates on
behalf of same-sex couples seeking marriage
equality in New York, Oregon, California and
the state of Washington.
ACLU attorneys would eventually le
suit in state court in Baltimore in July 2004
on behalf of nine couples and a widowed
man. Among them were Kebreau and
Mozelle, Polyak and Deane.
It would never have been my choice
to be public about my life, Deane says.
(But) we had to do it because we had
children and we have a responsibility to
our children to make sure were able to
take care of them.
A matter of families and nance
From the beginning, the plaintiffs have
argued the marriage question had less
to do with certicates and ceremonies
and more to do with tax breaks, health
insurance and the other practical benets
that rise in importance as families grow
and couples mature.
Dave Kolesar was just 18 years old when
an infection led to brain surgery and a dim
prognosis. Now 34, hes in great condition,
but worries along with his partner Patrick
Wojahn about after effects.
They joined the case a year after
Wojahn had proposed to Kolesar.
In case something else were to
happen to him, we wanted to be assured
that I would be able to take care of him,
Wojahn says.
For plaintiff John Lestitian, that what
if scenario became a reality in 2003,
when his partner of more than a decade
died suddenly. A subsequent battle over
the home they shared and his nal resting
place encouraged him to join the suit.
Id gone through a situation of a
contested will and dealing with the
aftermath of the death, he says. My
personal experience made me all the
more willing to step forward.
Yet for other plaintiffs, the choice to
make their private lives personal stemmed
in part from nancial concerns. For instance,
Charles Blackburn is blocked from sharing
his partners federal health benets, which
he estimates could save the couple several
thousand dollars each year.
Polyak and Deane estimate theyve
spent tens of thousands of dollars yearly on
separate health insurance policies and the
adoptions of each others biological children.
Despite the money spent, the couples
remain nancially at risk.
Weve done as much as we can
through wills and legal things, Deane
says. But we can only cover about eight
of the 1,000 benets that come with
marriage on our own.
Reaching the victory lap
On March 1, Patrick Wojahn and
Dave Kolesar joined dozens of same-sex
couples, gay lawmakers and advocates
who stood behind OMalley as he signed
the historic bill in Annapolis.
It was just electrifying, Wojahn says.
There was so much excitement in the air.
The bill-signing ceremony came just
one week after the Maryland Senate voted
25 to 22 to approve the measure, and
nearly ve years after the Maryland Court
of Appeals voted 4 to 3 to uphold state
law barring same-sex marriage, ending
the ACLUs suit.
The ACLU and Equality Maryland
immediately took the push to the General
Assembly, and the plaintiffs largely went
back to their normal lives.
Wojahn and Kolesar married in D.C last
year, as did Polyak and Deane, who said
they tired of waiting on legislators.
Lestitian found a new love and also
married in D.C. in 2010, while Mozelle and
partner Kebreau split in early 2009.
Still, Mozelle says she believes her
partner is as pleasantly surprised as she is
that the legislation went through.
I feared that it wouldnt, she says,
but I prayed that it would.
Some of the couples, like Wojahn and
Kolesar, plan to re-marry in Maryland to
ensure all of their rights.
For Blackburn and Dehn, both in their
70s, the ceremony they hope to have if the
law holds would be their rst.
But marriage or not, after 33 years, they
know where they stand.
I moved in a month after we met,
Blackburn says. We just knew we had
found something special in each other
and it remained that way.

Everybodys eyes weaken
as they age but adjusting
the bulbs and lamps in your
home can do wonders

Everyone experiences changes
in their eyesight as they age. For
many, it means buying reading
glasses to read a menu, newspaper
or other small print. According to
the American Lighting Association
(ALA), changing the lighting in
your surroundings can go a long
way to enhance reading ability and
increase comfort.
Often, the rst thing people
notice as they get older is their loss
of ability to see distance, says Terry
McGowan, director of engineering
and technology for ALA and owner
of Lighting Ideas in Cleveland. That
happens around age 45, and is
called presbyopia. By 60, most people
have a xed focus optical system and
need glasses. After age 60, eye
and visual system changes accelerate,
so that less light reaches the eye.
Therefore people need more light to
see details as they age.
Basically, the follow changes
are occurring: reduced visual
acuity (ability to see small details)
reduced contrast sensitivity (harder
to see differences between light and
dark objects and surfaces) reduced
color discrimination longer time
required to adapt to large and
sudden differences in brightness
increased sensitivity to glare.
Paul Eusterbrock, president of
Holktter International, a lighting
manufacturer that has championed
lighting developments and products
to help aging eyes, agrees. The
main issue is the quality of light,
he says. Research shows that a 60
year old needs twice as much light
as a 30 year old.
Eye fatigue during the day is
another side effect. Because the eye
loses the ability to accommodate,
the muscles of the eye have to work
harder, McGowan says. Eyes get
tired faster, especially when doing
difcult seeing tasks such as driving
at night or reading ne print.
The solution is to make seeing
easier. This means not only reading
large-print books, but also reducing
glare, setting up special lighting for
task areas and having regular eye
exams (including retinal) to catch
problems promptly.

According to McGowan, having
a few table lamps turned on while
watching TV can help reduce the
contrast that occurs between the
bright screen and the surrounding
darkness of the room.
Is there a magic light bulb that
will work for everyone? McGowan
and Eusterbrock say no. This
may sound strange, but the perfect
bulb is whichever one the user nds
works best for them, McGowan
says. Individual vision varies so much
especially as people age that its
difcult to develop lighting recipes that
are one-size-ts-all, he says.
It is indeed a matter of preference,
agrees Eusterbrock. There are
uorescents, halogens and even
light-emitting diode (LED) bulbs
bright enough for reading tasks, he
says. Whats most important is to
have light that you can direct, such
as a pivoting or adjustable head on
a task lamp. Designs with a reector
(inside the head) are even more
effective for focusing the light where
you need it, Eusterbrock says.
As a lighting designer, my advice
to older homeowners is to provide for
light level adjustments (via dimmers)
so they can match the lighting levels
to the tasks at hand, McGowan
says. Look for general lighting
xtures (such as downlights) that are
well shielded to minimize glare.
Dimmers are ideal in the
bathroom to add a bit illumination
to navigate during the night and
to make it easier to get up on dark
mornings without blinding glare.
A dimmed incandescent bulb does
not emit blue wavelengths of light
that can upset circadian rhythms,
which is another healthy lighting
consideration, McGowan says.
McGowan and Eusterbrock
advise layering the lighting in a room
so that functional illumination and
decorative lighting can be mixed to
achieve balance.
I think the most important element
is to have a lot of exibility with your
lighting, McGowan says. Each
room should have lighting choices
with controls to vary the light. The
objective is to give the user no
matter what their age the optimum
amount of lighting when and where
they want it, McGowan says.
If energy savings is a concern,
McGowan recommends selecting
compact uorescent lights (CFLs) and
LED bulbs with warm tones (look for
2700-3000K on the box) and a high
color-rendering index of 90 or more.

up steam

Shaw is the next great frontier for pio-
neering members of the LGBT commu-
nity looking for a great deal and lower
cost per square foot than its neighbor
to the west Dupont Circle, the current
epicenter of LGBT homeowners.
As housing prices climb in Dupont,
Shaws central location, access to sev-
eral Metro lines including Mt. Vernon,
U Street and Shaw/Howard University,
combined with its beautiful Victorian row
homes and affordable condo market has
made Shaw an obvious option to many of
todays LGBT homebuyers.
Shaw is difcult to dene as the bor-
ders are disputed and sections are taken
by neighborhoods wanting to delineate
themselves from the larger area dened as
historical Shaw. The lines are blurred as to
what areas are Convention Center, Logan
Circle and Truxton Circle and can at times
be referred to as Shaw. It can be a source
of controversy as to what exactly Shaw is.
If you look on a map, Shaw is east
of Dupont and south of Adams Mor-
gan. Technically speaking, the N.W.
borders of Shaw include M Street to the
south, New Jersey Avenue to the east,
Florida Avenue to the north, and 11th
Street to the west, though most real es-
tate professionals differ on whether Shaw
ends at 11th or 13th. Its home to Howard
University and Howard University Hos-
pital and the vibrant U Street corridor,
which houses such D.C. institutions as
Bens Chili Bowl and the Lincoln Theater.
Borderstan, the online news site that
covers Dupont, Logan and U Street, polled
its readers last year and asked, Where is
the D.C. Gay neighborhood? Only 14
percent picked Shaw/U Street in that poll
however, that tied Dupont, which also re-
ceived 14 percent of the vote. Logan Cir-
cle had more votes than those two neigh-
borhoods combined at 34 percent. The
14 percent was a climb from 8 percent the
year prior in 2010.
As more gays and lesbians look to ex-
pand their families, that expansion some-
times means a larger house. Some are not
interested in moving to the suburbs and
look to areas like Shaw, Bloomingdale and
LeDroit Park where you can still get a row
home for under $1 million. With an average
cost per square foot in Shaw at around $490
in February, as compared to Duponts $524
as reported by Trulia, LGBT families and
the LGBT community in general, have been
making the migration east.
LGBT businesses have followed or at
times, pioneered the migration to Shaw.
Urban Turf, a popular real estate web-
site, recently named 9th Street, which
is the main street of Shaw, the next
it neighborhood along with the ranks
of 14th Street, NoMa, and H Street NE.
Ninth Street has already attracted many
LGBT businesses with varied levels of
success. The Long View Gallery at 1234
9th St., and its owner Drew Portereld
have been Shaw residents since 2006.
When asked, Portereld said, Some peo-
ple thought we were crazy to open Long
View Gallery on 9th Street but our belief
in the neighborhood inspired us to stay
Cornerstone developments like the new
Convention Center Marriott as well as the
O Street Market are moving along, and
there is renewed excitement in Shaw.
Go to U Street on any night of the week
and you will likely encounter a cross-sec-
tion of D.C.s residents. Nellies Sports Bar
at 900 U St. N.W., and Town Dancebou-
tique at 2009 8th St. N.W. both opened
in 2007 and have become mainstays in
D.C.s gay nightlife. Conversely, BeBar/
EFN/Motley Bar, at 1318 9th St., which
opened in 2006, saw an abrupt closing
in August 2010, citing, among other rea-
sons, the location, as a reason for its poor
attendance and lack of sales. However,
as the other U Street establishments of
continue to see growth and success, the
Shaw neighborhood will continue to offer
an alternative to Duponts active R Street.
D.C.s economy is growing as people
participate in homeownership in the Dis-
trict. There are various rst time home-
owner credits offered through the District
and most lenders have programs geared
toward rst time homebuyers as well. Ad-
ditionally, if you are interested in purchas-
ing a xer-upper there are loan pro-
grams for that as well called 203k loans.
All of these options should be discuss with
your lender and real estate professional.
