A GUIDE IN

RECEPTION PROCEDURES
AND
CLASSIFICATION
STEP 1. CHECKING OF CREDENTIALS BY THE DESK OFFICER(D.O.)

STEP 2.
SEARCH OF DETAINEE/PRISONER BY THE SEARCHER

a. Strip Searching of Detainee/Prisoner;


b. Taking all cash and other personal property from the inmate and issue
receipt;
c. Turn-over all cash and valuables of the inmate to the Property Custodian
for safe keeping with official receipts.
STEP 3.
PHYSICAL EXAMINATION/APPRAISAL BY THE JAIL MEDICAL
PERSONNEL

a. Conduct a thorough medical examination of the inmate and check for body
vermin, cuts, bruises and other injuries and for needle marks to determine if
he/she is a drug dependent.
b. Observe the mental alertness, overall appearance, physical abnormalities, rashes,
scratches or other identifying marks of the inmate.
c. Inmate found with contagious disease or with psychological problems be
immediately isolated/segregated from other inmates.
d. A medical record is accomplished to include medical history(Vital Signs: PB,
Pulse Rate & Temperature)
e. Compare the findings with the medical certificate Issued by the Medico-legal
Officer upon his entry in jail.
STEP 4.
TAKING OF FINGERPRINTS AND PHOTOGRAPH, ACCOMPLISH A JAIL BOOKING,
AND COMPLETE THE DOCUMENTS REQUIRED IN THE CARPETA

Accomplish the Following Documents:

a. Fingerprint Specimen Sheet;


b. Jail Booking Report/Sheet;
c. Profile of Escapee;
d. Security Risk Factor Scoring Card;
e. Detainees Manifestation;

In addition to the above enumerated documents, the Carpeta should also contain the
following, to wit:
a. Commitment Order / Mittimus;
b. Complaint;
c. Information;
d. Pending Warrant;
e. Subpoena;
f. Decision/Judgment;
THE CARPETA SHOULD CONTAIN THE FOLLOWING INFORMATION:

The Warden establishes and maintains a record of all inmates, consisting of


information on the inmates name and alias(es), if any; weight, height and body
marks or tattoos, if any; nationality and, if a naturalized Filipino, his/her previous
nationality; previous occupation/ profession; prior criminal convictions; and
previous place of residence. In the case of a detainee, the record shall also
indicate the crime of which he/she was convicted; the sentencing court, his/her
sentence and the commencement date thereof; institutional behavior and conduct,
and the date he/she was received for confinement. In case of a detainee, the
record shall indicate the Criminal Case number in the trial court where the case is
pending, or the Case number in the appellate Court if the case is on appeal and
the status of the appeal; or the reason for his/her detention.
STEP 5.
ORIENTATION OF INMATE TO JAIL RULES AND POLICIES AND ABOUT ARTICLE 29
OF THE RPC/ R.A. 6125 (DETAINEES MANIFESTATION) BY THE CHIEF CUSTODIAL
OR THE OFFICER OF THE DAY

Appraise the detainee, preferably in the dialect which he/she understands,


that under Article 29 of the Revised Penal Code, as amended by R.A. 6127, that his
her preventive imprisonment shall be credited in the service of his/her sentence,
consisting of deprivation of liberty for the whole period he/she is detained if
he/she agrees voluntarily in writing to abide by the same disciplinary rules
imposed upon convicted prisoners; Provided, that he/she is not a recidivist, or has
not been previously convicted twice or more times of any crime; and when, upon
being summoned for the execution of his/her sentence, he/she surrendered
voluntarily.
If the inmate agrees to abide by the same disciplinary rules imposed upon
convicted inmates, he/she shall be asked to sign a Detainees Manifestation.
Otherwise, the Warden issues a Certification under oath to the effect that the
detainee was apprised of the provisions of Article 29 of the Revised Penal Code,
as amended, and that the detainee refused to abide by the rules imposed upon
convicted inmates.

An inmate who signs a Detainees Manifestation shall be treated as a


sentenced inmate insofar as work and discipline are concerned. Any failure or
neglect to perform his/her assigned work shall be sufficient cause for the
cancellation of the Manifestation. Thereafter, he/she shall not be treated as a
convicted inmate and cease to earn the privilege granted.
A detainee who is covered by a Certification is not required to work but
he/she may be made to clean his/her cell and perform such other work as may be
necessary for hygienic or sanitary reasons. He/she shall be credited with the
service of his/her sentence with four-fifths (4/5) of the time during which he/she
was detained.

The Warden submits the Detainees Manifestation or Certification as the


case may be, to the proper court before the date set for the arraignment of the
inmate and the same shall form part of the records of the case.

The same procedure shall be followed with respect to all accused persons
who have been convicted but whose cases are pending appeal before a higher
court. The Detainees Manifestation or Certification as the case may be, shall form
part of the records of the case. Full credit for the preventive imprisonment shall
commence from the date of the Detainees Manifestation.
Art. 29. Period of preventive imprisonment deducted from term of
imprisonment. Offenders who have undergone preventive imprisonment shall be
credited in the service of their sentence consisting of deprivation of liberty, with the
full time during which they have undergone preventive imprisonment, if the detention
prisoner agrees voluntarily in writing to abide by the same disciplinary rules imposed
upon convicted prisoners, except in the following cases:

1. When they are recidivists or have been convicted previously twice or more times
of any crime; and

2. When upon being summoned for the execution of their sentence they have failed to
surrender voluntarily.

If the detention prisoner does not agree to abide by the same disciplinary
rules imposed upon convicted prisoners, he shall be credited in the service of his
sentence with four-fifths of the time during which he has undergone preventive
imprisonment. (As amended by Republic Act 6127, June 17, 1970).
Whenever an accused has undergone preventive imprisonment for a period
equal to or more than the possible maximum imprisonment of the offense charged to
which he may be sentenced and his case is not yet terminated, he shall be released
immediately without prejudice to the continuation of the trial thereof or the
proceeding on appeal, if the same is under review. In case the maximum penalty to
which the accused may be sentenced is destierro, he shall be released after thirty (30)
days of preventive imprisonment. (As amended by E.O. No. 214, July 10, 1988).
AUTHORIZED DISCIPLINARY PUNISHMENT FOR INMATES

a. Reprimand
b. Temporary or permanent cancellation of some or all recreational privileges;
c. Cancellation of visiting privileges;
d. Extra-fatigue duty for sentenced inmates;
e. Close confinement in cell, provided that this punishment shall be imposed only in
the case of an incorrigible inmate, when other disciplinary measures had been
proven ineffective;
f. Transfer to another BJMP jail in the area, in coordination with the Court.
DISCIPLINARY BOARD

A Disciplinary Board shall be organized and maintained by jails for the


purpose of hearing disciplinary cases involving any inmate who violate jail rules
and regulations. It shall be composed o f the following:

CLASSIFICATION AND SEGREGATION OF NEWLY DETAINED INMATE

Composition of the Classification Board:

DUTIES AND FUNCTIONS OF THE CLASSIFICATION BOARD

The Classification Board is tasked to conduct background investigation of inmates


to determine the work assignment, type of supervision and degree of custody and
restrictions under which an inmate must live in jail. The investigation shall focus on:

a. Facts and data of the present case;


b. Earlier criminal history and if he/she is a recidivist or habitual delinquent, the facts about
his/her attitudes and behavior while confined in other institutions;
c. Biography or life history;
d. Medical History;
e. Vocational, recreational, educational and religious background/interests;
f. Psychological characteristics as evaluated by the psychiatrist and psychologist.
HABITUAL DELINQUENT DIFFERENTIATED FROM A RECIDIVIST

Recidivist is one who, at the time of his trial for one crime, shall have been
previously convicted by final judgment of another crime embraced in the same title of
the Revised Penal Code.

Habitual delinquent A person shall be deemed to be habitual delinquent, if within


a period of ten years from the date of his release or last conviction of the crimes of
serious or less serious physical injuries, robo, hurto, estafa, or falsificacion, he is found
guilty of any of said crimes a third time or oftener.
