2(7) Factory


Premises or yard where generally five or more
workers remain engaged in work on any day of
the year
Any part of manufacturing process
Does not include a mine


2(8) Adolescent


Person who reached fourteen years by age
But did not attain eighteen years.

2(10) Gratuity


30(thirty) days wages of a worker

At the rate of last drawn wages for a full year
or more than six months
2(11) Retrenchment

Termination by the employer of service of a
worker on the ground of needlessness caused
by redundancy.
2(17) Discharge


Termination of the service of worker

By the employer on account of physical or
mental disability.
2(22) Strike
Cessation of work by a group of workers
employed in any establishment
Refusal to work jointly
Refused to accept employment or to continue
to work by any group of workers of that
establishment under a common understanding
2(25) Settlement
Means a settlement arrived at the course of
conciliation proceeding
Includes an agreement between an employer
and his workmen arrived at otherwise than in
the course of any conciliation proceeding
Is working and signed by both the parties
The copy thereof is sent to the director of
labour and to the conciliator.

2(36) Adult


Any person who completed eighteen years.

2(39)Dismissal
Termination of service of a worker by the
employer for misconduct.
2(45) Wages
All remunerations expressed in terms of Taka
Capable of being expressed in terms of Taka.
Whether the terms of the contact of
employment are expressed or implied, are
fulfilled,
Payable to any worker for his job or work
Shall include other additional remuneration of
the aforesaid nature.

2(57) Lock-out
The closing of a place of employment or part of such
place
The suspension wholly or the part of work by an
employer
Refusal absolute or conditional by an employer to
continue to employ any member of workmen employed
by him
Such closing suspension of refusal is or in connection
with an industrial dispute or is intended for the purpose
of compelling workmen employed to accept terms and
condition of employment.
2(58) Lay-off
The failure, refusal or inability of an employer
on account of shortage of coal, power or
material
Failure of employer to accumulate stock or
break-down of machinery to give employment
to a worker

Any dispute or difference between employers
and employers or between employers and
workers or between workers and workers
Connected with the employment or the terms
of employment or the condition of work of any

Meaning of Industrial Relation (IR)
In normal sense, the relationship between the owner and the
employees is called industrial relation.
But industrial relation is not that the relationship only exists
between owner and employees. Industrial relation is
accumulation of four types relation ship. That is:
Relationship between worker and machine.
Relationship between workers to workers.
Relationship between owner and workers.
Relationship between owners to owners.
Industrial relations deals with people at work or that
industrial relations is concerned with many problems related
to employer- employee relation

Collective Bargaining
The process is called collective because issues relating to
terms and conditions of employment are solved by
representatives of employees and employers in groups
rather than as individuals. The term bargaining refers to
reach an agreement by using methods like negotiations,
discussions, exchange of facts and ideas, rather than
confrontation.
The ILO defines CB as:
Negotiation about working conditions and terms of
employment between an employer, a group of employers
or one or more employers organizations, on the one hand,
and one or more representative workers organizations on
the other with a view to reaching agreement.

Meaning of Grievance
Michael Jucius defines a Grievance as any discontent
or dissatisfaction, whether expressed or not and
whether valid or not, arising out of anything connected
with the company, that an employee thinks, believes or
even feels, is unfair, unjust or inequitable.

According to International Labor Organization (ILO)
Grievance is a complaint of one or more workers in
respect of wages, allowances, conditions of work and
interpretation of service stipulations, covering such area
as overtime, leave, transfer, promotion, seniority, job
assignment and termination of service.
