Condominium Lease

This Condominium Lease Agreement (this "Lease") is made effective as of February 29, 2012, by and between James Smith ("Landlord"), and Alex Green ("Tenant"). The parties agree as follows: PREMISES. Landlord, who is the registered owner of the residential condominium unit leases to Tenant, the property located at 13 D st, Big City California (the "Premises"), in consideration of the lease payments provided in this Lease. NOW THEREFORE THIS AGREEMENT WITNESSES that in consideration of the rents,covenants and agreements hereinafter reserved and contained on the part of the Tenant to be paid, observed and performed, the Landlord hereby leases unto the Tenant the Property for use and occupation as a single family residence including the chattels and appliances now on the Property, upon the following terms and conditions: TERM. The lease term will begin on March 09, 2012 and will terminate on March 09, 2014. RENEWAL. Tenant may renew this Lease for 18 months per renewal term. Tenant shall give notice of intent to renew not less than 25 days prior to the expiration of the lease or current renewal term. LEASE PAYMENTS. Tenant shall pay to Landlord monthly installments of $1,000.00 per month, payable in advance on the first day of each month, for a total lease payment of $24,000.00. Lease payments shall be made to Landlord at 35 Justice St, Big City, California 94901, which address may be changed from time to time by Landlord. In the event that the commencement date of this Tenancy occurs on a date other than the first day of a month, the rent shall be pro-rated until the first day of the immediately succeeding month. All terms of this Lease shall remain the same, except for the amount of the annual rent. The annual rent shall be in-creased by the aggregate increase in cost of the following items over the aggregate amount paid for the same items dur-ing the previous lease year: (a) real property taxes; (b) condominium association fees or dues; (c) recreational association fees or dues; and (d) homeowners' insurance premiums. CONDOMINIUM ASSOCIATION. Landlord shall pay all mandatory fees and dues to the condominium homeowners' association and to the condominium recreational association. Landlord reserves the right to vote at all meetings of the condominium homeowners' association and the condominium recreational association. SECURITY DEPOSIT. At the time of the signing of this Lease, Tenant shall pay to Landlord, in trust, a security deposit of $300.00 to be held and disbursed for Tenant damages to the Premises or other defaults under this Agreement (if any) as provided by law.

POSSESSION. Tenant shall be entitled to possession on the first day of the term of this Lease, and shall yield possession to Landlord on the last day of the term of this Lease, unless otherwise agreed by both parties in writing. At the expiration of the term, Tenant shall remove its goods and effects and peaceably yield up the Premises to Landlord in as good condition as when delivered to Tenant, ordinary wear and tear excepted. USE OF PREMISES. The Property shall be used as a single family residential dwelling to be occupied by the Tenant and for no other purpose. The Tenant acknowledges and agrees with the Landlord that, in accordance with the Declaration, neither s/he nor any member of his/her household shall keep, shelter or permit entry into the Property of any animal, livestock or fowl except for a single household pet as approved by the Landlord. CHATTELS AND PERSONAL PROPERTY WITHIN THE PREMISES. All chattels and personal property belonging to the Tenant and located or stored in or on the Property shall be kept and stored at the Tenants risk. The Landlord shall not be liable, except in the case of the Landlords direct negligence or willful misconduct, for any injury, damage or loss resulting from any accident or occurrence in or upon the unit and/or the common elements sustained by the Tenant or any person claiming through the Tenant. The Tenant covenants with the Landlord to keep the appliances and fixtures belonging tothe Landlord on the Property at the commencement date hereof in good and cleancondition, reasonable wear and tear, damage by fire or other casualty, excepted. PROPERTY INSURANCE. Landlord and Tenant shall each be responsible to maintain appropriate insurance for their respective interests in the Premises and property located on the Premises. MAINTENANCE AND REPAIR. Landlord shall keep the following in good repair: roof, exterior walls, foundation, sewer, plumbing, heating, wiring, air conditioning, driveways, and sidewalks, except when such repairs are necessitated by the misuse or negligence of Tenant, its agents, employees or invitees, and all other maintenance responsibilities required by law. Tenant shall maintain the premises in a reasonable safe, serviceable, clean and presentable condition, and except for the repairs and replacements to be made by Landlord pursuant to the preceding sentence, shall make all repairs, replacements and improvements to the premises, including all changes, alterations or additions ordered by any lawfully constituted government authority directly related to Tenant's use of the premises. Tenant shall (a) comply with all obligations primarily imposed upon tenants by applicable provisions of building and housing codes materially affecting health and safety, (b) keep that part of the premises that Tenant occupies and uses as clean and safe as the condition of the premises permit, (c) dispose from the dwelling unit all ashes, rubbish, garbage and other waste in a clean and safe manner, (d) keep all plumbing fixtures in the dwelling unit or used by Tenant as clean as their condition permits, (e) use in a reasonable manner all electrical, plumbing, sanitary, heating, ventilating, air-conditioning and other facilities and appliances, (f) not deliberately or negligently destroy, deface, damage, impair or remove a part of the premises, or knowingly permit a person to do so, and (g) conduct himself or herself in a manner that will not disturb a neighbor's peaceful enjoyment of the premises.

FURNISHINGS. The following furnishings will be provided by Landlord: table with chairs Tenant shall return all such items at the end of the lease term in a condition as good as existed at the beginning of the lease term, normal wear and tear excepted. DAMAGES. Any damages to the following items of property located in or on the premises will result in a charge to the Tenant as indicated herein: Item Living Room Counter Porch Charge $200.00 $100.00

RULES AND REGULATIONS. Tenant agrees to abide by all rules, regulations, and policies of the condominium homeowners' association and the condominium recreational association as applicable. Tenant must, at Tenant's expense, promptly comply with all laws, orders, rules, requests and directives of all governmental authorities, Landlord's insurers, and similar authorities and agencies. Landlord shall be responsible for any violations that may exist prior to transfer of possession of the leased premises to Tenant. Notices received by Tenant from any authority or entity must be promptly delivered to Landlord. Tenant may not do anything on the premises to increase the condominium homeowners' association's insurance premiums. If Tenant violates this provision and such violation results in an increase in the amount of such premiums, Tenant will be liable for the increase in premiums. ALTERATIONS. The Tenant will not remodel or make any structural changes, alterations,additions or decorations to the Property; will not paper, paint or decorate (provided the Tenant may repaint the Property as long as the Property is repainted to the same as the present color of the walls and ceilings within the Property at the time the Tenant returns position of the Property to Landlord ); nor install, attach, remove or exchange appliances or equipment, nor change the existing locks of the Property, without the prior consent of the Landlord. PETS. Tenant is permitted to have: no more than two cats, which must be spayed or neutered No additional pets shall be allowed without the prior written consent of Landlord. At the time of signing this Lease, Tenant shall pay to Landlord, in trust, a deposit of $50.00, to be held and disbursed for pet damages to the Premises (if any) as provided by law. This deposit is in addition to any other security deposit stated in this Lease. UTILITIES AND SERVICES. Landlord shall be responsible for all utilities and services in connection with the Premises. TAXES. Landlord shall pay all real estate taxes and assessments which may be levied against the Premises. Tenant shall be responsible for all personal taxes or assessments that result from the Tenant's use of the Premises. TERMINATION UPON SALE OF PREMISES. Notwithstanding any other provision of this Lease, Landlord may terminate this lease upon sixty (60) days` written notice to Tenant that the Premises have been sold.

TERMINATION CLAUSE. Tenant may, upon 60 days' written notice to Landlord, terminate this lease provided that the Tenant pays a termination charge equal to 2 months' rent or the maximum allowable by law, whichever is less. Termination will be effective as of the last day of the calendar month following the end of the 60 day notice period. Termination charge will be in addition to all rent due up to the termination day. MILITARY TERMINATION CLAUSE. In the event, the Tenant is, or hereafter becomes, a member of the United States Armed Forces on extended active duty and hereafter the Tenant receives permanent change of station orders to depart from the area where the Premises are located, or is relieved from active duty, retires or separates from the military, or is ordered into military housing, then in any of these events, the Tenant may terminate this lease upon giving thirty (30) days written notice to the Landlord. The Tenant shall also provide to the Landlord a copy of the official orders or a letter signed by the tenant's commanding officer, reflecting the change, which warrants termination under this clause. The Tenant will pay prorated rent for any days (he/she) occupy the dwelling past the first day of the month. Any security deposit will be promptly returned to the tenant, provided there are no damages to the premises. DESTRUCTION OR CONDEMNATION OF PREMISES. If the Premises are damaged or destroyed by fire or other casualty to the extent that enjoyment of the dwelling unit is substantially impaired, Landlord, in its sole discretion may elect to repair the Premises or terminate the Lease upon thirty (30) days' written notice to Tenant. If the Premises are condemned or cannot reasonably be repaired, this Lease will terminate upon twenty (20) days' written notice by either party. Tenant shall give Landlord immediate notice of any damage to the Premises. HABITABILITY. Tenant has inspected the Premises and fixtures (or has had the Premises inspected on behalf of the Tenant), and acknowledges that the Premises are in a reasonable and acceptable condition of habitability for their intended use, and the agreed lease payments are fair and reasonable. If the condition changes so that, in Tenant's opinion, the habitability and rental value of the Premises are adversely affected, Tenant shall promptly provide reasonable notice to Landlord. HOLDOVER. If Tenant maintains possession of the Premises for any period after the termination of this Lease ("Holdover Period"), Tenant shall pay to Landlord lease payment(s) during the Holdover Period at a rate equal to 150% of the most recent rate preceding the Holdover Period (or the maximum amount allowed by law if less). Such holdover shall constitute a month-to-month extension of this Lease. CUMULATIVE RIGHTS. The rights of the parties under this Lease are cumulative, and shall not be construed as exclusive unless otherwise required by law. NON-SUFFICIENT FUNDS. Tenant shall be charged $0.00 (or the maximum amount allowable under applicable law if less) for each check that is returned to Landlord for lack of sufficient funds. REMODELING OR STRUCTURAL IMPROVEMENTS. Tenant shall be allowed to

conduct any construction or remodeling (at Tenant's expense) only with the prior written consent of the Landlord. At the end of the lease term, Tenant shall be entitled to remove (or at the request of Landlord shall remove) such fixtures, and shall restore the Premises to substantially the same condition of the Premises at the commencement of this Lease. ACCESS BY LANDLORD TO PREMISES. After providing reasonable advance notice, or with Tenant's consent, Landlord shall have the right to enter the Premises to make inspections, provide necessary services, or show the unit to prospective buyers, mortgagees, tenants or workers. However, Landlord does not assume any liability for the care or supervision of the Premises. As provided by law, in the case of an emergency, Landlord may enter the Premises without Tenant's consent. During the last three months of this Lease, or any extension of this Lease, Landlord shall be allowed to display the usual "To Let" signs and show the Premises to prospective tenants. INDEMNITY REGARDING USE OF PREMISES. To the extent permitted by law, Tenant agrees to indemnify, hold harmless, and defend Landlord from and against any and all losses, claims, liabilities and expenses, including reasonable attorney fees, if any, which Landlord may suffer or incur in connection with Tenant's possession, use or misuse of the Premises, except due to Landlord's negligent acts or omissions. DANGEROUS MATERIALS. Tenant shall not have or keep on the Premises any article or thing of a dangerous, flammable, or explosive character that might substantially increase the danger of fire on the Premises, or that might be considered hazardous by a responsible insurance company, unless the prior written consent of Landlord is obtained and proof of adequate insurance protection is provided by Tenant to Landlord. MECHANIC'S LIENS. Neither Tenant nor anyone claiming through Tenant shall have the right to file mechanic's liens or any other kind of lien on the Premises. Further, Tenant agrees to (i) give actual advance notice to any contractors, subcontractors or suppliers of goods, labor or services that such liens will not be valid, and (ii) take whatever additional steps that are necessary in order to keep the premises free from all liens resulting from construction done by or for the Tenant. SUBORDINATION OF LEASE. This Lease is subordinate to any mortgage that now exists, or may be given later by Landlord, with respect to the Premises. ASSIGNABILITY/SUBLETTING. Tenant may not assign or sublease any interest in the Premises, nor assign, mortgage or pledge this Lease, without the prior written consent of Landlord. QUIET ENJOYMENT. The Landlord agrees that if the Tenant pays the rent and complies with all of the other terms and conditions of this Lease Agreement, then the Tenant may peaceably and quietly have, hold and enjoy the premises leased hereunder for the term of this Lease Agreement. SURRENDER OF THE UNIT. The Tenant will, upon termination of this Agreement (including any extension or renewal thereof) surrender the Property and all fixtures and appliances hereinbefore described in good, clean and operating condition, and in the same condition as when received, reasonable wear and tear excepted. Property, clean the Property, including without limitation the stove, refrigerator and dishwasher, and remove all trash from the Property. Upon vacating the Property, the Tenant shall deliver all keys to the Property, to the entrance to the building, all mail keys and parking cards to the Landlord within twenty-four (24) hours after vacating. NOTICE. All notices shall be given to the parties, in the case of Tenant, to the address of the premises, and in the case of Landlord, to the place at which rent is then being paid. Without prejudice to any other method of notifying a party in writing or making a demand or other communication, such notice shall be considered received on the third day after it is deposited in the U.S. Mail, registered or certified, properly addressed, return receipt requested, and postage prepaid. This Lease shall be construed in accordance with the laws of the State of California. ENTIRE AGREEMENT/AMENDMENT. This Lease contains the entire agreement of the parties and there are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Lease. This Lease may be modified or amended in writing, if the writing is signed by the party obligated under the amendment. SEVERABILITY. If any portion of this Lease shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Lease is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. WAIVER. The failure of either party to enforce any provisions of this Lease shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Lease. BINDING EFFECT. The provisions of this Lease shall be binding upon and inure to the benefit of both parties and their respective legal representatives, successors and assigns.
