If you have not already received a copy then it can be obtained from www.immi.gov.au You must have read the Life in Australia booklet before completing this application form. If you have difficulty, or are unable to read the booklet, you may have the content of it explained to you, for example, by a friend or relative. This form contains a statement, that you must sign, that confirms you understand and will respect the values of Australian society (as explained in the booklet) and will obey the laws of Australia. This includes acknowledging what would be required if you later applied for Australian citizenship. This statement must also be signed by each person aged 18 years or over, who is included in this form.

Integrity of application
The department is committed to maintaining the integrity of the visa and citizenship programs. If you, a member of your family unit included in your application or a third party acting on your behalf, provide (or have provided in a previous application) false or misleading information or bogus documents either knowingly or otherwise, your visa application will be refused and you will be subject to a 3 year bar in relation to visas to which the fraud criterion applies. Any visa granted may be cancelled.

Before filling in the form


Make sure you have all the required documents (see Supporting documents page 3). If your partner and dependants are included in this application, make sure you have all the documents relating to your partner and dependants ability to satisfy the requirements.

Deemed and fee-free visa applications


If you have made a valid visa application for a General Skilled Migration visa, which is yet to be decided, you may meet the requirements for a deemed or fee-free employer sponsored visa application. If you satisfy the requirements for a deemed visa application you do not need to complete a form 47ES or pay the initial Visa Application Charge. If you satisfy the requirements for a fee-free visa application, you will need to complete a form 47ES but do not have to pay the first instalment of the Visa Application Charge. How to fill in this form


Please use a pen and write neatly in English using BLOCK LETTERS. Please read the notes on each question. If a question is not applicable, write N/A. If you are not sure provide a brief comment on why you believe this to be the case. Any changes or corrections you make must be initialled and dated by each person who signs the form. If you use other sheets of paper for additional information for any questions, each sheet must also be signed and dated by all persons who sign the form. To avoid unnecessary delays, you could complete health checks (forms 26 and 160) if you are already in Australia and seek a penal clearance before you lodge your visa application. Applying on this form


This form is for people who are applying for: offshore skilled employer sponsored migration categories; or onshore skilled employer sponsored migration categories. See page 7, Question 3 Type of Application. Before completing this form, you should read the detailed requirements in booklet 5, Employer Sponsored Migration, available from the Department of Immigration and Citizenship (the department) website www.immi.gov.au/allforms/ or from any office of the department in Australia. Making a valid application


To make a valid application, you must undertake all of the following steps: complete this form hard copies are available at offices of the department or from the departments website www.immi.gov.au/allforms/ indicate the correct class of visa by selecting the type of application in Part A of the form Note: Some restrictions may apply to the visa class you can apply for if you have already lodged an application for a General Skilled Migration visa and you are seeking to make a deemed or fee-free application for the ENS, RSMS or LA); tell the department where you intend to live while your application is being processed; pay any applicable charge; and send your application to the same Centre of Excellence where your employers nomination is being processed details are available on the website www.immi.gov.au/contact/centres-of-excellence/ You must also: attach any documentation you are required to provide with your application; answer all questions truthfully; and provide supporting documents if requested by the department. Note: Providing incorrect information or documents can affect the success of your application, or may result in your visa being cancelled after it is granted.

Labour Agreement (LA), Invest Australia Supported Skills (IASS) agreement


You must meet the skill and qualification requirements set out in the agreement between your employer and the department under which you have been nominated. Your employer can tell you what the specific requirements of their agreement are.

Other requirements
You must also satisfy the following requirements for all visas: hold, or be eligible to hold, any license, registration or professional membership that is necessary to work in the occupation; be less than 45 years old, unless exceptional circumstances apply; have the appropriate English language skills for the visa, unless exceptional circumstances apply (exceptional circumstances can only be sought for the ENS and RSMS); and provide a formal contract from your employer covering the position for which you have been nominated.

Exceptional circumstances
Booklet 5, Employer Sponsored Migration, provides guidelines on the information you should provide if you are seeking to satisfy the skill, work experience, age or English language requirement on the basis of exceptional circumstances.

Who the form covers


Your application may cover a family unit, namely a main applicant, partner and other dependants. A partner and any dependants will need to satisfy health and character requirements before your application can be approved. You will only need to pay the first instalment of the Visa Application Charge once, if members of your family unit are included in your application when you lodge your application. There may, however, be some circumstances where family members cannot be included with your application because they are not in the same location. You will still need to declare them as non-migrating family members. For example, you may have applied for on onshore visa (subclass 855, 856 or 857), which requires all applicants to be in Australia when lodging the application, and the family members are outside Australia. In these cases, these family members may be included with your application once they arrive in Australia, provided the department has not yet made a decision on your application. The following requirements apply: 2 partner and any dependent children can be added to your application when you advise the department in writing. They do not have to complete a separate form and there are no additional application fees; and other family members can only be included with your application if they complete a separate form 47ES and pay the first instalment of the Visa Application Charge. Note: You should contact the department to discuss your particular circumstances before you lodge an application. Skill and qualification requirements


Each class of visa covered by this form has specific skill and qualification requirements which you must satisfy to be granted a visa.

Employer Nomination Scheme (ENS)


Unless you are eligible to make a fee-free visa application, you must satisfy one of the following: provide a satisfactory skills assessment from an Australian assessing authority relevant to the occupation for which you have been nominated and, unless exceptional circumstances apply, have at least 3 years post-qualification full-time work experience relevant to the occupation; or have been working in Australia in the occupation for which you are being nominated, as the holder of an eligible temporary visa, for at least the 2 years immediately prior to lodging this visa application, including at least the last year working for your nominating employer (onshore only); or be nominated for a position which attracts a base annual salary of at least the level specified by legislative instrument for highly paid executive positions. Note: Any skills assessment from a relevant Australian assessing authority must be provided when your application is lodged with the department.

Regional Sponsored Migration Scheme (RSMS)


You must have an Australian qualification that relates to the skill level of the nominated position, unless exceptional circumstances apply.

Partner means your spouse or de facto partner (including same-sex partners).

Dependent children
A dependent child may be your natural child, adopted child or step-child. A child of any age is not considered dependent if he or she is married, in a de facto or common law relationship, or is engaged to be married. A child who is 18 years of age or over will only be considered to be dependent on you if they are wholly or substantially reliant on you for financial support for their basic needs of food, shelter and clothing. You must also show that you have provided financial support for a substantial period and that the child is more reliant on you than on any other person or source. A child who is engaged in full-time employment or is aged 25 or over, will generally not be considered dependent. Children of any age who have a total or partial loss of bodily or mental functions which stops them earning a living are regarded as dependent and part of the family unit (whether or not they migrate with you). You will need to provide details of these children and whether they are in your care or have other care arrangements. In all cases, you should attach evidence of your childs dependency on you.

Supporting documents
The documents you must provide are listed in Part J of your application. Enclose all documents with your application. You may be asked to provide other documents during processing. Certified copies of documents mean copies authorised or stamped as being true copies of originals by a person or agency recognised by the law of your country. In Australia, they must be certified by a Justice of the Peace or Commissioner for Declarations or by a person before whom a Statutory Declaration may be made. All documents not in English must be accompanied by a certified English translation of the original. You may be asked to provide the originals of your documents at a later stage. Do not provide originals unless you are asked.

Visa Application Charge


Fees may be subject to adjustment at any time. Visa Application Charges may be subject to adjustment on 1 July each year. This may increase the cost of a visa. To check the Visa Application Charge, see form 990i Charges available from the departments website www.immi.gov.au/allforms/pdf/990i.pdf or check with the nearest office of the department.

Other family members


You may include other relatives with your application if they are unmarried, widowed, divorced or separated, as well as wholly or substantially reliant on you for financial support for their basic needs of food, shelter and clothing. You must also show that you have provided financial support for a substantial period and that the relative is more reliant on you than on any other person or source. A relative with a total or partial loss of bodily or mental functions which stops them earning a living may be regarded as dependent on you. You will need to provide details of these relatives and whether they are in your care or have other care arrangements. Note: You will need to complete form 47A, Details of child or other dependent family member aged 18 years or over, for each dependant who is 18 years of age or over.

Method of payment
In Australia
To make a payment, please pay by credit card, debit card, bank cheque or money order made payable to the Department of Immigration and Citizenship. Debit card and credit card are the preferred methods of payment.

Immigration assistance
A person gives immigration assistance to you if he or she uses, or claims to use, his or her knowledge or experience in migration procedure to assist you with your visa application, request for ministerial intervention, cancellation review application, sponsorship or nomination. In Australia a person may only lawfully give immigration assistance if he or she is a registered migration agent or is exempt from being registered. Only registered migration agents may receive a fee or reward for providing immigration assistance. If an unregistered person in Australia, who is not exempt from registration, gives you immigration assistance they are committing a criminal offence and may be prosecuted.

Custody requirement
The department will seek to ensure that allowing a child to migrate is not in contravention of Australias international obligations in relation to the prevention of child abduction. If your application includes a child under 18 years and the childs other parent is not migrating with you or there is any other person who has the legal right to determine where the child can live, you will need to provide a Statutory Declaration from each of them giving permission for the child to migrate or a certified copy of a valid court order showing that you/your partner has the legal right to remove the child from the country.

Migration agents in Australia


Migration agents in Australia must be registered with the Office of the Migration Agents Registration Authority (Office of the MARA) unless they are exempt from registration.

Visa cancellation
Powers under the Migration Act provide for cancellation of an RSMS visa where the employee has not commenced employment with the employer within 6 months of arriving in Australia or 6 months after the visa is granted if in Australia. The Act also provides powers to cancel an RSMS visa if the employee leaves the position within 2 years of commencement of employment. Visa cancellation is not intended where the employee makes a genuine effort to complete the 2-year contract with the employer.

Migration agents outside Australia


Migration agents who operate outside Australia do not have to be registered. The department may give some overseas agents an ID number. This number does not mean that they are registered. Note: Some Australian registered migration agents operate overseas.

Migration agent information


A migration agent is someone who can: advise you on the visa that may best suit you; tell you the documents you need to submit with your application; help you fill in the application and submit it; and communicate with the department on your behalf. If you appoint a migration agent, the department will assume that your migration agent will be your authorised recipient, unless you indicate otherwise. Your migration agent will be the person with whom the department will discuss your application and from whom it will seek further information when required. You are not required to use a migration agent. However, if you use a migration agent, the department encourages you to use a registered migration agent. Registered agents are bound by the Migration Agents Code of Conduct, which requires them to act professionally in their clients lawful best interests. Information on migration agents, including a list of registered migration agents, is available on the Office of the MARA website www.mara.gov.au You can also access information about migration agents on the departments website www.immi.gov.au

Authorised recipient information


All written communication about your application will be sent to your authorised recipient, unless you indicate that you wish to have health and/or character information sent directly to you. The department will communicate with the most recently appointed authorised recipient as you may only appoint one authorised recipient at any time for a particular application. You will be taken to have received any documents sent to that person as if they had been sent to you. To appoint an authorised recipient you should complete: Part M Options for receiving written communications; and form 956A Appointment or withdrawal of an authorised recipient. Note: Migration agents/exempt persons do not need to complete form 956A. Form 956A is available from the departments website www.immi.gov.au/allforms/

Consent to communicate electronically


The department may use a range of means to communicate with you. However, electronic means such as fax or e-mail will only be used if you indicate your agreement to receiving communication in this way. To process your application the department may need to communicate with you about sensitive information, for example, health, police checks, financial viability and personal relationships. Electronic communications, unless adequately encrypted, are not secure and may be viewed by others or interfered with. If you agree to the department communicating with you by electronic means, the details you provide will only be used by the department for the purpose for which you have provided them, unless there is a legal obligation or necessity to use them for another purpose, or you have consented to use for another purpose. They will not be added to any mailing list. The Australian Government accepts no responsibility for the security or integrity of any information sent to the department over the internet or by other electronic means. If you authorise another person to receive documents on your behalf and they wish to be contacted electronically, their signature is required on form 956 or 956A to indicate their consent to this form of communication. Note: Electronic communication is the fastest means of communication available and the department prefers to communicate electronically because this results in faster processing.

Exempt persons
The following people do not have to be a registered migration agent in order to provide immigration assistance, but they must not charge a fee for their service: a close family member (spouse, de facto partner, child, parent, brother or sister); a member of parliament or their staff; an official whose duties include providing immigration assistance (eg. a Legal Aid provider); a member of a diplomatic mission, consular post or international organisation.

Appointing a migration agent/exempt person


To appoint a migration agent/exempt person you should complete Part M Options for receiving written communications. Your migration agent/exempt person should complete form 956 Advice by a migration agent/exempt person of providing immigration assistance. Form 956 is available from the departments website www.immi.gov.au/allforms/

Options for receiving written communications


If you do not appoint a migration agent/exempt person you may still authorise another person, in writing, to receive written communications on your behalf. This person is called the authorised recipient.

About the information you give


The department is authorised to collect information provided on this form under Part 2 of the Migration Act 1958 Control of Arrival and Presence of Non-Citizens. The information provided will be used for assessing your eligibility for a visa to migrate to Australia. The department may notify your nominating employer of the outcome of your visa application. The employer may also be notified of the status of your visa application where a decision has not yet been made. The information provided might also be disclosed to agencies who are authorised to receive information relating to adoption, border control, business skills, citizenship, education, health assessment, health insurance, health services, law enforcement, payment of pensions and benefits, taxation, review of decisions and registration of migration agents. Relevant information about you will be disclosed to federal, state and territory police to assist in your location and possible detention in the event that you become an unlawful non-citizen. You will become an unlawful non-citizen if your visa ceases (by cancellation for breach of visa condition for example) or expires and you do not hold another visa authorising you to remain in Australia. The collection, access, storage, use and disclosure by the department of the information you provide in this form is governed by the Privacy Act 1988 and, in particular, by the 11 Information Privacy Principles. The information form 993i Safeguarding your personal information, available from offices of the department, gives details of agencies to which your personal information might be disclosed. The information on this form, including any information on your health, will be used to assess your health for an Australian visa and may be disclosed to the relevant Commonwealth, state and territory health agencies and examining doctor(s). Form 1071i Health requirement for permanent entry to Australia provides additional information on Australias visa health requirements. Form 1071i is available at offices of the department or from the departments website www.immi.gov.au/allforms/ The department is authorised under the Migration Act 1958, in certain circumstances, to collect a range of personal identifiers including a facial image, fingerprints and a signature from noncitizens, including from visa applicants. The department requires personal identifiers to assist in assessing your identity. The department is authorised to disclose your personal identifiers and information relating to your name and other relevant biographical data to a number of agencies including law enforcement and health agencies and to other agencies who may need to check your identity with this department. Where the department obtains personal identifiers they will become part of your official record with the department.

The department is involved in international information exchanges with a number of countries, including the United Kingdom, the United States of America, Canada and New Zealand. These international information exchanges may involve the sharing of personal identifiers, including facial images and fingerprint data, collected by immigration agencies such as this department. If, as a result of this sharing between countries, there is a match with your personal identifiers, the department will disclose your biographical data, copies of travel and other identity documents or information from such documents, your immigration status and immigration history (which may include any immigration abuse and offences) and any criminal history information relevant to immigration purposes. The purpose of such disclosure would be to help confirm your identity and determine if you have presented to the department and the other agency under the same identity and with similar claims.
