The Rules and Regulations published herein apply only to Transportation Rate Schedules which make specific reference to Amberjack Pipeline Company LLC Transportation Rules Schedule No. 5, supplements hereto and successive issues hereof.

AMBERJACK PIPELINE COMPANY LLC SUPPLEMENT NO. 4 TO TRANSPORTATION RULES SCHEDULE NO. 5 This Carrier will transport Petroleum as defined herein, receiving and delivering the same through its own facilities and lines, and where applicable, lines of connecting carriers, subject to the following rules: 1C. DEFINITIONS (Cancels 1B) "Carrier" as herein used means Amberjack Pipeline Company LLC. "Barrel" as herein used means forty-two (42) United States gallons at sixty degrees (60) Fahrenheit and zero (0) gauge pressure if the vapor pressure of the Petroleum is at or below atmospheric pressure, or at equilibrium pressure if the vapor pressure of the Petroleum is above atmospheric pressure. "Petroleum" as herein used means the direct liquid products of oil wells, or a mixture of the direct liquid products of oil wells with the indirect liquid products of oil and gas wells, including gasoline and liquefied petroleum gases, as provided in Item 3. [W] "Tender" Nomination as herein used means an offer by a shipper to the Carrier of a stated quantity of Petroleum for transportation from a specified origin or origins to a specified destination in accordance with these rules. [C] Average Regular Shipper Volume means the average monthly volume shipped during the Base Period. Shippers not shipping for any month will be credited with zero barrels for that month in establishing their Average Regular Shipper Volume. [C] Base Period means a six (6) month period beginning six (6) months prior to the month requiring proration. [C]Regular Shipper means a Shipper that has a shipping record over the Base Period. [C]New Shipper means any Shipper who has not shipped at any time during the Base Period. 4A. [R2] SPECIFICATIONS AS TO QUALITY AND LEGALITY OF SHIPMENTS

Carrier reserves the right to reject any and all other following shipments: A. B. Petroleum having a Reid vapor pressure in excess of 8.6. Petroleum containing water, sediment and other impurities totaling in excess of one percent (1%) as determined by industry accepted tests, or by such other tests as may be agreed upon by the shipper and Carrier. Petroleum where the shipper or consignee has failed to comply with all applicable laws, rules and regulations made by any governmental authorities regulating shipments of Petroleum.

Notwithstanding the above specifications, Carrier may accept Petroleum from shipper that does not meet the above specifications due to, but not limited to, operational circumstances (i.e. offshore deep water well maintenance or production facility upsets), emergencies, or events of force majeure (such as sea

In such case, however, shipper must notify Carrier fully, in writing, of the characteristics of such Petroleum and shipper shall then secure from the producer or connecting carrier or shall provide itself, in writing, to Carrier an assumption of all liability and agree to hold Carrier harmless from and against any loss, cost or disadvantage to other shippers, and other pipelines or downstream facilities, or to Carrier arising from such transportation. If Carrier determines that a shipper has delivered to Carrier's facilities Petroleum that has been contaminated by the existence of and/or excess amounts of impure substances, including but not limited to chlorinated and/or oxygenated hydrocarbons such as methanol, or arsenic, lead, and/or other metals which cause harms to other shippers, carriers, users of the contaminated Petroleum or Carrier, such shipper will be excluded from further entry into applicable segments of the pipeline system until such time as the quality of the Petroleum is to the satisfaction of the Carrier. Carrier is not responsible for monitoring receipts or deliveries for contaminants. Further, Carrier reserves the right to dispose of any contaminated Petroleum blocking its pipeline system. Disposal thereof may be made in any reasonable manner including but not limited to commercial sales, and any liability associated with the contamination or disposal of any Petroleum shall be borne by the shipper introducing the contaminated Petroleum into Carrier's system. Notwithstanding the foregoing, in general, the shipper who introduced into Carrier's system Petroleum that does in any way not comply with the above specifications, is liable for all consequences of transportation by Carrier of such Petroleum, including but not limited to, damages, costs and expenses of disposal, costs and expenses necessary to return the Carrier's system facilities to service, claims from other shippers, carriers, or users of the non-complying Petroleum, and the costs of any regulatory or judicial proceeding. 13B. APPORTIONMENT WHEN [W]TENDERS NOMINATIONS ARE IN EXCESS OF FACILITIES (Cancels 13A) When there shall be [W]tendered Nominated to the Carrier, for transportation, more Petroleum than can be immediately transported, on a line segment, the transportation furnished by the Carrier shall be apportioned among [W]Regular Shippers and [W]New Shippers as follows: 1. New Shippers shall be allocated a total of [W]five percent (5%) ten percent (10%) of the available pipeline capacity. If more than one New Shipper has Nominated volumes, pipeline space shall be allocated proportionately to each New Shipper in relation to the total Nominations by New Shippers, so that the total pipeline capacity allocated for all New Shippers shall not exceed [W]five percent (5%) ten percent (10%) of the available pipeline capacity. 1. The remaining capacity [C] (following allocation to New Shippers of the line segment being prorated) shall be allocated among Regular Shippers in proportion to their [C] Average Regular Shipper Volume. Regular Shippers allocations will be the lesser of their current nomination or their Average Regular Shipper Volume, unless additional capacity remains after Regular Shippers allocations [N]base period shipments. [C]In that instance, the remaining capacity will be allocated proportionally among all Shippers with allocation not to exceed Shippers current nomination. [N]The base period is a period of 12 months beginning 13 months prior to the month of allocation and excluding the month preceding the month of allocation. [N]A Regular Shipper is any shipper having a record of movements, in the line segment being prorated, during the base period. A New Shipper is a shipper who does not qualify as a Regular Shipper under the above definition. No Nominations shall be considered beyond the amount which the party requesting shipment has available for shipment.

USE OF COMMUNICATION FACILITIES Without additional charge, shippers or consignees may use the private communication facilities of Carrier for the transmission of messages incident to a shipment, but Carrier shall not be obligated to deliver messages nor shall it be liable for failure to deliver messages, for errors or delay in transmission, or for interruption of the service. 19A. APPLICATION OF RATES FROM UN-NAMED ORIGINS [N]AND TO UN-NAMED DESTINATONS (Cancels 19) Pending the issue of new rates from any new points of origin or [N]destination that may be established along the lines of the Carrier, the following rule will govern: From any such origin not named in a [N] Transportation Rate Schedule to a named destination [N] in the applicable Transportation Rate Schedule, apply the rate published from the next more distant origin point name [W]herein therein. From any origin named in a Transportation Rate Schedule to a destination not named in the applicable Transportation Rate Schedule, apply the rate published from the next more distant destination named therein. If the intermediate point is going to be used for more than 30 continuous days, then a Transportation Rate Schedule will be issued to establish the point on a permanent basis. 23A. [W]TENDER NOMINATION REQUIRED (Cancels 23) Petroleum will be transported or stored by Carrier only under a [W]tender Nomination accepted by Carrier. Any shipper desiring to [W]tender Nominate Petroleum for transportation or storage shall make such [W]tender Nomination to Carrier [N]prior to 12 Noon Central Standard Time/Central Daylight Saving Time, whichever is applicable, [C]on or before the [W]twenty-third (23rd) day twentieth (20th) day of the month preceding the month during which transportation or storage under the [W]tender Nomination is to begin; except that, if space is available for current movement, Carrier has the right to accept a [W]tender Nomination of Petroleum for transportation or storage after the [W]twenty-third (23rd) day twentieth (20th) day of the month preceding the month during which transportation or storage, under the [W]tender Nomination is to begin. When the [W]twenty-third (23rd) twentieth (20th) day of the month falls on a weekend or holiday, Nominations will be required prior to 12 Noon Central Standard Time/Central Daylight Saving Time, whichever is applicable, on the preceding workday. [C] All tenders shall be confirmed in writing, by the shipper, prior to the end of the month during which transportation or storage of the Petroleum tendered is begun. 24A. GRAVITY AND SULFUR BANK (Cancels 24) To assure that no shipper will be materially damaged or allowed to benefit by changes in gravity and sulfur due to the intermixing of Petroleum in the system, shippers will be required, as a condition of [W]tendering Nominating, to participate in a Gravity and Sulfur Bank. A fee of .2 cents per Barrel will be assessed to cover costs for administration of the quality bank for the shippers. The tables of gravity and sulfur differential values per Barrel as attached hereto as Exhibits A, B, and C are incorporated herein and made a part of these Rules.

AMBERJACK PIPELINE COMPANY LLC SUPPLEMENT NO. 4 TO TRANSPORTATION RULES SCHEDULE NO. 5 Carrier shall administer the quality bank providing adjustments for the value of crudes with different qualities in the manner specified below for both receipt and delivery volumes: Applicable Barrels and gravities shall be the net Barrels at 60 degrees Fahrenheit (with no deduction for loss allowance) and the gravities recorded by the Carrier at points where it customarily records gravities and quantities. The weighted average gravity differential value per Barrel (for two or more gravities of Petroleum), as hereinafter referred to, shall be obtained in the following manner: multiply the gravity differential values per Barrel (from the attached tables as same are from time to time revised) by the number of Barrels to which such gravity differential values are applicable and then divide the total of the resultant gravity differential values in dollars and cents by the total of the applicable Barrels. Applicable Barrels and sulfur content shall be the net Barrels at 60 degrees Fahrenheit (with no deduction for loss allowance) and the sulfur content recorded by a competent laboratory for samples obtained by the Carrier at the points where it customarily measures and samples receipts for custody transfer. The weighted average sulfur differential value per Barrel (for two or more sulfur contents of Petroleum), as hereinafter referred to, shall be obtained in the following manner: multiply the sulfur differential values per Barrel by the number of Barrels to which such sulfur differential values are applicable and then divide the total of the resultant sulfur differential values in dollars and cents by the total of the applicable Barrels. Sulfur content as furnished by the laboratory at the true gravity shall be adjusted to reflect its comparison to the reference crude at 35.5 degree gravity. The adjustment to the test sulfur content shall be made by establishing a ratio of weight per gallon for the gravity of the sample to weight per gallon for the gravity of the reference crude of 35.5 degree gravity. The Table of Ratio Factors for Sulfur Adjustments is attached hereto as Exhibit "C" and as made a part of these Rules. The ratio thus obtained will be applied against the tested sulfur content of the sample to obtain the adjusted sulfur content (gravity ratio x tested sulfur content = adjusted sulfur content). The adjusted sulfur content will then be used to obtain the sulfur differential value per Barrel from the table of sulfur differential values per Barrel (Exhibit "B"). I. Adjustment between shippers, for both receipt volumes and delivery volumes, shall be computed as follows: A. Compute the weighted average gravity differential value per Barrel of the Barrels received from/ delivered to each shipper.

B. Compute the weighted average sulfur differential value per Barrel of the Barrels received from/ delivered to each shipper. Sulfur differential values from 0 to 0.75 will be considered 0.75. II. Compute the weighted average gravity differential value per Barrel of the composite common stream for receipts and deliveries.

Receipt Calculation:

A. If the weighted average gravity differential value per Barrel of a shipper as so determined under Paragraph I above shall be greater than the weighted average gravity differential value per Barrel of the aforementioned common stream Petroleum as determined under Paragraph II, the difference in cents per Barrel shall be calculated and shipper shall be credited (receives from the bank) an amount calculated by multiplying said difference in gravity differential value per Barrel by the applicable Barrels.

B. If the weighted average gravity differential value per Barrel of a shipper is less than the weighted average gravity differential value per Barrel of the aforementioned common stream Petroleum, the difference shall be calculated as above outlined and a shipper debited (pays to the bank) for such difference.

Delivery Calculation:

A. If the weighted average gravity differential value per Barrel of a shipper as so determined under Paragraph I above shall be greater than the weighted average gravity differential value per Barrel of the aforementioned common stream Petroleum as determined under Paragraph II, the difference in cents per Barrel shall be calculated and shipper shall be debited (pays the bank) an amount calculated by multiplying said difference in gravity differential value per Barrel by the applicable Barrels.

B. If the weighted average gravity differential value per Barrel of a shipper is less than the weighted average gravity differential value per Barrel of the aforementioned common stream Petroleum, the difference shall be calculated as above outlined and a shipper credited (receives from the bank) for such difference. III. Compute the weighted average sulfur differential value per Barrel of the composite common stream for receipts and deliveries

Receipt Calculation:

A. If the weighted average sulfur differential value per Barrel of a shipper as so determined under Paragraph I above shall be greater than the weighted average sulfur differential value per Barrel of the aforementioned common stream Petroleum as determined under Paragraph III, the difference in cents per Barrel shall be calculated and shipper shall be debited (pays the bank) an amount calculated by multiplying said difference in sulfur differential value per Barrel by the applicable Barrels. B. If the weighted average sulfur differential value per Barrel of a shipper is less than the weighted average sulfur differential value per Barrel of the aforementioned common stream Petroleum, the difference shall be calculated as above outlined and shipper shall be credited (receives from the bank) for such difference.

Delivery Calculation:

A. If the weighted average sulfur differential value per Barrel of a shipper as so determined under Paragraph I above shall be greater than the weighted average sulfur differential value per Barrel of the aforementioned common stream Petroleum as determined under Paragraph III, the difference in cents per Barrel shall be calculated and shipper shall be credited (receives from the bank) an amount calculated by multiplying said difference in sulfur differential value per Barrel by the applicable Barrels.

B. If the weighted average sulfur differential value per Barrel of a shipper is less than the weighted average sulfur differential value per Barrel of the aforementioned common stream Petroleum, the difference shall be calculated as above outlined and shipper shall be debited (pays the bank) for such difference. A sample calculation is attached as Exhibit "D".

These calculations shall be made for each calendar month and the algebraic sum of the adjustments for the system shall be zero One Dollar. If a shipper shall have a net debit balance when netting the two adjustments made on receipts and deliveries above, the balance shall be remitted to the clearinghouse within fifteen (15) days from receipt of statement of such debit. If shipper shall have a credit, the clearinghouse shall remit the amount thereof after receipt by the clearinghouse of the sums from those shippers having debits as calculated above.

GENERAL APPLICATION
The Rules and Regulations published herein apply only to Transportation Rate Schedules which make specific reference to Amberjack Pipeline Company LLC Transportation Rules Schedule No. 5, supplements hereto and successive issues hereof.

AMBERJACK PIPELINE COMPANY LLC SUPPLEMENT NO. 3 TO TRANSPORTATION RULES SCHEDULE NO. 5

This Carrier will transport Petroleum as defined herein, receiving and delivering the same through its own facilities and lines, and where applicable, lines of connecting carriers, subject to the following rules: 1B (Cancels 1A). DEFINITIONS "Carrier" as herein used means Amberjack Pipeline Company LLC. "Barrel" as herein used means forty-two (42) United States gallons at sixty degrees (60) Fahrenheit and zero (0) gauge pressure if the vapor pressure of the petroleum is at or below atmospheric pressure, or at equilibrium pressure if the vapor pressure of the petroleum is above atmospheric pressure. "Petroleum" as herein used means the direct liquid products of oil wells, or a mixture of the direct liquid products of oil wells with the indirect liquid products of oil and gas wells, including gasoline and liquefied petroleum gases, as provided in Item 3. "Tender" as herein used means an offer by a shipper to the Carrier of a stated quantity of petroleum for transportation from a specified origin or origins to a specified destination in accordance with these rules. Average Regular Shipper Volume means the average monthly volume shipped during the Base Period. Shippers not shipping for any month will be credited with zero barrels for that month in establishing their Average Regular Shipper Volume. Base Period means a six (6) month period beginning six (6) months prior to the month requiring proration. Beginning November 2006 until a six (6) month average can be established, the Base Period will be the number of months shown below: Delivery Month November 2006 December 2006 January 2007 February 2007 March 2007 April 2007 Base Period 1 month 2 months 3 months 4 months 5 months 6 months

Regular Shipper means a Shipper that has a shipping record over the Base Period. New Shipper means any Shipper who has not shipped at any time during the Base Period. 4A. [R2] SPECIFICATIONS AS TO QUALITY AND LEGALITY OF SHIPMENTS

Carrier reserves the right to reject any and all other following shipments: A. B. Petroleum having a Reid vapor pressure in excess of 8.6. Petroleum containing water, sediment and other impurities totaling in excess of one percent (1%) as determined by industry accepted tests, or by such other tests as may be agreed upon by the shipper and Carrier.

Notwithstanding the above specifications, Carrier may accept Petroleum from shipper that does not meet the above specifications due to, but not limited to, operational circumstances (i.e. offshore deep water well maintenance or production facility upsets), emergencies, or events of force majeure (such as sea storms or shut-in platforms). In such case, however, shipper must notify Carrier fully, in writing, of the characteristics of such Petroleum and shipper shall then secure from the producer or connecting carrier or shall provide itself, in writing, to Carrier an assumption of all liability and agree to hold Carrier harmless from and against any loss, cost or disadvantage to other shippers, and other pipelines or downstream facilities, or to Carrier arising from such transportation. If Carrier determines that a shipper has delivered to Carrier's facilities Petroleum that has been contaminated by the existence of and/or excess amounts of impure substances, including but not limited to chlorinated and/or oxygenated hydrocarbons such as methanol, or arsenic, lead, and/or other metals which cause harms to other shippers, carriers, users of the contaminated Petroleum or Carrier, such shipper will be excluded from further entry into applicable segments of the pipeline system until such time as the quality of the Petroleum is to the satisfaction of the Carrier. Carrier is not responsible for monitoring receipts or deliveries for contaminants. Further, Carrier reserves the right to dispose of any contaminated Petroleum blocking its pipeline system. Disposal thereof may be made in any reasonable manner including but not limited to commercial sales, and any liability associated with the contamination or disposal of any Petroleum shall be borne by the shipper introducing the contaminated Petroleum into Carrier's system. Notwithstanding the foregoing, in general, the shipper who introduced into Carrier's system Petroleum that does in any way not comply with the above specifications, is liable for all consequences of transportation by Carrier of such Petroleum, including but not limited to, damages, costs and expenses of disposal, costs and expenses necessary to return the Carrier's system facilities to service, claims from other shippers, carriers, or users of the non-complying Petroleum, and the costs of any regulatory or judicial proceeding. 13A. [R1] APPORTIONMENT WHEN TENDERS ARE IN EXCESS OF FACILITIES

When there shall be tendered to the Carrier, for transportation, more Petroleum than can be immediately transported on a line segment, the transportation furnished by the Carrier shall be apportioned among Regular Shippers and New Shippers as follows: 1. New Shippers shall be allocated a total of five percent (5%) of the available pipeline capacity. If more than one New Shipper has nominated volumes, pipeline space shall be allocated proportionately to each New Shipper in relation to the total nominations by New Shippers, so that the total pipeline capacity allocated for all New Shippers shall not exceed five percent (5%) of the available pipeline capacity. 2. The remaining capacity (following allocation to New Shippers of the line segment being prorated) shall be allocated among Regular Shippers in proportion to their Average Regular Shipper Volume. Regular Shippers allocations will be the lesser of their current nomination or their Average Regular Shipper Volume, unless additional capacity remains after Regular Shippers allocations. In that instance, the remaining capacity will be allocated proportionally among all Shippers with allocation not to exceed Shippers current nomination.

To assure that no shipper will be materially damaged or allowed to benefit by changes in gravity and sulfur due to the intermixing of petroleum in the system, shippers will be required, as a condition of tendering, to participate in a Gravity and Sulfur Bank. A fee of .2 cents per barrel will be assessed to cover costs for administration of the quality bank for the shippers. The tables of gravity and sulfur differential values per barrel as attached hereto as Exhibits A, B, and C are incorporated herein and made a part of these Rules. Carrier shall administer the quality bank providing adjustments for the value of crudes with different qualities in the manner specified below for both receipt and delivery volumes: Applicable barrels and gravities shall be the net barrels at 60 degrees Fahrenheit (with no deduction for loss allowance) and the gravities recorded by the Carrier at points where it customarily records gravities and quantities. The weighted average gravity differential value per barrel (for two or more gravities of petroleum), as hereinafter referred to, shall be obtained in the following manner: multiply the gravity differential values per barrel (from the attached tables as same are from time to time revised) by the number of barrels to which such gravity differential values are applicable and then divide the total of the resultant gravity differential values in dollars and cents by the total of the applicable barrels. Applicable barrels and sulfur content shall be the net barrels at 60 degrees Fahrenheit (with no deduction for loss allowance) and the sulfur content recorded by a competent laboratory for samples obtained by the Carrier at the points where it customarily measures and samples receipts for custody transfer. The weighted average sulfur differential value per barrel (for two or more sulfur contents of petroleum), as hereinafter referred to, shall be obtained in the following manner: multiply the sulfur differential values per barrel by the number of barrels to which such sulfur differential values are applicable and then divide the total of the resultant sulfur differential values in dollars and cents by the total of the applicable barrels. Sulfur content as furnished by the laboratory at the true gravity shall be adjusted to reflect its comparison to the reference crude at 35.5 degree gravity. The adjustment to the test sulfur content shall be made by establishing a ratio of weight per gallon for the gravity of the sample to weight per gallon for the gravity of the reference crude of 35.5 degree gravity. The Table of Ratio Factors for Sulfur Adjustments is attached hereto as Exhibit "C" and as made a part of these Rules. The ratio thus obtained will be applied against the tested sulfur content of the sample to obtain the adjusted sulfur content (gravity ratio x tested sulfur content = adjusted sulfur content). The adjusted sulfur content will then be used to obtain the sulfur differential value per barrel from the table of sulfur differential values per barrel (Exhibit "B"). I. Adjustment between shippers, for both receipt volumes and delivery volumes, shall be computed as follows: A. Compute the weighted average gravity differential value per barrel of the barrels received from/ delivered to each shipper.

B. Compute the weighted average sulfur differential value per barrel of the barrels received from/ delivered to each shipper. Sulfur differential values from 0 to 0.75 will be considered 0.75. II. Compute the weighted average gravity differential value per barrel of the composite common stream for receipts and deliveries.

Receipt Calculation:

A. If the weighted average gravity differential value per barrel of a shipper as so determined under Paragraph I above shall be greater than the weighted average gravity differential value per barrel of the aforementioned common stream petroleum as determined under Paragraph II, the difference in cents per barrel shall be calculated and shipper shall be credited (receives from the bank) an amount calculated by multiplying said difference in gravity differential value per barrel by the applicable barrels. B. If the weighted average gravity differential value per barrel of a shipper is less than the weighted average gravity differential value per barrel of the aforementioned common stream petroleum, the difference shall be calculated as above outlined and a shipper debited (pays to the bank) for such difference.

Delivery Calculation:

A. If the weighted average gravity differential value per barrel of a shipper as so determined under Paragraph I above shall be greater than the weighted average gravity differential value per barrel of the aforementioned common stream petroleum as determined under Paragraph II, the difference in cents per barrel shall be calculated and shipper shall be debited (pays the bank) an amount calculated by multiplying said difference in gravity differential value per barrel by the applicable barrels. B. If the weighted average gravity differential value per barrel of a shipper is less than the weighted average gravity differential value per barrel of the aforementioned common stream petroleum, the difference shall be calculated as above outlined and a shipper credited (receives from the bank) for such difference.

III. Compute the weighted average sulfur differential value per barrel of the composite common stream for receipts and deliveries

Receipt Calculation:

A. If the weighted average sulfur differential value per barrel of a shipper as so determined under Paragraph I above shall be greater than the weighted average sulfur differential value per barrel of the aforementioned common stream petroleum as determined under Paragraph III, the difference in cents per barrel shall be calculated and shipper shall be debited (pays the bank) an amount calculated by multiplying said difference in sulfur differential value per barrel by the applicable barrels. A sample calculation is attached as Exhibit "D".

These calculations shall be made for each calendar month and the algebraic sum of the adjustments for the system shall be zero One Dollar. If a shipper shall have a net debit balance when netting the two adjustments made on receipts and deliveries above, the balance shall be remitted to the clearinghouse within fifteen (15) days from receipt of statement of such debit. If shipper shall have a credit, the clearinghouse shall remit the amount thereof after receipt by the clearinghouse of the sums from those shippers having debits as calculated above.

AMBERJACK PIPELINE COMPANY LLC SUPPLEMENT NO. 2 TO TRANSPORTATION RULES SCHEDULE NO. 5

This Carrier will transport Petroleum as defined herein, receiving and delivering the same through its own facilities and lines, and where applicable, lines of connecting carriers, subject to the following rules: 1A. DEFINITIONS [R1] "Carrier" as herein used means Amberjack Pipeline Company LLC. "Barrel" as herein used means forty-two (42) United States gallons at sixty degrees (60) Fahrenheit and zero (0) gauge pressure if the vapor pressure of the petroleum is at or below atmospheric pressure, or at equilibrium pressure if the vapor pressure of the petroleum is above atmospheric pressure. "Petroleum" as herein used means the direct liquid products of oil wells, or a mixture of the direct liquid products of oil wells with the indirect liquid products of oil and gas wells, including gasoline and liquefied petroleum gases, as provided in Item 3. "Tender" as herein used means an offer by a shipper to the Carrier of a stated quantity of petroleum for transportation from a specified origin or origins to a specified destination in accordance with these rules. Base Period means a six (6) month period beginning six (6) months prior to the month requiring proration. Beginning November 2006 until a six (6) month average can be established, the Base Period will be the number of months shown below: Delivery Month November 2006 December 2006 January 2007 February 2007 March 2007 April 2007 Base Period 1 month 2 months 3 months 4 months 5 months 6 months

Average Regular Shipper Volume means the average monthly volume shipped during the Base Period. Shippers not shipping for any month will be credited with zero barrels for that month in establishing their Average Regular Shipper Volume. Regular Shipper means a Shipper that has a shipping record over the Base Period. New Shipper means any Shipper who has not shipped at any time during the Base Period.

SPECIFICATIONS AS TO QUALITY AND LEGALITY OF SHIPMENTS

Carrier reserves the right to reject any and all other following shipments: A. B. [W]Petroleum having a Reid vapor pressure in excess of 8.6. [W]Petroleum containing water, sediment and other impurities totaling in excess of one percent (1%) as determined by industry accepted tests, or by such other tests as may be agreed upon by the shipper and Carrier. [W]Petroleum where the shipper or consignee has failed to comply with all applicable laws, rules and regulations made by any governmental authorities regulating shipments of [W]petroleum.

[N] Notwithstanding the above specifications, Carrier may accept Petroleum from shipper that does not meet the above specifications due to, but not limited to, operational circumstances (i.e. offshore deep water well maintenance or production facility upsets), emergencies, or events of force majeure (such as sea storms or shut-in platforms). In such case, however, shipper must notify Carrier fully, in writing, of the characteristics of such Petroleum and shipper shall then secure from the producer or connecting carrier or shall provide itself, in writing, to Carrier an assumption of all liability and agree to hold Carrier harmless from and against any loss, cost or disadvantage to other shippers, and other pipelines or downstream facilities, or to Carrier arising from such transportation. If Carrier determines that a shipper has delivered to Carrier's facilities [W]Petroleum that has been contaminated by the existence of and/or excess amounts of impure substances, including but not limited to chlorinated and/or oxygenated hydrocarbons such as methanol, or arsenic, lead, and/or other metals which cause harms to other shippers, carriers, users of the contaminated [W]Petroleum or Carrier, such shipper will be excluded from further entry into applicable segments of the pipeline system until such time as the quality of the [W]Petroleum is to the satisfaction of the Carrier. Carrier is not responsible for monitoring receipts or deliveries for contaminants. Further, Carrier reserves the right to dispose of any contaminated [W]Petroleum blocking its pipeline system. Disposal thereof may be made in any reasonable manner including but not limited to commercial sales, and any liability associated with the contamination or disposal of any [W]Petroleum shall be borne by the shipper introducing the contaminated [W] Petroleum into Carrier's system. Notwithstanding the foregoing, in general, the shipper who introduced into Carrier's system [W]Petroleum that does in any way not comply with the above specifications, is liable for all consequences of transportation by Carrier of such [W]Petroleum, including but not limited to, damages, costs and expenses of disposal, costs and expenses necessary to return the Carrier's system facilities to service, claims from other shippers, carriers, or users of the non-complying [W]Petroleum, and the costs of any regulatory or judicial proceeding. 13A. [R1] APPORTIONMENT WHEN TENDERS ARE IN EXCESS OF FACILITIES

When there shall be tendered to the Carrier, for transportation, more Petroleum than can be immediately transported on a line segment, the transportation furnished by the Carrier shall be apportioned among Regular Shippers and New Shippers as follows:

1. New Shippers shall be allocated a total of five percent (5%) of the available pipeline capacity. If more than one New Shipper has nominated volumes, pipeline space shall be allocated proportionately to each New Shipper in relation to the total nominations by New Shippers, so that the total pipeline capacity allocated for all New Shippers shall not exceed five percent (5%) of the available pipeline capacity. 2. The remaining capacity (following allocation to New Shippers of the line segment being prorated) shall be allocated among Regular Shippers in proportion to their Average Regular Shipper Volume. Regular Shippers allocations will be the lesser of their current nomination or their Average Regular Shipper Volume, unless additional capacity remains after Regular Shippers allocations. In that instance, the remaining capacity will be allocated proportionally among all Shippers with allocation not to exceed Shippers current nomination.

DEFINITIONS

"Carrier" as herein used means Amberjack Pipeline Company. "Petroleum" as herein used means the direct liquid products of oil wells, or a mixture of the direct liquid products of oil wells with the indirect liquid products of oil and gas wells, including gasoline and liquefied petroleum gases, as provided in Item 3. "Tender" as herein used means an offer by a shipper to the Carrier of a stated quantity of petroleum for transportation from a specified origin or origins to a specified destination in accordance with these rules. 2. COMMODITY

The Carrier will transport petroleum, as defined in Item 1, exclusively and will not accept any other commodity for transportation. 3. MIXTURES

The indirect liquid products of oil and gas wells, including gasoline and liquefied petroleum gases, hereinafter referred to as indirect products, will be accepted and transported as a mixture with the direct liquid products of oil wells, hereinafter referred to as direct products, providing the vapor pressure of the resulting mixture does not exceed that permitted by Carrier's facilities and operating conditions. The indirect products portion of the mixture will be accepted for transportation at reception points other than the one at which the direct products portion of the same mixture is received, provided that the shipper, consignee, and destination are the same, and that operating conditions and the Carrier's facilities permit the indirect products portion to be mixed with the direct products of the same shipper or consignee. The rate to be assessed on each portion of the mixture shall be the rate applicable from the reception point at which each is received. The direct and indirect products will be measured and tested separately for determining volumes received. Each such measurement will be made in accordance with Item 8. Mixtures will be transported and delivered as petroleum only. Nothing in this rule is to be construed to waive provisions of Item 5 of this rules schedule or to require the Carrier to receive, transport, and deliver unmixed indirect products. However, unmixed indirect products may be transported for subsequent mixing with direct products in accordance with this rule where facilities exist and operations permit transporting such indirect products.

If Carrier determines that a shipper has delivered to Carrier's facilities crude petroleum that has been contaminated by the existence of and/or excess amounts of impure substances, including but not limited to chlorinated and/or oxygenated hydrocarbons such as methanol, or arsenic, lead, and/or other metals which cause harms to other shippers, carriers, users of the contaminated crude petroleum or Carrier, such shipper will be excluded from further entry into applicable segments of the pipeline system until such time as the quality of the crude petroleum is to the satisfaction of the Carrier. Carrier is not responsible for monitoring receipts or deliveries for contaminants. Further, Carrier reserves the right to dispose of any contaminated crude petroleum blocking its pipeline system. Disposal thereof may be made in any reasonable manner including but not limited to commercial sales, and any liability associated with the contamination or disposal of any crude petroleum shall be borne by the shipper introducing the contaminated crude petroleum into Carrier's system. Notwithstanding the foregoing, in general, the shipper who introduced into Carrier's system crude petroleum that does in any way not comply with the above specifications, is liable for all consequences of transportation by Carrier of such crude petroleum, including but not limited to, damages, costs and expenses of disposal, costs and expenses necessary to return the Carrier's system facilities to service, claims from other shippers, carriers, or users of the non-complying crude petroleum, and the costs of any regulatory or judicial proceeding. 5. SHIPMENTS, MAINTENANCE OF IDENTITY

Petroleum will be accepted for transportation only on condition that it may be subject to such changes in gravity or quality while in transit as would result from its mixture with other petroleum in the pipelines or tanks of the Carrier. Carrier shall be under no obligation to deliver the identical petroleum received but may make delivery out of common stock or out of Carrier's pipeline stream of substantially like petroleum. 6. MINIMUM TENDER

Minimum tender volumes for deliveries out of the Amberjack Pipeline System will be consistent with the minimum volume requirements of the outbound pipeline carriers. 7. TITLE

The Carrier shall have the right to reject any petroleum, when tendered for transportation, which may be involved in litigation, or the title of which may be in dispute, or which may be encumbered by lien or charge of any kind, and require satisfactory evidence of shipper's perfect and unencumbered title or satisfactory indemnity bond to protect Carrier. By tendering petroleum, the shipper warrants and guarantees that the shipper has unencumbered title thereto or the right to cause the petroleum to be transported and that unencumbered title or right remains in effect throughout the movement covered by Page 3 of 7

this rules schedule. In addition, shipper agrees to hold Carrier harmless from any and all loss, cost, liability, damage or expense resulting from failure of title or shipper's failure to have the right to cause the petroleum to be transported; and it is understood that acceptance by the Carrier of the petroleum for transportation shall not be deemed a representation by Carrier as to title. 8. GAUGING, TESTING AND VOLUME CORRECTIONS

Petroleum shipped hereunder shall be measured and tested by representatives of the Carrier or by automatic equipment approved by the Carrier. Quantities shall be determined by dynamic or static measurement methods in accordance with appropriate American Petroleum Institute (A.P.I.) standards, latest revision, and adjusted to base (reference or standard) conditions. The base conditions for the measurement of liquids, such as petroleum and its liquid products, having a vapor pressure equal to or less than atmospheric pressure at base temperature are as follows: Pressure . . . . . . . . 14.696 psia (101.325 kPa) Temperature . . . . . 60.0 F (15.56 C) For liquids, such as liquid hydrocarbons, having a vapor pressure greater than atmospheric pressure at base temperature, the base pressure shall be the equilibrium vapor pressure at base temperature. Deductions will be made for the actual amount of non-merchantable quantities, specifically basic sediment and water and/or other impurities as ascertained by industry accepted test method or other tests agreed upon. When indirect liquid products are received from pressure vessels using static measurement methods, a further adjustment will be made to cover evacuation losses if a gas blanket at or in excess of the vapor pressure of the liquid is not used. When indicated in the Transportation Rate Schedule, the following Pipeline Loss Allowance (PLA) will apply. From the net quantities so determined for acceptance, a further deduction of one-tenth of one percent (0.1%) will be made to cover evaporation and loss during transportation. The balance shall be the net quantities deliverable. 9. ARRANGEMENTS REQUIRED FOR FURTHER TRANSPORTATION

The Carrier will accept petroleum for transportation only when the shipper or consignee has made the necessary arrangements for shipment beyond. 10. ORIGIN FACILITIES REQUIRED FOR AUTOMATIC CUSTODY TRANSFER

Where consignor (or shipper) elects to deliver petroleum to the Carrier at point of origin through automatic custody transfer facilities (in lieu of tankage), the consignor (or shipper) shall furnish the required automatic measuring and sampling facilities, and the design, construction, and calibration of such facilities must be approved by the Carrier and any appropriate regulatory body. In the event automatic custody transfer is made by meters, the consignor (or shipper) shall also furnish whatever pumping service is necessary to insure that the petroleum being delivered to the meter is at a pressure in excess of the bubble point of the liquid. 11. APPLICATION OF RATES AND CHARGES

Petroleum accepted for transportation shall be subject to the rates and charges in effect on the date of receipt of such petroleum by the Carrier. Trunk line transportation and all other lawful charges will be Page 4 of 7

TRANSPORTATION RULES SCHEDULE (Continued) collected on the basis of the net quantities of petroleum delivered. All net quantities will be determined in the manner provided in Item 8. 12. NOTICE OF ARRIVAL, DELIVERY AT DESTINATION

The obligation of the Carrier is to deliver, at the destination, the quantity of petroleum to be transported, less deductions, and such delivery may be made upon twenty-four (24) hours' notice to the shipper or consignee who shall accept and receive said petroleum from the Carrier with all possible dispatch into the tanks or receptacles to be provided by the shipper or consignee. If the shipper, or consignee, is unable or refuses to receive said petroleum as it arrives at the destination, the Carrier reserves the right to make whatever arrangements for disposition of the petroleum it deems appropriate in order to clear its pipeline. Any additional expenses incurred by the Carrier in making such arrangements shall be borne by the shipper or consignee. 13. APPORTIONMENT WHEN TENDERS ARE IN EXCESS OF FACILITIES

When there shall be tendered to the Carrier for transportation more petroleum than can be immediately transported, the transportation furnished by the Carrier shall be apportioned among all shippers in proportion to the amounts tendered by each, based on the capacity of the system and so as to not adversely affect the reasonable operation of Carrier's facilities. No nominations shall be considered beyond the amount which the party requesting shipment has available for shipment. If a shipper is unable to tender petroleum equal to the space allocated to it, its volumes for the succeeding month shall be reduced by the amount of allocated throughput not utilized during the preceding month if apportionment is necessary. 14. PAYMENT OF TRANSPORTATION AND OTHER CHARGES

The shipper or consignee shall pay all applicable transportation and other lawful charges accruing on petroleum delivered to and accepted by the Carrier for shipment, and if required shall pay or furnish guaranty of payment of same satisfactory to the Carrier before acceptance of shipment. The Carrier shall have a lien on all petroleum belonging to the shipper or consignee to secure the payment of any and all unpaid transportation and other charges that are due to the Carrier by the shipper or consignee, and may withhold such petroleum from delivery until all unpaid charges shall have been paid. If such charges remain unpaid five (5) days after notice and demand therefor, the Carrier, or its representatives, shall have the right to sell such petroleum at public auction at the office of the Carrier in Houston, Texas, on any day not a legal holiday, and not less than forty-eight (48) hours after notice stating the time and place of such sale and the quantity, general description, and location of the petroleum to be sold has been published in a daily newspaper of general circulation published in the said city where the sale is to be held, and notice sent by fax to the shipper. The Carrier may be a bidder and purchaser at such sale. Out of the proceeds of said sale Carrier may pay itself all transportation and other lawful charges and all expenses incident to the sale, and the balance shall be held for whomsoever may be lawfully entitled thereto. In addition to all other charges accruing on crude petroleum accepted for transportation through Carriers facilities, a per barrel charge will be assessed and collected in the amount of any fee or other charge, however denominated, which is levied against Carrier by any federal, state or local agency. 15. LIABILITY OF CARRIER

The Carrier, while in possession of any of the petroleum herein described, shall not be liable for any loss thereof, damage thereto, or delay, except to the extent that liability therefor is imposed on the Carrier by law. In case of loss of petroleum for which Carrier is not responsible, the shipper shall bear the loss. Where such loss occurs in the Amberjack Pipeline System containing petroleum which is the property of Page 5 of 7

TRANSPORTATION RULES SCHEDULE (Continued) more than one shipper, each shipper shall bear the loss in such proportion as his total volume in said system bears to the total volume in said system. 16. CLAIMS, SUITS, AND TIME FOR FILING

As a condition precedent to recovery for loss, damage, or delay to shipments, claims must be filed in writing with the Carrier within nine (9) months after delivery of the petroleum, or, in case of failure to make delivery, then within nine (9) months after a reasonable time for delivery has elapsed; and suits arising out of such claims shall be instituted against the Carrier only within two (2) years from the time when the Carrier delivers, or tenders delivery of, the petroleum or, in case of failure to make or tender delivery, then within two (2) years after a reasonable time for delivery has elapsed. Where claims are not filed or suits are not instituted thereon in accordance with the foregoing provisions, Carrier will not be liable and such claims will not be paid. 17. DUTY OF CARRIER

The Carrier shall not be required to transport petroleum except with reasonable diligence, considering the quantity of petroleum, the distance of transportation, the safety of operation, and other material factors. 18. USE OF COMMUNICATION FACILITIES

Without additional charge, shippers or consignees may use the private communication facilities of Carrier for the transmission of messages incident to a shipment, but Carrier shall not be obligated to deliver messages nor shall it be liable for failure to deliver messages, for errors or delay in transmission, or for interruption of the service. 19. APPLICATION OF RATES FROM UN-NAMED ORIGINS

Pending the issue of new rates from any new points of origin that may be established along the lines of the Carrier, the following rule will govern: From any such origin not named in a rate schedule to a named destination, apply the rate published from the next more distant origin point name herein. 20. SYSTEM INVENTORY REQUIREMENTS

Carrier will require each shipper to supply a pro rata share of petroleum necessary for pipeline to ensure efficient operation of Carrier's pipeline system. Petroleum provided by shippers for this purpose may be withdrawn only after: (1) shipments have ceased and shipper has notified Carrier in writing to discontinue shipments in the Carrier's system, and (2) shipper balances have been reconciled between shipper and Carrier. Carrier shall have the right to require advance payment of transportation charges on the volumes to be cleared from Carrier's system and any unpaid accounts receivable, before final delivery will be made. Carrier shall have a reasonable period of time from the receipt of said notice to complete administrative and operational requirements incidental to shipper withdrawal. 21. DIVERSION

Subject to Item 6, change in destination or routing will be permitted without additional charge, on written request from the shipper, provided an applicable rate schedule is in effect for any requested destination or routing, and provided that no back-haul is required. 22. PIPEAGE OR OTHER CONTRACTS

Separate pipeage and other contracts in accordance with applicable rate schedule and these rules and regulations covering further details may be required by Carrier before any duty for transportation shall arise. Page 6 of 7

TENDER REQUIRED

Petroleum will be transported or stored by Carrier only under a tender accepted by Carrier. Any shipper desiring to tender petroleum for transportation or storage shall make such tender to Carrier on or before the twenty-third (23rd) day of the month preceding the month during which transportation or storage under the tender is to begin; except that, if space is available for current movement, Carrier has the right to accept a tender of petroleum for transportation or storage after the twenty-third (23rd) day of the month preceding the month during which transportation or storage, under the tender, is to begin. When the twenty-third (23rd) of the month falls on a weekend or a holiday, nominations will be required prior to 12 noon Central Standard Time/Central Daylight Saving Time, whichever is applicable, on the preceding workday. All tenders shall be confirmed in writing, by the shipper, prior to the end of the month during which transportation or storage of the petroleum tendered is begun.
