-An intervention management operational plan to address

extra judicial killing.

 Both local and international human rights groups,
including the Media, have been expressing alarm and
concern about the mounting number of people who were
reported killed or wounded either in an alleged legitimate
encounter with police operatives or in an apparently
extrajudicial killing, in compliance with the President’s
policy to rid the country of the scourge of the proliferation
of dangerous drugs.
 As most of the cases involving an alleged extrajudicial
killings were perpetrated by vigilante groups mostly riding
in tandem; thus, nobody was arrested or prosecuted. The
public grew sceptical about the helplessness of the law
enforcement agency, the PNP and the NBI, to contain the
threat to peace and national security.
This is a widespread extensive crime watch program,
coupled with a 24 hour routine patrol monitoring and
police visibility in the community. It aims to saturate
and eradicate extra judicial killings and other
widespread crimes in the country by denying the
opportunity to the perpetrators by having Law
enforcement authorities and deputized force
multiplier detailed on the areas in coordination with
various government and non-governmental
organizations and volunteers.
I. Statement of Principles:
 a. Extra Judicial Killings, as one of the emerging
criminal problem in the country shall be eradicated.
 b. Perpetrators and remnants of the extra judicial
killings shall be arrested and put into bars.
 c. Zero casualty shall be achieved with the
employment of legal means.
 d. Justice shall prevail in the manner provided by law.
 e. Police visibility shall be the main contributory pre-
emptive measure to address extra-judicial killings.
 f. Proper coordination with the community, and
concerned authorities and volunteers shall be the main
arm of the program to address ejks.
 The main objective of the OPLAN id to eradicate extra judicial
killings as one of the emerging criminal problem in the country.

 The PNP intends to address the alleged extra judicial killings


perpetrated by vigilante groups and or wounded and or killed in
an alleged legitimate encounter with other police operatives.

 To simultaneously work on an extensive crime watch program,


parallel to a much extensive police visibility and routine patrol
with the full cooperation of the community and other NGOs and
volunteers.
 To tap the competent organizations to support and augment the
PNP actions and initiatives, such as the AFP Reserve Commands
 To establish a strong coordination with proper
authorities and agencies together with the community
in addressing the ejk problem.
 To strengthen the crime watch program of the
community in coordination with other non-
governmental organizations and volunteers with the
end in view of eradicating ejk.
 To increase public support towards the offensive action
against ejk.
 To increase the number of partnership and alliances
towards the eradication of ejk.
 To supplement the collaboration between policy
makers and partner government agencies and other
stakeholders

 RA 9851 - AN ACT DEFINING AND PENALIZING CRIMES AGAINST


INTERNATIONAL HUMANITARIAN LAW, GENOCIDE AND OTHER
CRIMES AGAINST HUMANITY, ORGANIZING JURISDICTION,
DESIGNATING SPECIAL COURTS, AND FOR RELATED PURPOSES

International Humanitarian Law is on the red light each and every time
an alleged Extra Judicial Killing case has been reported. As per the
humanitarian law advocates, there is a rampant violation of such a law.

Wilful killing
 Section 7. Penalties. - Any person found guilty of committing any of the
acts provided under Sections 4, 5 and 6 of this Act shall suffer the
penalty of reclusion temporal in its medium to maximum period and a
fine ranging from One hundred thousand pesos (Php 100,000.00) to Five
hundred thousand pesos (Php 500,000.00).
 The PNP utilizing its available resources, in cooperation
and coordination with the concerned government
authorities and other non-governmental organizations,
volunteers and the community shall undertake to suppress
lawlessness and extra judicial killings.
 Several activities through partnership with various groups
such as NGOs,, media entities, local government agencies
and the community should be undertaken to promote
awareness and attain the objective of the OPLAN.
 All the activities must be geared towards mind setting that
the success of the OPLAN is paramount to improve peace
and order situations and to eradicate extra-judicial killings.
 This operational plan is a continuing effort between
the coordinating agencies and teams which has 4
stages or phases. Coordination, Engagement, Support,
Monitoring and Evaluation.

COORDINATION. Proper coordination and


information dissemination to partner governmental
agencies and NGOs, the Volunteers and the Community
as well.

Coordination shall be made with the following


government agencies, stakeholders and non-
governmental organization to ensure success of the
OPLAN
 All concerned local police/units/stations shall
coordinate with the LGUs to provide support for
the activities and ensure cooperation of
subordinate offices.
 All local police shall also coordinate with the brgy.
Officials to seek assistance in the conduct of an
extensive Crime watch program, massive patrol
and visibility campaigns
 The chief of local police shall direct the police
community relations to coordinate with other
NGOs to solicit necessary support for the
operation.
 The PNP together with the concerned authorities shall
organize a 24 hour crime watch and routine patrol program
and visibility on each identified prone areas in cooperation
with the local community and volunteers.
 Brgy. Officials, Brgy Police in particular shall engage
routine patrol and monitoring in CCTV Cameras installed.
 The Reserve AFP personnel as per recommendation by
their respective reserve commands with active duty
training shall be mobilized and utilized as a force
multiplier to augment the PNP and law enforcement forces.
 PNP Force Multipliers shall provide assistance in the
conduct of the said operational plan.
 SUPPORT. The other organization, volunteers and
members of the community tapped will provide
necessary assistance and support in the completion
and success of the OPLAN.

 MONITORING AND EVALUATION. This shall be


undertaken through submission of the incident
reports from various sources. The OPLAN shall be
evaluated to asses if the desired objective are attained
and to determine the impact of such.
Directorate for Operations and Intelligence
 Provide appropriate support to the OPLAN
 Provide needed data and crime statistics and operational needs.
 Provide PCR related information
 Performs all task as directed.
Directorate for Comptrollership and Logistics
 Provide funds for the implementation of this OPLAN
 Perform tasks as directed
 Provide logistical support for the implementation of the OPLAN.
 Ensures the availability of transportation requirements in support
to maximum deployment of the personnel
Other Directorate Staff
 Provide appropriate support as necessary
 Performs other task as directed.
Police Community Relations Group
 Assist DPCR and DO in the implementation of this
OPLAN.
 Conduct PCR activities in relation to the OPLAN
 Provide PCR related info and activities
 Perform other task as directed

Police Regional Offices 1 – 13, COR, ARMM and NCRPO


 Provide appropriate support and assistance to other
Directorate offices in the implementation of the OPLAN.
 Implement the OPLAN.
 Supervise barangay related operations for confidence
building among members of the barangay to maximize
community involvement and volunteerism.
 Perform other tasks as directed.
COORDINATING INSTRUCTIONS

 All tasked offices and units shall render a monthly


report on the operation to the DPCR and DO.
 All tasked offices/units shall exercise initiatives and
resourcefulness in the conduct of the operation.
 All tasked units shall also be guided by the PNP
Operational Procedures in the implementation of this
OPLAN
 Lateral coordination is highly encouraged
 The life and limb of the initiators and actors in the
operation is at stake.
 The Force multipliers and the volunteers from the
community shall be properly equipped.
 The emergency hotlines shall be known by the
members of the community and the whole
coordinating teams.
 The important installations such as the nearest
hospitals, police precinct and assistance centre shall be
identified.
 Ambulance and Patrol cars should be on standby for
immediate mobilization if necessary.
VII. Dealing with the Media

Media has been one of the main contributor to


emerging issues about extra judicial killings in the
country. Information that is deemed confidential and
would compromise and prejudice the investigative
processes and police operations shall not be
communicated though media. Press conferences shall be
made from time to time about the status of the
operation to avoid misconception of news blackout.
The OPLAN is expected to make a difference and
eradicate or at least minimize and diminish the rampant
occurrence of extra judicial killings in the country. It is
expected to materialize with the end in view of the full
coordination and cooperation with the community and
the concerned government and non-governmental
organizations. It is expected to be the mover to utilize
the support coming from the AFP Reserve Commands
and an extensive crime watch program, parallel to a
much more massive police visibility and routine patrol.
