FINDINGSONTUCSONUNIFIEDSCHOOLDISTRICTWITHREDARDSTOMEXICANAMERICAN STUDIESDEPARTMENT:DisparateTreatmentofMexicanAmericanLatina/oStudents; DiscriminatoryTreatmentofMexicanAmericanLatina/oStudents;DenialofEquitable EducationalOpportunitiesforMexicanAmericanLatina/oStudents;andViolationoftheEqual ProtectionforMexicanAmericanLatina/oStudents March7,2012 INTRODUCTION OnTuesday,January10,2012,theTUSDGoverningBoardpassedtheGoverningBoard ResolutiononMexicanAmericanStudiesthatterminatedMexicanAmericanStudies Department(MASD)highschool,middleschool,andelementaryschoolcourses.

Specifically, the24sectionsofMASDclassesthatwereterminatedatsixTUSDhighschoolswere: AmericanHistoryMexicanAmericanPerspectives1,2 AmericanGovernmentSocialJusticeEducationProject LatinoLiterature7,8 LatinoLiterature5,6 (SeelinkbelowforentireTUSDGoverningBoardResolutiononMexicanAmericanStudies: http://www.tusd1.org/contents/govboard/Documents/ResolutionMAS011012.pdf) AsaresultofTUSDsGoverningBoardResolutiononMexicanAmericanStudies,Mexican AmericanLatina/ostudentswithintheseclasseshavesuffered:irreparableharm; psychologicalandmentaldistress;acleardisparateanddiscriminatorytreatment;adenialof equitableeducationalopportunity;andaviolationoftheEqualProtectionoftheConstitution. ThetestimonialsofMexicanAmericanLatina/ostudentswhowereenrolledinMASDclasses andactionstakenagainstthembyTUSDofficials(locatedwithwebsitelinksintheappendixat theendofthisdocument)illustratetheharmthatTUSDhascausedinpassingtheGoverning BoardResolutiononMexicanAmericanStudies. AsaresponsetoTUSDsGoverningBoardResolutiononMexicanAmericanStudiesthe MexicanAmericanLegalDefenseandEducationFund(MALDEF),actingonbehalfofthe interestsofMexicanAmericanLatina/ostudentsandfamiliesinTUSD,filedonFebruary2, 2012intheUnitedStatesDistrictCourtfortheDistrictofArizonatheMENDOZAPLAINTIFFS RESPONSETOCOURTCONCERNINGSUSPENSIONOFMEXICANAMERICANSTUDIESCOURSES ANDREQUESTFORSPECIALMASTERTOTAKEACTION(CaseNo.4:74CV00090DCB).

OnFebruary29,2012,UnitedStatesDistrictJudge,DavidC.Bury,respondedtoMALDEF andtheMendozaPlaintiffsdeclaringITISORDEREDthatthemotionforSpecialMasterto TakeAction(Doc.1354)isDENIEDtotheextentitrequeststhisCourttoordertheDistrictto reinstateMASDcourses.Furthermore,JudgeBurystated,ThisCourtfindsthat discontinuanceoftheMASDcoursesduringtheremainderoftheUSPslifeexpectancywillnot violatetheEqualProtectionClauseoftheConstitutionbyintentionallysegregatingor discriminatingagainststudentsbasedonraceorethnicgroup. TheMexicanAmericanLatina/ocommunityinTucsonandstudentswhowereenrolled inTUSDsMASDcoursestakesexceptiontotheCourtsfindingthatthediscontinuanceofthe MASDcourseswillnotviolatetheEqualProtectionClauseoftheConstitutionby discriminatingagainststudentsbasedonraceorethnicgroupinthatwehavebeensingled outandhaveboreforthepastsixyearsandcontinuetobearthebruntofdiscriminatory attacksanddisparatetreatmentfromtheStateofArizona,toincludeoftheOfficeof SuperintendentandtheOfficeofAttorneyGeneral. Moreover,TUSDLeadershiptoinclude:SuperintendentJohnPedicone;TUSDAssistant SuperintendentGuadalupeGarcia;TUSDGoverningBoardPresidentMarkStegeman;TUSD GoverningBoardClerkMichaelHicks;TUSDGoverningBoardMemberMiguelCuevas;and TUSDGoverningBoardMemberAlexandreSugiyama(andtoexcludeTUSDBoardMember AdelitaGrijalvawhohasbeenaconsistentadvocateofequitableeducationforMexican AmericanLatina/ostudents)havenotonlycoweredtotheStateofArizonasdiscriminatory passageofHB2281andimplementationofARS15112,butinfacttheyhaveperpetuatedthe discriminatoryattacksanddisparatetreatmentofMexicanAmericanLatina/ostudentsinTUSD inlightoftheissuesurroundingMASD. Inaddition,theMexicanAmericanLatina/ocommunityinTucsonandstudentswho wereenrolledinTUSDsMASDcoursestakesexceptionSpecialMasterWillisHawleys recommendationtoJudgeBurythathenotes:(1)thattheBoardssuspensionofthecourses doesnotrestricttheMexicanAmericanStudy(sic)Departmentfromactingtodevelop practicablestrategiesformeetingtheacademicandsocialdevelopmentalneedsofMexican Americanstudents.Themostpracticablestrategiesformeetingtheacademicandsocial developmentalneedsofMexicanAmericanstudentsweretakingplaceinMASDcourses,as supportedthroughtheArizonaStateSuperintendentscommissionedindependentaudit(see linkforauditbelow).Furthermore,thedecimationofTUSDsMASDpersonnelthrough retaliatory,disparate,anddiscriminatorypractices,undertheleadershipofTUSD SuperintendentJohnPediconeandGoverningBoardPresidentMarkStegeman,haveleft TUSDsMASDwithaDirector,anAdministrativeAssistant,andthreeparttimestudenthelpers,

hardlyapracticablestafftoadequatelyandeffectivelyserveTUSDslargeststudent population,31,617MexicanAmericanLatina/ostudentsthatcomprise61.3%oftheDistrict(as of03/06/2012TUSDAccountabilityandResearchwebsite: http://tusdstats.tusd.k12.az.us/planning/profiles/curr_enr/anydate/anyenry.asp).IfTUSDwere sincereinwantingtoeffectivelyserveMexicanAmericanLatina/ostudents,wouldhave providedresourcestoMASDtohirepersonnelthatisequitabletostaffinginotherTUSDEthnic StudiesDepartmentswiththesamesenseofurgencythatitdemonstratedineliminatingMASD courses.

Furthermore,theMexicanAmericanLatina/ocommunityinTucsonandstudentswho wereenrolledinTUSDsMASDcoursestakesexceptionSpecialMasterWillisHawleys communicationinhismemorandumtoJudgeBury,datedFebruary23,2012,whereinhe states:Idonotrecommendthatyouorderthatthecoursesbereinstatedatthistime.Such reinstatementwouldfurtherdisrupttheeducationofthestudentsinvolvedandwouldimpede thedevelopmentoftheUnitaryStatusPlan.ThelivedexperiencesofMexicanAmericans Latinas/osinTUSDandoureducationalwellbeinghasbeendisruptedforover100yearsdue tothedisparateanddiscriminatorytreatmentmetedoutbytheDistrict,henceourcurrent situationunderaFederalDesegregationCourtOrder.Ratherthanpositionhimselfasan advocateforsocialjusticeandthewellbeingoftheMexicanAmericanLatina/ostudentsand immediatelyreinstateMASDcourses,SpecialMasterHawleyhaschosentoconsultwithTUSD Leadership,toincludeSuperintendentJohnPedicone,theguiltypartyanddefendantinthe DesegregationCourtOrder.Thisisanalogoustoacriminalcaseintervenerconsultingwiththe guiltypartyorcriminaltodecideherorhisfatewhiletheplaintifforvictimofcrimesitbyidly andhavenosayinhowjusticeshouldbeservedontheperpetratorofthecrime. TheMexicanAmericanLatina/ocommunityinTucsontakesthedecadeslongdisparate anddiscriminatorytreatmentofourchildreninTUSDveryseriously,infactweviewitas criminal.ManylivesofMexicanAmericanLatina/oyouthsandtheirfamilieshavebeen destroyedduetoTUSDsdisparateanddiscriminatorytreatmentofourchildren.Unlikeour expectationsthatwehaveforTUSD,weexpectthattheSpecialMaster,asaCourtappointed expertchargedwithbringinganendtodiscriminatorypracticesofTUSD,actingoodfaithand dowhatisjustforMexicanAmericanLatina/ostudentsandimmediatelyreinstateMASD courses.TheMASDcourseshave:developedwithinourchildrenastrongsenseofidentity,both culturalandacademic;transformedthelivesforthebetterforthousandsofourchildren; developedthenecessaryskillsthathaveaffordedourchildrentomatriculateintocollege;and haveprovidedapracticablealternativetoalifeoflowwages,crime,andprisonwhichareall toocommonoccurrencesandlifeoutcomesforMexicanAmericanLatina/oyouth.Inother wordsMexicanAmericanLatina/oyouthsdonothavetheluxurytowaitforthefull

developmentoftheUnitaryStatusPlan;theyhaveindeedsufferedirreparableharm, psychologicalandmentalharm,disparateanddiscriminatorytreatment,andaviolationofthe EqualProtectionoftheConstitutionandthehandsofTUSDandtheGoverningBoard ResolutiononMexicanAmericanStudies.Inessence,MexicanAmericanLatina/oyouthneedto memadewholeasmuchaspossibleandthisisonlyattainablethroughthereinstatementof MASDcourses. TUSDsterminationofMASDLiteratureandMASDSocialStudiescoursesaswellasthe prohibitionofallowingstudentstoenrollinLatinoLiterature5,6;LatinoLiterature7,8; AmericanHistoryMexicanAmericanPerspectives1,2;andAmericanGovernmentSocialJustice EducationProjectforthe20122013SYrepresentsthedenialofequitableeducational opportunityandaviolationoftheEqualProtectionClauseoftheConstitutionforMexican AmericanLatina/ostudents.TheseaforementionedMASDclasseshavedemonstratedfrom the20042005SYtothe20092010SY,asixconsecutiveyearperiod,toclosetheachievement gapforMexicanAmericanLatina/ostudentsandhasincreasedgraduationratesfrom5%to 10%higherforMexicanAmericanLatina/ostudentscomparedtheirpeerswhodidnottake theseclasses(Seepgs.4346andpgs.4647,CambiumLearning,Inc.NationalAcademic EducationalPartners:CurriculumAuditoftheMexicanAmericanStudiesDepartment,Tucson UnifiedSchoolDistrict[http://www.scribd.com/doc/58025928/TUSDethnicstudiesaudit]Itis alsoimportanttonotethatundertheleadershipofTUSDSuperintendentJohnPedicone,the dataforthe20102011SYstudentsenrolledinMASDcourseshasbeenrequestedbytheTUSD MASDandwithnoresponsefromTUSDAdministration).GiventhatTUSDserves61.3%ofthe studentpopulation,thelargeststudentdemographicintheDistrict,combinedwiththe DistrictsfailuretoeffectivelyengageMexicanAmericanLatina/ostudentsinordertoincrease theiracademicachievement,thisactofrefusingstudentstheopportunitytotakeMASD LiteratureandMASDSocialStudiescoursesisadenialofequitableeducationalopportunities, cleardiscriminatoryanddisparatetreatmentofMexicanAmericanLatina/ostudents,anda clearviolationofEqualProtectionClauseoftheConstitutionforMexicanAmericanLatina/o students. ThemessagethatTUSDissendingtoMexicanAmericanLatina/ostudentsisa psychologicallydamagingonewhereinparents,families,andcommunityaretoldbyTUSDthat theirhistory,cultureandliteraryworksarelessthanandnotequalto,andnotworthyofbeing AmericanenoughtostudyinTUSDschools.Thismessageisadecadeslongcontinuationof TUSDactinginbadfaithwithaswellasdisparatelytreatinganddiscriminatingagainst MexicanAmericansLatinas/osinTUSD. ThefollowinganalysisofwhathastranspiredatsixTUSDhighschoolsCatalinaMagnet HighSchool,ChollaHighMagnetSchool,PaloVerdeHighMagnetSchool,PuebloMagnetHigh

School,RinconHighSchool,andTucsonHighMagnetSchoolsincetheterminationofMASD coursesduetotheTUSDGoverningBoardResolutiononMexicanAmericanStudiesthatwas passedonJanuary10,2012,demonstratesacleardisparateanddiscriminatorytreatment andaviolationoftheEqualProtectionClauseoftheConstitutionforMexicanAmerican Latina/ostudents. WhileMASDdidnotofferAmericanGovernmentSocialJusticeEducationProjectatCatalina MagnetHighSchoolforthe20112012SY,thisMASDSocialStudiescoursewasidentifiedon thePostUnitaryStatusPlantobetaughtatthissitesincethe20092010SY.Therestrictingof studentsbyTUSD,undertheleadershipofSuperintendentJohnPedicone,barredstudents fromenrollingintheAmericanGovernmentSocialJusticeEducationProjectforthe20112012 SYasthiscoursewasnotmadeavailableforstudentstoenrollinduringtheregistration process.Moreover,CatalinaMagnetHighSchoolcontinuestooffertheAmericanHistory MultiplePerspectives1,2coursethatfocusesonraciallyandethnicallyidentifiablegroupsfor theremainderofthe20112012SYthusdemonstratingaviolationoftheEqualProtectionfor MexicanAmericanLatina/ostudents.

SUMMARY:DENIALOFEQUITABLEEDUCATIONALOPPORTUNITIESANDVIOLATIONOFTHE EQUALPROTECTIONFORMEXICANAMERICANLATINA/OSTUDENTSATTUSDSCATALINA MAGNETHIGHSCHOOL ForTUSDtodenyMexicanAmericanLatina/ostudentstheeducationalopportunityto studytheirhistory,culture,andliterarytraditionsinthecurriculumatCatalinaMagnetHigh School,where593studentsareMexicanAmericanLatina/othatcomprise50.0%ofthestudent population,whileatthesametimeaffordingotherraciallyidentifiablegroupstodosoisa denialofequitableeducationalopportunitiesforMexicanAmericanLatina/ostudents,andis aviolationoftheEqualProtectionforMexicanAmericanLatina/ostudents.
