Court on April 17, 2012, Defendant Eric H. Holder Jr. respectfully moves for an order compelling the production of documents that the State of Texas has improperly withheld from discovery. For the reasons set out in the Attorney Generals Memorandum of Points and Authorities (Ex. 1), the State has misapplied three categories of privilege in response to the Attorney Generals First Set of Requests for Production of Documents (Mar. 20, 2012) (Ex. 2). First, Texas has improperly asserted that the deliberative process privilege over documents in the possession, custody, or control of the Office of the Governor. See Office of the Governors Privilege Log (Apr. 14, 2012) (Ex. 3); see also Plaintiffs Objections and Responses to Defendants First Set of Requests for Production (Mar. 30, 2012) (Ex. 4). Second, the State has claimed that a state legislative privilege extends to communications between a legislator and a state agency, as well as to purely internal documents produced by a state agency after communications with a legislator. See Department of Public Safetys Privilege Log (Apr. 14, 2012) (Ex. 5); Office of the Secretary of State Privilege Log (Apr. 20, 2012) (Ex. 6). Third, the State of Texas has incorrectly asserted that the attorney-client privilege and legislative privilege extend to communications between the Texas Legislative Council (TLC) and state legislators, although the State has not yet produced a privilege log concerning documents in the possession of the TLC. See Plaintiffs Objections and Responses to Defendants First Set of Requests for Production, supra. The Attorney General therefore respectfully requests that the Court enter the attached Proposed Order Compelling the Production of Documents and Privilege Logs (Ex. 7).
