Voter education and mobilisation.

40. (1) The Commission shall, in performing its duties under Article 88 (4) (g) of the Constitution (a) establish mechanisms for the provision of continuous voter education and cause to be prepared a voter education curriculum; and mobilise and encourage voters to turn out and vote during elections so as to attain a voter turnout at every election of at least seventy per cent of the registered voters.

(b)

(2) Where in any elections the turnout of voters is lower than seventy per cent of the registered voters, the Commission shall compile a report to be laid before Parliament detailing the reasons and circumstances leading to such lower voter turnout.

SCHEDULE THAT, the Bill be amended in the Schedule by inserting the following new amendments in their proper numerical sequence(i) by inserting the following immediately after the amendment proposed to section 30(2)S. 31 Insert the following new sub-section after sub-section (3)(3A) The Commission shall, after receipt of the names under sub-section (3), publish the names of the authorized person or persons in the Kenya Gazette and in at least two daily newspapers of national circulation at least fourteen days before the nomination day. THE PUBLIC FINANCIAL MANAGEMENT BILL (BILL NO. 7 OF 2012)


NOTICE is given that the Chairperson of the Departmental Committee on Budget (Hon. Christuthus Okemo) intends to move the following amendments to the Public Financial Management Bill, (Bill No7 of 2012) at the Committee Stage
CLAUSE 4 THAT, Clause 4 be amended (a) by deleting subsection (1). (b) in subsection (3) by deleting the words declared under section(1) (c) by deleting subsection (4) CLAUSE 6 THAT, Clause 6 be amended by (a) deleting subsection (b) (b) deleting subsection (g) CLAUSE 7 THAT, Clause 7 be amended by deleting paragraph (e) and substituting therefor the following (e) review the Division of Revenue Bill presented to Parliament and ensure that reflects the principles under Articles 187(2)(a), 201 and 203 of the Constitution. CLAUSE 9 THAT, Clause 9 be deleted. CLAUSE 10 THAT, Clause 10 be amended (a) by deleting subsection (1)(a). (b) by deleting subsection (1)(g). CLAUSE 15 THAT, Clause 15 be amended(a) by deleting subsection (2)(a) and substituting therefor the following(2) (a) over the medium term a minimum of thirty per cent of the national and county governments budget shall be allocated to the development expenditure. (b) in subsection (2)(d) by inserting the following words after the word level as approved by Parliament for the National Government and the County Assembly for the County Government. CLAUSE 17 THAT, Clause 17 be amended by deleting subsections (6) (7) and (8) and substituting in place thereof with the following new subsection 17(6) The disbursement of funds to County governments shall be effected on the first working day of every quarter in the financial year in equal installments in accordance with Articles 203(j)and 219 of the Constitution. CLAUSE 19 THAT, Clause 19 be amended by deleting the words to the Equalization and substituting thereof with the words from the Consolidated. (b) by inserting the following new subclause immediately after sub-clause (1) 31(1A) Where either House of Parliament is canvassing a matter relating to the national debt, the Cabinet Secretary shall submit to Parliament, a report of all loans made to the National Government, national government entities, and county governments, not later than seven days after receiving a request to do so from either House of Parliament. (c) in subsection (2) by deleting the opening paragraph and substituting therefor the following (2) At the end of every four months, the Cabinet Secretary shall submit a report to Parliament stating the loan balances brought forward, carried down, additions and subtractions on new loans obtained from outside Kenya or denominated in foreign currency specifyingCLAUSE 39 THAT, Clause 39 be amended (a) in subsection (3) by deleting the words and only if immediately after the words the Budget Policy Statement; (b) in subsection (4) by deleting the word only immediately after the words the National Assembly may. CLAUSE 64 THAT, Clause 64 be amended(a) in subsection (1), by deleting paragraphs (b) and (c) and inserting the following new paragraph (b) by inserting the following new subsection immediately after subsection (1)64.(1A) The Head of the Public Debt Management Office shall be recruited competitively by the Public Service Commission. CLAUSE 66 THAT, Clause 66 be amended in subsection (1), deleting paragraph (h). CLAUSE 68 THAT, Clause 68 be amended in subsection (4)(b) by inserting the words and the Controller of Budget at the end thereof. CLAUSE 74 THAT, Clause 74 be amended by re-numbering the existing subsection (1) as subsection (2) and inserting a new sub-clause 74 (1A) as follows 74 (1A). The Controller of Budget shall have unlimited access to information with respect to records, documents, books of accounts and all financial statements, electronic or otherwise of any public entity and state organ both at the National and county level as it relates to the execution of his or her mandate. CLAUSE 83 THAT Clause 83 be amended by deleting subclause (5). CLAUSE 86 THAT, Clause 86 be amended in subclause (1) by deleting all the words appearing after the words may be established or dissolved substituting therefor the words by Parliament with financial certification from the National Treasury.

CLAUSE 97 THAT, Clause 97 be amended by (a) deleting subsection (1) and substituting therefore the following new subclauses97.(1) Where the Cabinet Secretary finds that there is a serious material breach or persistent breaches by a state organ or public entity concerned and the Cabinet Secretary shall, in order to forestall the situation, stops the transfer of not more than fifty per cent of the funds for a period of not more than sixty days and shall inform the Controller of Budget and Parliament accordingly. (2) The Controller of Budget shall investigate the matter and prepare a report to Parliament on the matter in respect of the state organ or public entity concerned. (3) Parliament shall, within thirty days of notification by the Cabinet Secretary, approve or renew the decision of the Cabinet Secretary to stop the transfer of funds and the Cabinet secretary shall abide by the decision of the Parliament. 97(5) Pursuant to Article 226(5) of the Constitution, the holder of a public office, including a political office, adjudged guilty of a material breach that results in the stoppage of funds shall be: (a) held accountable and shall make good the loss, whether the person remains the holder of the office or not; and (b) is barred from holding any other public office as long as the person remains undischarged of the offence.

CLAUSE 109 THAT, Clause 109 be amended in subclause (9) by inserting the words with a copy to the Controller of Budget at the end thereof. CLAUSE 137 THAT, Clause 137 be amended by inserting a new sub-clause immediately after subclause 137(1) as follows 137(1A) The County Budget and Economic Forum shall consist of (a) The Governor of the county who shall be the chairperson; (b) other members of the county executive committee; (c) a number of representatives equal to the number of executive committee members appointed by the Governor from persons nominated by organizations representing professionals, business, labour issues, women, persons with disabilities, the elderly and faith based groups at the county level. CLAUSE 144 THAT, Clause 144 (18) be amended by deleting the words Consolidated Fund and inserting in place therefor the words County Revenue Fund.

(1B) A person shall not be qualified to be appointed as a Director under subsection (1A) unless that person holds a minimum of a masters degree in either economics, public finance, financial management or a closely related area from a recognised university, and has at least fifteen years experience in public finance management. CLAUSE 73 THAT, clause 73 be deleted and replaced with the following new clause National government entity to have financial management and internal audit control system. No. 12 of 2003. 73. Every national government entity shall ensure that it has in place a financial management and internal audit control system that complies with the requirements of the Public Audit Act, 2003.
