MOTION TO INTERVENE, FOR SANCTIONS, AND DISMISSAL
Now comes Brett Kimberlin and moves this Court to allow him to file this Motion
based on the fact that Mr. Walker has used this Peace Order to harass Plaintiff and in
retaliation for Plaintiff filing a Peace Order, Kimberlin v Walker.
1. Mr. Walker filed a Peace Order against Neal Rauhauser on January 30,2012 by
falsely telling the Court that Mr. Rauhauser committed acts in Montgomery
County Maryland. In fact, Mr. Walker has no personal knowledge that Mr.
Rauhauser did anything in Montgomery County or even lives in Montgomery
County.
2. On the Peace Order, Mr. WaJker does not list any address in Montgomery
County for Mr. Rauhauser. However, in a civil suit against Mr. Rauhauser filed
on the same day in Price William County Virginia civil court, Mr. Walker listed
Mr. Rauhauser's address as ' , RantouJ, JL 61866." See
Exhibit A. Clearly, Mr. Walker gave false testimony to the Court when he said
that Mr. Rauhauser committed the acts alleged in the Peace Order in
Montgomery County.
3. Moreover, Mr. Walker told Montgomery County Sheriffs that Neal Rauhauser
lived at Plaintiffs home, which caused three sheriffs to arrive at 7:00 pm on
February 2, 2012 to serve Mr. Rauhauser.
4. Mr. Rauhauser has never even visited Plaintiff at his home and certainly does
not reside there.
5. Clearly, Mr. Walker had no legal or factual basis on which to file a Peace Order
against Neal Rauhauser in Montgomery County. In fact. he only filed it in
Montgomery County in order to harass Plaintiff by sending the police to his
home in retaliation for Plaintiff filing his Peace Order. Clearly, this constitutes
abuse and warrants dismissal and sanctions against Mr. Walker.
WHEREFORE, for all the above reasons, Plaintiff moves this Court to dismiss
the Peace Order against Neal Rauhauser and impose sanctions against Mr.
Walker for filing a false, malicious and harassing Peace Order.
