Wax/Tape sealed tenders for and on behalf of BSNL Sangrur are invited from the experienced contractors for provision of scroll advertisement of BSNL products on Cable TV for advertisement purpose in Sangrur SSA, as per details given below :S.N 1 Coverage area. Estd. Cost Rs 3 Lacs E/Money Rs 7,500/Security 10% of the total accepted tender value.

Tender should be submitted in the following manner :-

Envelop-A (Technical Bid) should contain two sets of envelops (wax/tape sealed) each marked ORIGINAL and COPY consisting of following documents.

i) Required Amount of Earnest Money in the shape of Demand Draft issued by any scheduled bank, in favour of Accounts Officer (CA), BSNL, O/o GMT/D Sangrur payable at Sangrur. ii) Demand draft (original) for Rs. 500/- (Rs. Five hundred only) nonrefundable in favour of Accounts Officer (CA), BSNL, O/o GMT/D Sangrur (in case of tender form document has been downloaded from the website). iii) Attested copy of PAN Card of the firm. vi) Letter of authorization, if required as per Annexure-C v) Affidavit regarding non-relative in BSNL Sangrur as per Annexure-B. vi) Attested copy of valid Service Tax number. vii) Attested copy of partnership deed or proprietorship deed or article/Memorandum of Association. viii) Latest Annual Audited Account in form C-6 i.e. for the financial year 200607. (This condition is not valid for Partnership/Proprietor firms). ix) Each page of bid document duly signed & dated by authorized signatory.

Financial bid of only those tenderers will be opened whose technical bid is found in order. In case of any dispute, the decision of GMT/D Sangrur will be final & binding.
2. 3. Duration of Contract : One year from the date of award of contract with an option of extension for a further period of one year on the same rates, terms & conditions. Mode of payment : The tender document can be purchased @ Rs 500/- non-refundable (each Section) upto 13-00 Hrs on or before 11-11-2008 in cash or DD drawn in favour of Accounts Officer (CA), BSNL O/o GMTD Sangrur, payable at Sangrur. The complete & detailed tender form is also available on our website i.e. www.punjab.bsnl.co.in. The firm can download the tender form from website. In this case a demand draft of Rs. 500/- (Rupees five hundred only) non-refundable in favour of Accounts Officer (CA) BSNL, O/o GMT/D Sangrur payable at Sangrur issued on or before the date of sale of tender form, must be enclosed while submission of tender bid. Earnest Money is to be paid in the form of Crossed Demand Draft issued by a scheduled bank, drawn in favour of Accounts Officer (CA), BSNL, O/o GMT/D Sangrur payable at Sangrur. The evaluation of bids shall be done on package basis irrespective of the item-wise rates.

The tender, which is not accompanied by the requisite documents, shall be summarily rejected. Tender will not be received after expiry of date and time. GMTD Sangrur reserves the right to reject any or all the tenders without assigning any reason. If it happens to be a holiday on any of the dates above, next working day shall be applicable.

Tender should be in a wax sealed cover & superscribed Tender for provision of scroll advertisement of BSNL products on Cable TV for advertisement purpose in r/o Sangrur SSA. The sealed tender should be addressed to Divisional Engineer (Sales), O/o GMTD, Sangrur & should be dropped in tender box either in person in his office or sent by registered post so as to reach his office latest by 1100 hrs of 12-11-2008. Financial bid of only those tenderers will be opened whose technical bid is found in order. In case of any dispute, the decision of GMT/D Sangrur will be final & binding. 3. Tenders will be opened at 11-30 hrs on dated 12-11-2008 O/o Divisional Engineer (Sales), O/o GMTD Sangrur in the presence of such contractors or their representatives who intend to be present at their own cost. No tender will be entertained after the time limit fixed. (i) Rates should be quoted in figures as well as in words and should be genuine & reasonable. The tenderer quoting unrealistic rates will likely to be debarred for issuance of the tender form in future. Rates should include all types of taxes except Service Tax. Service Tax will be paid extra as applicable. (ii) The evaluation of bids shall be done on package basis irrespective of item-wise rate. There should be no over writing/correction in rates. Corrections if any, must be initialed. Conditional & incomplete tenders are also liable for rejection. The accepted rates will be operative for one year from the date of agreement. The General Manager Telecom (D), Sangrur may extend or reduce the period further upto one year if necessary as per administrative convenience. The quantities of stations may vary drastically. (I) The successful tenderer will have to deposit a security by Bank Draft/FDR & he /they will have to execute a agreement with the BSNL regarding terms and conditions of the tender within seven days of the written intimation of acceptance of tender. (ii) A security of an amount equal to the 10% of the total accepted value will be deposited by the successful tenderer, 5% of which will be required to be deposited in the shape of FDR pledged to AO (CA) BSNL, O/o GMTD Sangrur and remaining 5% by deducting from contractors running bills @ 10% of each bill till the realization of total Security. 8. If any tenderer withdraws before the final acceptance of the tender or if any tenderer fails to deposit the security as prescribed within the stipulated period the earnest money of the tenderer is liable to be forfeited. General Manager Telecom District Sangrur reserves the right to reject, accept any or all tenders without assigning any reason thereof and may or may not accept the lowest or any of the tender. The General Manager Telecom District Sangrur reserves the right to accept any tender in part/ parts.

Earnest money will be refunded to the tenderers in due course in accordance with the rules of the BSNL for which stamped pre-receipt may be enclosed with the tender offer. The BSNL will not be liable to pay any interest on the earnest money or the security deposit which remains in its custody. Income TAX/Sales TAX/Surcharge, as applicable will be deducted on the gross amount payable for the work done. Service tax will be paid extra as applicable. The BSNL Sangrur also reserves the right to forfeit the EMD & the security deposit if after the acceptance to tender, the successful contractor, fails to comply with any of the terms & conditions set out therein or any contract or agreement which may be drawn up as a consequence of the acceptance of the tender. In such cases the right to cancel the tender/contract is also retained by the department and the decision of the GMT (D) Sangrur (including forfeiture of the earnest money/Security deposit) will be final. If there is any dispute in the interpretation of any clause/Clauses in the terms of the contract or in case of any other dispute, the matter will be referred to the sole arbitrator i.e. Chief General Manager Telecom Punjab Circle Chandigarh or any other person nominated by him whose decision will be final. If the contractor refuses to accept the work order for any specified work or fails to give the specified output, the BSNL reserves the right to get the work done by other Agency/ Contractor even at higher rates and the difference of the cost will be deducted from the contractors pending bills or the security as the case may be. The contractor shall receive all letters addressed to him by the General Manager Telecom District Sangrur or DEs/SDOs/SDEs either personally or through his authorised agents failing which the letters will be posted to him. The BSNL will not be responsible for non-receipt of letters and contents of such letters shall be binding on the contractor as if these letters have been received by him on the date of posting. The work will be done as per directions/specification given by the DEs/SDOT concerned. The contractor will be responsible and liable to make good any losses which may be caused to the BSNL due to the negligence of the contractor. I) The contractor shall submit his running Bills duly verified by the DET/SDOT/SDE (G) concerned after completing a work order to the GMTD office Sangrur where the Bills will be processed to make payment.

The contractor will pay the Service Tax to Service Tax Deptt. & paid-up slip will be submitted to this office within fifteen days from date of receipt of payment at sr. no. 19 (I), failing which no bill will be processed by this office. Job description The tenderer should familiarize himself fully with the job/work before quoting the rates. a) The work order will be issued by the Advertisement section or any person authorized to do so. b) The Advertisement scroll of BSNL products will be on two channels namely SMS Channels (Music) & Movie Channel. The advertisement/message should appear approximately 50 times a day on each channel. c) There will be no excuse what so ever for making modification in the existing scheme Advertisement/Message for adding new Add/Message at any time whenever required without any limit of numbers. d) Cable TV operator will cover all the surrounding villages if not covered on the date of start, given in the list (Annexure-D) on the date of start or within fifteen days from the date of issue of work order, failing which penalty will be imposed as laid under clause-25. e) Any change/addition in matter required, will be effected on urgent basis without any extra cost. f) The area of the advertisement should cover 152 cities/villages, as per Annexure-D Mode of execution of the contract and coordination by BSNL officers. The work of advertisement will be supervised by the departmental official duly nominated for work, who may be consulted in case of minor variations/change etc. but in case of a major approval must be obtained from DE (Sales) duly nominated for the purpose.

The contractor will submit to the office of GMTD Sangrur his books of accounts and all concerned papers maintained by him in this connection within 15 days from day of his being called upon to do so. The GMTD Sangrur reserves the right to suspend any schedule item/items, clause of agreement, temporarily or permanently as per administrative convenience and in the interest of BSNL. The jurisdiction of the civil court shall be at the H. Q. of the GMTD Sangrur. Minimum work output & Penalty Clause An output as mutually agreed and strictly mentioned in the work order will have to be given by the contractor. (Date of start & date of completion shall be given while issuing work order).

Penal Clause : A penalty at the following rate will be imposed on total estimated cost of work order for the deviation from the prescribed job description as per clause no. 20 of tender document as well as work order. For 1st week delay = 1% penalty For 2nd to 3rd week delay = 2% penalty th th For 4 to 6 week delay = 5% penalty The penalty will be recovered from bills/Security. However in case of any dispute in imposing the penalty, the decision of the GMT/D Sangrur, in this regard shall be final and binding. (ii). If the contractor refuses to accept the work order for any specified work or fails to give the specified output as per clause-24, the BSNL reserves the right to get the work done by other Agency/ Contractor even at higher rates & the difference of the cost will be deducted from the contractors pending bills or the security as the case may be in addition to penalty as per clause-25 (i) above. The BSNL reserves the right to carry out the work in part or in full departmentally or through any other contractor/ agency. The BSNL also reserves the right to appoint one or more contractors for this job. The BSNL does not bind itself to accept the lowest or any tender or to assign any reason for non-acceptance of any tender, as the authority to accept any tender rests with the GMTD. The BSNL will not be liable to pay any interest on the earnest money or on the security deposit which remains under its custody. BSNL also reserves also the right to forfeit the earnest and the security pledged to the Govt. of India if the tenderer after acceptance, fails to comply with any of the terms and conditions set out above or in any other contract or agreement which may be drawn up as a consequence of acceptance of tender. In such circumstance the right of cancellation of the tender/ contract is also retained by the GMTD Sangrur. The security deposit will be refunded to the contractor after obtaining NOC and subject to the condition that there is no labour complaint pending with the BSNL, after the successful completion of the work and expiry of contract period, if no amount is due to be paid by the contractor to the department. 27. 28. 29 30. Next working day shall be applicable in case there happens to be a holiday on last date for issue of tender forms or on the date of opening tenders. Tendency to influence by any means for the acceptance of the tender will render the tender liable to exclusion from consideration. The contractor would comply with all the provisions of various labour acts enacted from time to time. The contractor or any or his labourer will not claim for regular employment in BSNL because of their working with the contractor for BSNL works. The BSNL will not be responsible to absorb him/them in any regular/Temporary service.

The actual quantities of various items of work/purchase may vary based on actual requirement but generally being limited to +25% of the indicated quantity GMT Sangrur also reserves the right to divert any contractor any where through out the SSA where found necessary at existing approved rates. No extra payment will be made. ARBITERATION If there is any dispute in the interpretation of any clause/Clauses in the terms of the contract or in case of any other dispute, the matter will be referred to the sole arbitrator i.e. Chief General Manager Telecom Punjab Circle Chandigarh or any other person nominated by him whose decision will be final and binding. FORCE MAJURE In unavoidable circumstances like war, civil commotion, fires, floods, strikes or lockouts. Either party can intimate within 21 days of occurrence and up to 7 days an option to terminate the contract.

Participation of near relatives of the BSNL Employees in the Tender/Execution of works in BSNL units. The near relatives of any BSNL Employee either directly recruited or on deputation are prohibited from participation in tenders and execution of works in the different units of BSNL. i. The near relatives for this purpose are defined as. a) Members of a Hindu undivided family. b) They are husband and wife. c) The one is related to the other in the manners as father, mother, son(s) & sons wife (daughter in law),Daughter(s) & daughters husband (son in law), brother(s) & brothers wife, sister(s) & sisters husband (brother in law). ii. The company or firm or any other person is not permitted to tender for works in BSNL Unit in which his near relative(s) is/are posted. The Unit is defined as SSA/Circle/Chief Engineer/Chief Archt/Corporate Office for non-executive employees and all SSA in a Circle including Circle Office/Chief Eng./Chief Archt/Corporate office for executive employees (including those called as Gazetted Officers at present). The tenderer should give a certificate that none of his/her such near relative is working in the units as defined above where he is going to apply for tender/work. In case of proprietorship firm certificate will be given by the proprietor, for partnership firm certificate will be given by all the partners and in case of limited company by all the Directors of company. Any breach of these conditions by the company or firm or any other person, the tender/work will be cancelled and earnest money/Security deposit will be forfeited at any stage whenever it is so noticed. The department will not pay any damages to the company or firm or the concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit.
